RESOLUTION NO. fQyl
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX TO
THE CITY CERTAIN PROPERTY KNOWN AS ANNEXATION NO.
54 AND GIVING NOTICE THEREOF
WHEREAS, there is situated outside and contiguous to the
City of Newport Beach a certain uninhabited territory within the
meaning of the Annexation of Uninhabited Territory Act of 1939,
said territory being hereinafter more particularly described; and
WHEREAS, the City has received a written petition request-
ing annexation of said territory containing a description thereof
and signed by the owners of not less than one - fourth of the land in
said territory by area and by assessed value as shown on the last
equalized assessment roll of the County; and
WHEREAS, on or about the 4th day of September, 1963, there
was submitted to the Secretary of the Orange County Boundary Com-
mission a legal description and plat of the hereinafter described
uninhabited territory for its report, and said plat was filed with
the Registrar of Voters, pursuant to the provisions of Section
35002 of the Government Code of the State of California; and
WHEREAS, on the 23rd day of September, 1963, there was
filed with the City Clerk of the City of Newport Beach a report
of said Orange County Boundary Commission prepared pursuant to the
provisions of Section 35002 of said Government Code;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that proceedings are hereby initiated
to annex said territory hereinafter described, which territory is
contiguous to the present boundaries of said City and which said
territory now is uninhabited within the meaning of the Annexation
• of Uninhabited Territory Act of 1939 and that the reasons for
said annexation are that the owner or owners of said property have
petitioned for its annexation to the City of Newport Beach and it
would make municipal services available to said property and be
in the best interests of said owner or owners and the City and its
citizens that said City annex said territory.
NOTICE IS HEREBY GIVEN that it is proposed by said City
of Newport Beach to annex said hereinafter described territory to
said City, which said territory shall in these proceedings bear the
name of "ANNEXATION NO, 5411. The specific description of the bound-
aries of the territory so proposed to be annexed is as follows-
Portions of Lots B, C and D of the Banning Tract, Superior
Court Case 6385, Los Angeles County, California, Portion
of Lot 1 and all of Lot 2, Tract No. 463, as shown on a
Map thereof, Recorded in Book 32, pages 2 and 3, of
Miscellaneous Maps, Records of Orange County, California,
more particularly described as follows:
Beginning at the intersection of the centerline of 15th
Street with the centerline of Monrovia Avenue, as shown
on a Map thereof, Recorded in Book 65, pages 31 through
36 inclusive of Record of Surveys, Records of Orange
County, California; thence South 0° 37' 24" East along
the centerline of said Monrovia Avenue, a distance of
440.93 feet to the Northeasterly line of said Tract No.
463 and the True Point of Beginning of this description;
thence South 29° 26' 43" East along the said Northeast-
erly line, a distance of 1015.70 feet to the centerline
of Superior Avenue; thence South 39° 41' 15" West along
the said centerline of Superior Avenue, a distance of
705.55 feet; thence North 500 18' 45" West along the
Northeasterly line of the land described in a Deed to
A. E. S. Chaffey et al, Recorded in Book 4228, page 191
of Official Records of said Orange County, and the South-
easterly prolongation thereof, a distance of 152.00 feet
to the beginning of a tangent curve concave Southwesterly
and having a radius of 730.00 feet; thence Northwesterly
along said curve through an angle of 10° 13' 12 ", a
distance of 130.21 feet; thence North 840 49' 47" West,
575.70 feet to the beginning of a non - tangent curve
having a radius of 450.00 feet, a radial line from said
beginning bears North 310 40' 54" East; thence North-
westerly along said curve through an angle of 40 08' 51 ",
a distance of 32.57 feet to a line tangent; thence North
540 10' 15" West along said line tangent a distance of
659.54 feet; thence North 0° 38' 10 West, 2547.67 feet
to the Westerly prolongation of the centerline of 16th
Street; thence South 890 21' 50" West along the said
Westerly prolongation, 660.00 feet to a line parallel
with and 660.00 feet Westerly of the centerline of
Whittier Avenue, as said centerline is shown on said
Map Recorded in Record of Survey Book 65, pages 31 through
36 inclusive; thence North 0° 38' 10" West along said
parallel line, a distance of 1835.09 feet to the South-
westerly boundary line of the one foot wide strip of
land known as "The Westside Strip Parcel ", Annexed to
• the City of Newport Beach, Orange County, California
by Ordinance No. 630; thence South, 290 26' 43" East
along the said Southwesterly boundary line, a distance
of 2471.18 feet to an angle point in said boundary line;
thence North 890 23' 38" East along said boundary line,
1.14 feet to the Northeasterly line of said Tract No.
463; said Northeasterly line being the boundary line
of the said City of Newport Beach established by the

"Superior Avenue Annex. ", Annexed to said City by Ordi-
nance No. 820; thence South 29° 26' 43" East, 376.75
feet; to an angle point in the said City boundary line;
thence departing from said City boundary line South
29° 26' 43" East along the Northeasterly line of the said
Tract No. 463, a distance of 1256.97 feet to the True
Point of Beginning of this description.
FURTHER NOTICE IS HEREBY GIVEN that on Tuesday, the 12th
day of November, 1963, at the hour of 7030 P. M. on said day, or
as soon thereafter as the matter may be heard, in the Council
Chamber of the City Hall of the City of Newport Beach, 3300 Newport
Boulevard, Newport Beach, California, a hearing will be had, at
which hearing the City Council shall hear and pass upon all written
protests filed at any time prior to the final adjournment of the
hearing by any person owning real property within the territory pro-
posed to be annexed, and at any time prior to said final adjournment
any owner of property within the territory proposed to be annexed
may file a written protest against the annexation. The protest
shall set forth the name of the owner of the property affected and
give a description of the said property in general terms.
The City Clerk of the City of Newport Beach is hereby au-
thorized and directed to cause a copy of this resolution to be pub-
lished once a week for two weeks, said publication to be complete

at leas - days prior to the date set for the hearing,
and the publication shall be in the official newspaper of the City
and also in a newspaper of general circulation published outside
of the City but in the County in which is located the territory
proposed to be annexed.
The City Clerk is further authorized and directed to
mail a notice of the proposed annexation not less than twenty (20)
days prior to the first public hearing on the proposed annexation

to all persons to whom land proposed to
be annexed is
assessed in
the last available equalized assessment
roll, at the
address shown
thereon or as known to said City Clerk, and to any person who has
filed his name and address and the designation of the lands in
which he has any interest, either legal or equitable, with the City
Clerk.

The City Clerk is further authorized and directed to
transmit a certified copy of this resolution to the governing
board of each school district which is included in whole or in
part within the territory proposed to be annexed which has made
written request therefor.
