IMW 1 RESOLUTION NO. 5871
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
3 AGREEMENT WITH THE IRVINE COMPANY, SUBDIVIDER,
FOR.THE .CONSTRUCTION OF IMPROVEMENTS IN TRACT
4 NO. 5130

6 T RMREAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement in which The Irvine Company,
8 subdivider of Tract No. 5130, agrees to construct street and other
9 public improvements necessary to serve said subdivision; and
10 WHEREAS, said agreement provides that The Irvine Company
11 shall file with the City of Newport Beach a bond or other security
12 to assure faithful performance of said agreement; and
13 WHEREAS, the City Council has reviewed said agreement
14 and found the same to be fair and equitable and in accordance with
15 the provisions of the Code;
16 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
17 Clerk be and are hereby authorized and directed to execute the
18 same on behalf of the City of Newport Beach at such time as The
19 Irvine Company files said security with the City and the same is
20 approved by the City Manager as to sufficiency and the City Attorne3
21 as to form.
