III RESOLUTION NO. 5886
2 A RESOLUTION'OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
3 CONTRACT WITH THE COSTA MESA COUNTY WATER
DISTRICT

5 TrNiEREAS, the City of Newport Beach has entered into a
6 contract with the Santa Ana Heights Water Company, a California
7 corporation, for the purchase of the assets of said company; and
8 WHEREAS, the City has assumed the obligation to serve
9 water within the service area of said company; and
10 WHEREAS, said contract provides that the City may contract
11 with other water distributing agencies to assume the obligation of
12 service within portions of the service area of said company; and
13 WHEREAS, a contract has been prepared between the City
14 and the Costa Mesa County Water District under which said District
15 would assume the obligation to serve water within a portion of the
16 service area of the Santa Ana Heights Water Company immediately
17 after the City undertakes the service of water within said area;
18 and
19 WIMERMS, said contract also provides for the sale of a
20 portion of'the land and certain other assets being acquired by the
21 City from said company to the Costa Mesa County Water District; and
22 TVTHEREAS, the City Council has reviewed the provisions of
23 said contract and found the same to be fair and equitable;
24 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
25 Clerk be and are hereby authorized and directed to execute said
26 contract on behalf of the City.
