2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING A NOTICE OF ADDITION OF
3 TERRITORY UNDER THE DECLARATION OF COVENANTS,
CONDITIONS AND RESTRICTIONS APPLICABLE TO TRACTS
4 NOS. 5463 AND.5480 AND.AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE_THE.SANE ON BEHALF OF THE.

7 WHEREAS, the City of Newport Beach executed Covenants,
8 Conditions and Restrictions applicable to Tract No. 5463 and Tract
9 No. 5480 pursuant to Resolution No. 5925; and
10 WHEREAS, a final map has been approved for Tract No,
11 5435 adjoining said tracts; And
12 WHEREAS, said Tract No. 5435 is a portion of the planned
13 residential development approved by Revised Use Permit No. 971;
14 and
15
WHEREAS, a notice of addition of territory has been pre-
16
pared and executed by Declarant as defined in the Declaration of
17
Covenants, Conditions and Restrictions applicable to said Tracts
18
Nos. 5463 and 5480; and
19
WHEREAS, said Covenants, Conditions and Restrictions
20
provide for the approval of the City to be endorsed on said notice;
21
N%J7 THEREFORE, BE IT RESOLVED that the notice of addiP
22
tional territory is approved by the City, and the Mayor and City
23
Clerk are authorized and directed to execute said notice on behalf
24
of the City.
