HomeMy WebLinkAbout6026 - Tract 3201 Drainage Easement Vacationti So�P 9.2 90 Pk 90 T1I :me 9/ /64 (12) 1 RESOLUTION NO. 6Q26 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE VACATION OF A DRAINAGE 3I EASEMENT IN LOT 32,.TRACT 3201 4 51 WHEREAS, the City Council of the City of Newport Beach 6' � did, on the 10th day of August, 1964, pass its certain Resolution 7� of Intention No. 6016, declaring its intention to order the vacatia 8 of a certain drainage easement in the City of Newport Beach, here- 9 inafter more particularly described, pursuant to and in accordance 10j with the "Public Service Easements Vacation Law// and all amendments 11 thereto, being Sections 50430 to 50445, inclusive, of the Govern- 12 meat Code of the State of California; and 13 WHEREAS, the Public Works Director of the City of Newport 14 Beach has caused to be conspicuously posted along the line of said 15 easement proposed to be vacated, not more than 300 feet apart and 16 not less than three in all, notices of the vacation of said easemen 17 and said notices were posted at least ten days before the date of 18 the hearing of all persons interested in or objecting to the pro- 19 posed vacation, all of which will more fully appear from the 20 affidavit of Joseph T. Devlin, Public Works Director of the City 21 of Newport Beach, on file in these proceedings; and 22 WHEREAS, said notices so posted by the Public Works 23 Director of the City of Newport Beach stated the passage of said 24 Resolution of Intention No. 6016 aforesaid, and the time and place 25 of the hearing before the City Council of all persons interested in 26 or objecting to the proposed vacation of said easement; and 27 WHEREAS, the City Council of the City of Newport Beach 28 did set Monday, September 14, 1964, at 7:30 o ;clock P. M, on said 2.9 day as the time, and the Council Chamber located in the City Hall 30 of the City of Newport Beach at 3300 Netrgort Boulevard, Newport 31 Beach, California, as the place, for hearing all persons interested 32 - _0 8 z 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29, 30 31 32 �s in or objecting to the proposed vacation of said easement; and WHEREAS, a notice of said hearing, giving the date, time and place thereof, was published in the official newspaper of the City once each week for at least two successive weeks prior to said hearing, all of which will more fully appear by the affidavit of William M. Schmidt, Advertising Manager of the Newport Harbor News Press -Daily Pilot, said official newspaper, on file in these pro- ceedings; and WHEREAS, the City Council of the City of Newport Beach has heard the evidence, both written and verbal, of all persons interested in the vacation of said easement in this resolution more particularly hereinafter described, and finds from all the evidence submitted that said easement described in said Resolution of Inten- tion, and hereinafter described, is unnecessary for present or prospective public use; NOW, THEREFORE, the City Council of the City of Newport Beach finds and determines and hereby orders that the drainage easement in, over and under that certain real property in the City of Newport Beach, County of Orange, State of California, described as follows; The southwesterly 6 feet of Lot 32, Tract 3201, as per map recorded in Book 130, Pages 25 through 30, inclusive, of Miscellaneous Maps in the office of the County Recorder of Orange County, California, is unnecessary for present or prospective public use, and that it be vacated.
