A RESCLUTIOB? OF INTENTION OF THE CITY COUNCIL
OF TIM CITY OF NePORT. BEACH DECLARING ITS
INTENTION TO ORDER THE VACATION OF A D I:z G E
ZASMCHT IN ]LCT.32, TRACT 3201
The City Council of the City of Newport Beach, pursuant
to the provisions of the "public Service Easements Vacation Law"
and all amendments thereto, being Sections 50430, et sea,, of the
Government Code of the State of California, does hereby resolve and
declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of Newport
Beach to order, the vacation of a certain drainage easement in,
over and under that certain real property in the City of Newport
Beach, County of Orange, State of California, described as follows:
The southwesterly 6 feet of Lot 32, Tract 3201, as
per map recorded in Book 130, Pages 25 through 30,
inclusive, of miscellaneous Tviaps in the office of
the County Recorder of Orange County, California,
Said easement to be vacated is Flown on a certain map
entitled '16' Drainage Easement to be Vacated, Lot 32, Tract 320181,
being City of Newport Beach Public works Department Drawing No.
R /W- 5038 -L, dated 7 -6 -64, a copy of which is marked Exhibit "A" and
attached hereto and by this reference made a part hereof, and which
shall be kept on file in the office of the City Clerk as a part of
this resolution.
SECTION 2. The proposed vacation is not intended to and
shall not be construed to affect or impair that certain easement
for the purpose of constructing, operating and maintaining a seater
main and appurtenances in, over and under the Northwesterly 5 feet
of said Lot 32, Tract 3201, granted to the City of Newport Beach by
a document recorded in Book 5442, page 417, of Official Records of
Orange County, California.

SECTION 3. The proceedings for the vacation of said
21 easement are taken pursuant to, and the City Council of the City

3 of Newport Beach hereby elects to proceed under the provisions of,

4 the "Public Service Easements Vacation Lawry and all amendments
51 I thereto, being Sections 50430 to 50445, inclusive, of the Govern -
6 1 meat Code of the State of California.
71 SECTION 4. The Public Works Director of the City of
81 Newport Beach shall cause to be conspicuously posted along the line
9 of said easement proposed to be vacated, not more than 300 feet
10 apart and not less than three in all, notices of the vacation of
11 said easement. The notices shall state the passage of this resolu-
12 tion of intention and the time and place of the hearing before the
13 City Council of all persons interested in or objecting to the
14 proposed vacation. Said notices shall be posted at least ten days
15 before the date of said hearing.
16 SECTION 5. Notice is hereby given that the City Council
17 of the City of Newport Beach does hereby fix Monday, the 14th day
18 of September, 1964, at the hour of 7:30 o'clock P. K. on said day,
19 in the Council Chamber located in the City hall of the City of
20 Newport Beach at 3300 Newport Boulevard, Newport Beach, California,
21 as the time and place for hearing all persons interested in or
22 objecting to the proposed vacation of said easement.
23 SBCTI ®N 6. A notice of the hearing hereinbefore set,
24 giving the date, time and place of said hearing, shall be published
25 by the City Clerk in the official newspaper of the City once each
26 week for at least two successive weeks prior to said hearing.
