HomeMy WebLinkAbout6036 - Ocean Front Vacationr 64 (12) `r 1 RESOLUTION N0. 6036 2 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF- NEWPORT BEACH DECLARING ITS 3 INTTENTION TO ORDER THE CLOSING UP, VACATION AND ABANDOMENT OF A PORTION OF A CERTAIN 4 STREET KNOWN AS OCEAN FRONT 5 6 The City Council of the City of Newport Beach, pursuant 7I to the provisions of the t°Street Vacation Act of 1941`9, and all 8 amendments thereto, being Sections 8300 to 8331, inclusive, of 9� the Streets and Highways Code of the State of California, does 10 hereby resolve and declare as follows: 11 SECTION 1. The public interest and convenience require 12 the closing up and abandonment of a portion of a certain street 13 known as Ocean Front in the City of Newport Beach, and it is the 14 intention of the City Council of the City of Newport Beach to 15 order the following described portion of said street in the City 16 of Newport Beach, County of Orange, State of California, to be 17 vacated, closed up and abandoned, to wit: 18 Beginning at the most southerly corner of Lot 1, 19 Block D, Seashore Colony Tract in the City of Newport Beach, County of Orange, State of California, as per map recorded in Book 7, Page 25 of xiscel- 20 laneous Flaps in the office of the County Recorder of said County; thence northwesterly along the 21 northeasterly line of Ocean Front (50 feet wide), 22 formerly known as Ocean Avenue, to.the most south- erly corner of Lot 2 of said Block D; thence south - 23 westerly along the southwesterly prolongation of the southeasterly line of said Lot 2 to a line parallel 24 with and distant southwesterly 15 feet (measured at right angles) from said northeasterly line of Ocean 25 Front; thence southeasterly along said parallel line to the southwesterly prolongation of the south - 26 easterly line of said Lot 1; thence northeasterly along said southwesterly prolongation of the south - 27 easterly line of said Lot 1 to the point of beginning. 28 All that portion of said street to be vacated, closed up 29 and abandoned is more clearly shown on a certain map approved and 30 adopted by the City Council of the City of Newport Beach for said 31 vacation, closing up and abandonment, by resolution dated September 32 14, 196 4, and designated "Resolution No. 6027P°, which said map is 2. 1 on file in the office of the City Clerk of the City of Newport 2 Beach. Reference is hereby made to said map for further particulars 3i as to the proposed vacation, closing up and abandonment of said 4 portion of said street, and said map is made a part of this resolu- 5 tion by this reference to the same extent and purpose as if it were 6 incorporated herein in full. 7 SECTION 2. The proceedings for the closing up and aban- 8 donment of the aforesaid portion of said street shall be had and 9 taken, and the City Council of the City of Newport Beach hereby 10 elects to proceed under the provisions of the "Street Vacation Act 11 of 1941 ", and all amendments thereto, being Sections 8300 to 8331, 12 inclusive, of the Streets and Highways Code of the State of Cali - 13 fornia. 14 SECTION 3. The Street Superintendent of the City of 15 Newport Beach shall cause to be conspicuously posted along the 16 line of the portion of said street proposed to be vacated not more 17 than 300 feet apart, but not less than three in all, notices of 18 the vacation of said portion of said street. Said notices shall 19 state the passage of this Resolution of Intention and the time and 20 place of the hearing of all persons interested in or objecting to 21 the proposed vacation of said portion of said street. Said 22 notices shall be so posted at least ten days before the date of 23 said hearing, all as required by law. 24 SECTION 4. Notice is hereby given that the City Council 25 of the City of Newport Beach does hereby fix Monday, the _ (ofd, day 26 of October, 1964, at the hour of 7:30 otclock P. M. of said day, in 27 the Council Chambers of the City of Newport Beach, located in the 28 City Hall of the City of Newport Beach, as the time and place for 29 hearing all persons interested in or objecting to the proposed • 30 vacation of said portion of said street, and the City Council at • 31 said time and place will hear the evidence offered by any person 32 interested in the vacation of said portion of said street 2. I' hereinbefore described. 2 SECTION 5. Resolution No. 6028 is hereby rescinded. 3 SECTION 6. This Resolution of Intention shall be pub - I 4 lished at least once in the official newspaper of the City, and 5 said publication shall be made before the date set for the hearing 6 of all persons interested in or objecting to the proposed vacation. 7 ADOPTED this 28th day of September, 1964. 9 Mayor 10!
