1 RESOLUTION NO. 5838
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
3 CONTRACT FOR CITY- FINANCIAL. CONTRIBUTION TO THE
COST OF CONSTRUCTING STORM.DRAIN IN MARINERS
4 DRIVE

6 WHEREAS, Baycrest Development Company is having storm
7 drainage facilities constructed in Mariners Drive between Commodore
8 Road and the flood control channel in Dover Drive in the City of
9 Newport Beach to serve the areas included within Tracts 3763 and
10 3764 being subdivided by said company; and
11 WHEREAS, it is desirable for the City to connect several
12 additional drainage inlets to said storm drainage facilities to
13 provide drainage for storm waters originating in tracts developed
14 previously to Tracts 3763 and 3764; and
15 WHEREAS, a contract has been prepared under which the
16 City would contribute the sum of $2,483.33 as its share of the
17 cost of said storm drainage facilities to pay for the construction
18 of said additional drainage inlets; and
19 WHEREAS, the City Council has reviewed the terms of said
20 contract and found the same to be fair and equitable;
21 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
22 Clerk are authorized and directed to execute the same on behalf of
23 the City of Newport Beach.
