2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NELSROLVI BEACH AUTHORIZING THE EIMCUTION OF. AN
3 AGREE1,017T U ITH BAYCREST DEVELOPMENT CO., SUB-
DIVIDER, FOR.THE CONSTRUCTION OF IMPROVEMENTS
4 IN TRACT N0. 3975

6 t•7IM'P.EAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which Baycrest Developmen
8 Co., a co- partnership., subdivider of Tract No. 3975, agrees to con -
9 struct street and other public improvements necessary to serve said
10 subdivision; and
11 WHEREAS, subdivider has furnished security to assure the
12 faithful performance under said agreement in accordance with the
13 Newport Beach Municipal Code; and
14 L EAS, the City Council has reviewed said agreement and
15 found the same to be fair and equitable and in accordance with the
16 provisions of the :ode;
17 N(YU, THEREFORE, BE IT RESOLVED that the Mayor and City
18 Clerk be and are hereby authorized and directed to execute the
19 same on behalf of the City of Newport Beach at such time as said
20 security is approved by the City Manager as to sufficiency and the
21 City Attorney as to form.
