HomeMy WebLinkAbout6059 - Tract 5169 Public Utility Easement8ti -e�Z 73i� f-77 - 39 TH x- 114/64 (12) 1 RESOLUTION NO. 6059 2I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BUACK ORDERING THE VACATION OF A PORTION 3 OF A PUBLIC UTILITY EASEMENT IN LOT 13, TRACT 5169 4 . 5 J,=,MhS, the City Council of the City of Newport Beach 6 did, on the 19th day of October, 1964, pass its certain Resolution 71 Intention No. 6043, declaring its intention to order the vaca, 8 I tion of a portion of a certain public utility easement in the City 9 of Newport Beach, hereinafter more particularly described, pursuant) 10 to and in accordance with the "Public Service Easements Vacation 11 Laws' and all amendments thereto, being Sections 50430 to 50445, 12 inclusive, of the Government Code of the State of California; and 131 WHEREAS, the Public Works Director of the City of Newport 14 Beach has caused to be conspicuously posted along the line of the 15 portion of said easement proposed to be vacated, not more than 300 16 feet apart and not less than three in all, notices of the vacation 17 of said portion of said easement, and said notices were posted at 18 least ten days before the date of the hearing of all persons inter - 19 ested in or objecting to the proposed vacation, all of which will 20 more fully appear from the affidavit of Joseph T. Devlin, Public 21 Works Director of the City of Newport Beach, on file in these pro - 22 ceedings; and 23 WHE71IBAS , said notices so posted by the Public Forks 24 Director of the City of Newport Beach stated the passage of said 25 Resolution of Intention No. 6043 aforesaid, and the time and place 26 of the hearing before the City Council of all persons interested in 27 or objecting to the proposed vacation of said portion of said 28 easement; and 29 WHEREAS, the City Council of the City of Newport Beach 30 did set Monday, November 9, 1964, at 7:30 o1clock P. N. on said . 31 day as the time, and the Council Chamber located in the City Pall 32 of the City of Newport Beach at 3300 Newport Boulevard, Newport 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29. 30 31 32 Beach, California, as the place, for hearing all persons interested in or objecting to the proposed vacation of said portion of said easement, and WHEREAS, a notice of said hearing, giving the date, time and place thereof, was published in the official newspaper of the City once each week for at least two successive weeks prior to said hearing, all of which will more fully appear by the affidavit of William M. Schmidt, Advertising Manager of the Newport Harbor News Press -Daily Pilot, said official newspaper, on file in these pro- ceedings; and FT&?RFAS, the City Council of the City of Newport Peach has heard the evidence, both written and verbal, of all persons interested in the vacation of said portion of said easement in this resolution more particularly hereinafter described, and finds from all the evidence submitted that said portion of said easement described in said Resolution of intention, and hereinafter describ is unnecessary for present or prospective public use; NOW2 THER2FORB, the City Council of the City of Newport Beach finds and determines and hereby orders that the portion of a certain public utility easement described as follows; That portion of that certain Public Utility Base- ment, 10 feet in width, in Lot 13, Tract 5169, in the City of Newport Beach, County of Orange, State of California, as per map recorded in Book 190, pages 11 to 13 inclusive of Miscellaneous Maps of said County, bounded southerly by a line bearing South 820 09' 22" West which passes througgh a point in the centerline of said easement North 45° 34' 272' East 54.27 feet from the most southwesterly corner . of said Lot 13, and bounded easterly by the westerly line of that certain Public Utility Easement, 20 feet in width, as shown on said maps, is unnecessary for present or prospective public use, and that it I be vacated. The City Council further orders that the City Clerk of the City of Newport Beach shall cause a certified copy of this order, duly attested by her as the City Clerk, under the seal of 2.
