RESOLUTION NO. 6056
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF'AN
AGREEMENT FOR PAYMENT OF.PROPERTY OWNER'S SHARE
OF THE COST OF CONSTRUCTION OF CERTAIN IMPROVEMENTS
® WHEREAS, City intends to enter into a contract providing
for the construction of the Miscellaneous Storm Drain Construction
• of 1964-65, Contract No. 925; and
WHEREAS, included in said contract is the construction
of a storm drain connecting to the natural drainage course crossing
certain property in Block 336, Corona del Mar Tract, and it would
be of benefit to the owners of said property to have the storm
drain extended across their property; and
WHEREAS, there has been presented to the City Council of
the City of Newport Beach an agreement between the City and
HAL WILL SMITH an owner of certain property in said
Block 336, by the terms of which the City would include in said
Contract No. 925 provision for the construction of a 48" diameter
drain pipe across said owner's property and said owner would pay
the City his share of the cost thereof; and
WHEREAS, the City Council has reviewed said agreement.
and found the same to be fair and equitable;
NOW, THEREFORE, BE IT RESOLVED that said agreement is
approved and the Mayor and City Clerk are hereby authorized and
directed to execute the same on behalf of the City of Newport
Beach.
