2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH. RESCINDING RESOLUTION NO. 5194
3 RELATING.TO THE ACCEPTANCE OF.A DEED OF RIGHT
OF-WAY

5 WHEREAS, the City Council adopted Resolution No. 5194 on
6 the 28th day of March, 1960, purporting to accept a grant of ease -
7 ment for public road purposes over the real property in the City of
8 Newport Beach, County of Orange, State of California, described as
91 follows:

11 That portion of Lots 1 and 2, Tract No. 3232, recorded in
Miscellaneous Maps Book 99, pages 49 and 50, records of
12 Orange County, California, and described as follows:
13 Beginning at the intersection of the centerline of
Marine Avenue, 60 feet in width, as shown upon said
14 map of Tract No. 3232, with the U. S. Bulkhead Line
extending from U. S. Bulkhead Stations Nos. LOI.to
15 200, as said Bulkhead Line is shown upon a map dated
March 20, 1936, on file in the U. S. Engineers' Office,
16 Los Angeles, California, entitled "Harbor Lines Newport
Bay Harbor, California"; thence North 00 06' 3091 West a
17 distance of 106.00 feet; thence North 89° 53' 30Bt East
a distance of 30.00 feet to the true point of beginning;
18 thence North 0° 06' 3080 Vest a distance of 53.00 feet;
thence South 170 42' 0300 East a distance of 43.01 feet;
19 thence South 0° 06' 3000.East a distance of 24.00 feet;

Reserving unto the Grantor, its successors and assigns,
the right to construct, maintain and operate lines of any
and all kinds across, under or over said road or any part
thereof, including lines for the conveyance of water and
including lines for telephone, telegraph and electric power,
but so as not to interfere with the reasonable use for
public road purposes.
Subject to all existing easements, reservations, rights
and rights of way of record;
and
WHEREAS, the purpose of said grant of easement was to
develop a turn - around area in Marine Avenue between Bayside Drive
and the Balboa Island bridge; and
WHEREAS, it was subsequently determined that the develop -
meet of said -turn- around would be impractical; and
t5 WHEREAS, said deed of right of way was never physically
16 delivered to the City of Newport Beach;
17 NOW, THEREFORE, BE IT RESOLVED that Resolution No. 5194
18 is rescinded and that the City of Newport Beach hereby disclaims
19 any interest in the land hereinabove described.
