15 output, which will necessitate increasing the height of the exist -
16 ing radio tower on said City -owned property to an approximate height
17 of 350 feet; and
18 WHEREAS, Success Broadcasting Company has requested that
19 the City Council authorize such height increase by appropriate
20 amendment of the license agreement of 1961, as subsequently amended
21 and
22 WHEREAS, such an amendment to license agreement has been
23 presented to the'City Council and the City Council has considered
24 the terms and conditions thereof and found them to be fair and
25 equitable;
26 NOW, THEREFORE, BE IT RESOLVED that said amendment to
27 license agreement be approved and the Mayor and City Clerk are
28 hereby authorized and directed to execute the same on behalf of the
29 City of Newport Beach.

WHEREAS, the City of Newport Beach and Newport -Costa Mesa

Broadcasting, Inc., entered into a license agreement dated February

1961, under which said broadcasting corporation was granted 'a licen,

and permit to construct and maintain a radio transmitter and radio

tower on certain City -owned property as described therein, which

license agreement was amended by an amendment thereto dated December
