• 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING AHENDMENTS- TO .THE .
3 DECLARATION OF COVENANTS, CONDITIONS AND RE-
STRICTIONS IMPOSED UPON TRACT.NO. 4444

5 WHEREAS, the City Council by Resolution No. 5550 approved
6 the Declaration of Covenants, Conditions and Restrictions imposed
7 upon Tract No. 4444, which declaration was subsequently recorded in
8 Book 6014, page 726, Official Records of Orange County; and
9 WHEREAS, Resplan, Inc., as the.developer of said tract
10 and as the declarant in said declaration,has proposed certain
11 amendments to the declaration which according to the terms thereof
12 must be approved by the City of Newport Beach; and
13 WHEREAS, the City Council has reviewed said proposed
14 amendments and finds that they are in the interests of the declar-
15 ant and are not objectionable to the City;
16 NOW, THEREFORE, BE IT RESOLVED that said proposed amend -
17 ment to Section 1 of Article VII authorizing the assignee of an
18 owner or owners of the lots as provided in any first mortgage or fix
19 deed of trust to vote at any annual or special meeting of the mem-
20 bers of the Association, and the amendment to Paragraph b of Sectior,
21 2 of said Article VII authorizing the Board of Directors to estab-
22 lish lower fees than the $50 per month and the $60 per month estab-
23 lished therein, be approved, and that the Mayor and City Clerk be
24 authorized and directed to execute said amendments on behalf of
25 the City of Newport Beach.
