A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH FINDING THAT CERTAIN CITY- OWTED
WATER FRONT IS NOT SUITABLE FOR USE AS A PUBLIC
BEACH OR PARK
WHEREAS, the City holds title to the real property
after described; and
WHEREAS, said real property fronts on the Rivo Alto Canal
in NetTDort Bay; and
WHEREAS, Section 37351 of the Government Code of the Stat
of California provides that the legislative body of a city shall
not sell or convey any portion of a water front, except to the
State for use as a public beach or park, unless by a four-fifths
vote of its members the legislative body finds and determines that
the water front to be sold or conveyed is not suitable for use as
a public beach or park.; and
ti7tiEREAS, it appears that said property is not suitable
for use as a public beach or park and it would be in the public
interest to sell said property;
NOW, T&XREFORE, BE IT RESOLVED that the City Council
hereby finds that the hereinafter described parcel of real proper
is not suitable for use as a public beach or park:
All that certain land situated in the State of California,
County of Orange, City of Newport Beach, described as follmys:
Lot 4 in Bloch 434 of Canal Section, Newport Beach., as sho ^.an
on a Map recorded in Book 4, page 98 of Miscellaneous Taps,
'records of Orange County, California.
