RESOLUTION NO. 6043
A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF MIPORT.BEACH DECLARING ITS .
INTENTION TO ORDER THE VACATION OF A PORTION
OF A PUBLIC UTILITY EASEMENT.IN LOT 132 TRACT
5169
The City Council of the City of Newport Beach, pursuant
to the provisions of the "Public Service Easements Vacation Law"
and all amendments thereto, being"Sections 50430, et seq., of the
Government Code of the State of California, does hereby resolve and
declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of Newport
Beach to order, the vacation of a portion of a certain public
utility easement described as follows;
That portion of that certain Public Utility Ease-
ment, 10 feet in width, in Lot 13, Tract 5169, in
the City of Newport Beach, County of Orange, State
,of California, as per map recorded in Book 190,
pages 11 to 13 inclusive of Miscellaneous Maps of
said County, bounded southerly by a line bearing
South 820 09` 22" West which passes througgh a pint
in the centerline of said easement North 45° 34' 27"
East 54.27 feet from the most southwesterly corner .
of said Lot 13, and bounded easterly by the westerly
line of that certain Public Utility Easement, 20
feet in width, as shown on said maps.
The portion of said easement to be vacated is shown on a
certain map entitled "Abandonment of Public Utility Easement in Lot
13, Tract No. 516959, being Drawing No. 5169 -8 -L of The Irvine
Company dated 9/17/64, a copy of which is marked Exhibit 97A" and
attached hereto and by this reference made a part hereof, and
which shall be kept on file in the office of the City Clerk as a
part of this resolution.
SECTION 2. The proceedings for the vacation of said
portion of said easement are taken pursuant to, and the City
of the City of Newport Beach hereby elects to proceed under the
provisions of, the 9?ublic Service Easements Vacation Lau" and all
Iii amendments thereto, being Sections 50430 to 50445, inclusive, of the
211 Government Code of the State of California.

SECTION 3. The Public Works Director of the City of

Newport Beach shall cause to be conspicuously posted along the line

of the portion of said easement proposed to be vacated, not more
•

than 300 feet apart and not less than three in all, notices of the
7
vacation of said portion of said easement. The notices shall state
8
the passage of this resolution of intention and the time and place
I
9
of the hearing before the City Council of all persons interested in
10
or objecting to the proposed vacation. Said notices shall be posted
11
at least ten days before the date of said hearing.

SECTION 4. Notice is hereby given that the City Council
13
of the City of Nermort 3each does hereby fix Noonday, the `AW day
14
of November, 1964, at the hour of 7:30 o'clock P. H. on said day, in
15
the Council Chamber located in the City Hall of the City of Newport
16
Beach at 3300 Newport Boulevard, Newport Beach, California, as the
17
time and place for hearing all persons interested in or objecting
18
to the proposed vacation of said portion of said easement.

SECTION 5. A notice of the hearing hereinbefo-re set,
20
giving the date, time and place of said hearing, shall be published
21
by the City Clerk in the official newspaper of the City once each
22 week for at least two successive weeks prior to said hearing.
23 ADOPTED this 19th day of October, 1964.
