RESOLUTION NO. 5923
2 A EESOLUTION OF TIC CITY COUNCIL OF THE CITY
OF K-X1QU"PORT BEACH AUTHORIZING THE EXECUTION OF
3 A NOTICE OF CONSENT TO USE LAND

5 wHEREA5, the City of Newport Beach owns and maintains a
6 private access road along the northerly and easterly sides of its
7 property located easterly of Newport Boulevard and northerly of
8 32nd Street in the City and has recently granted a temporary non -
9 exclusive easement over a portion of said road to provide access
10 to property northerly thereof; and
11 WFIMMEAS, the added use of said private access road becaus
12 of such easement may give -the appearance of its being a public
13 street; and
14 WHEREAS, Section 813 of the California Civil Code author-
15 izes the owner of land to record in the office of the county
16 recorder a notice of consent to use the land or any portion thereof
17 for the purpose described in the notice, which notice is evidence
18 that subsequent use is permissive and with consent; and
19 MiffAS, there has been presented to the City Council a
20 Notice of Consent to Use Land prepared in accordance with said
21 section of the Civil Code by which the City would consent to the
22 use of its private access road for road purposes; and
23 WHZKMAS, the City Council has reviewed said notice and
24 determined the execution and recording thereof to be desirable and
25 in the public interest;
26 NOC79 THER11:FO-RE, BE IT RESOLVED that the I -iayor and City
27 Clerk are authorized and directed to execute said notice on behalf
28 of the City of Newport Beach, and the City Clerk is authorized and
29 directed to record the same in the County Recorderis office,
30 ADOPTED this 9th day of Marc z 9 /64-.
