2 A RESOLUTION OF THE CITY COUNCIL OF THE. CITY OF
NE14PORT BEACH AUTHORIZING THE . ^CUTION OF A
3 CONTRACT

511 WRCAS, the City of Newport Beach owns the following
6 described property:
7 Parcel 1
8 All of Lot 1, Block 223, as shown on a map of Section A,
Newport Beach, recorded in Book 4, page 21, of Niscel-
9 laneous baps, Records of Orange County, California, and
all that portion of Block 222 of said Section A described
10, as follows:
11 Beginning at.the most northerly corner of said Block 222;
running thence south 46° 50' 30" east along the north -
12 easterly line of said Block 222.to the most northerly corner
of Lot 1, Tract 814, as shown upon a map recorded in Book
13 24, page 36, Records of said County; running thence south -
14 westerly along the northwesterly line of said Lot 1, Tract
814, to a point in the southwesterly line of said Block
222; thence northwesterly along the southwesterly line
15 of said Block 222 to the most westerly corner of said
16 Block 222; thence northeasterly along the northwesterly
line of said Block 222 to the point of beginning,

18 The property adjoining Parcel 1 described as follows:
19 Beginning at the most northerly corner of Lot 1, Block
223, as shown on a map of Section A, Newport Beach,
20 recorded in Book 4, page 21, of Niscellaneous Maps,
Records of Orane County, California; running thence

south 460 50' 39" east along the northeasterly line of
22 said Block 223 and Block 222 of said Section A to the
most westerly corner of Lot 1, Tract 814, as shown on
23 a map recorded in Book 24, page 36, Records of Orange
County, California; thence northeasterly along the
24 northeasterly prolongation of the northwesterly line
of said Lot 1, Tract 814, to an intersection with the
25 U. S. Government bulkhead line between U. S. bulkhead
station 120 and station 121, as shown on a map entitled
9Harbor Lines, Newport Harbor, California ", approved by
26 the Secretary of War, may 2, 1936, and on -file in the
27 office of the United States District Engineer in Los
Angeles, California; thence northwesterly along said
28 bulkhead line to an intersection with the northeasterly
prolongation of the northwesterly line of said Lot 11
Block 223; thence southwesterly along the northeasterly
29 prolongation of the northwesterly line of said Lot 1,

Block 223, to the point of beginning;

3211 1HEMAS, Section 1402 (b) of the Newport Beach Charter
11 provides that the City Council may sell and convey said property;

3j WHEREAS, a contract has been prepared under which the
4I City agrees to sell and Anthony Fools, Inc., a California corpora
• 5, tion, agrees to buy said real property; and
6I WHEREAS, said contract provides for payment to the City
7 in the sum of $155,000, which is equal to or higher than the fair
8 market value of said property; and
9 W11EREAS, said contract also provides for the buyer to pay
10 the cost of establishing the line of ordinary high tide adjacent to
11 said property; and
12 VMRE.AS, it appears to be in the best interests of the
13 City to execute said contract and sell the above described real
14 property pursuant thereto;
15 NOW, THEREFORE, BE IT RESOLVED that the Nayor and City
16 Clerk be and are hereby authorized and directed to execute said
17 contract on behalf of the City.
