A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING AN EASEMENT DEED

WHEREAS, the County of Orange has executed and delivered

to the City of Newport Beach an Easement Deed dated December 9,

1964, granting to the City a perpetual easement for the purpose of

operating and maintaining a water main and appurtenances in, over
Bland
under that certain real property in the County of Orange, State

of California, described as follows:

That portion of Block 50, Irvinets Subdivision, in
the County of Orange, State of California, as per
11
map recorded in book 1, page 88 of Miscellaneous
Record Naps in the office of the County Recorder
12
of said County, described as follows:

A strip of land 20 feet in width, the southerly
line thereof being parallel with and distant
14
northerly 40 feet (measured at right angles) from
15
the following described center line:

Beginning at a point in the northwesterly line of
said Block, distant South 39° 50t 5011 B9est thereon
17
1200.4+1 feet from the northerly corner of said
Block, said point being the beginning of a curve
18
concave southerly and having a radius of 1200 feet,
the southeasterly terminus of said curve being
19
tangent to the northeasterly line of said Blocky
thence easterly along said curve, through a central
20
angle of 90° Olt 10" an arc distance of 1885.36
feet to said tangent northeasterly line.

Except that portion thereof lying northwesterly of
22
a line parallel with and distant southeasterly 40
feet (measured at right angles) from said north -
23
westerly line of Block 50.

also except that portion thereof lying easterly of
the center line of MacArthur Boulevard, (100 feet

wide) as described in a deed recorded January 10,
1963-in book 6389, page 651 of official records of
26
said County;
2711 which provides, however, that in the event future use by the Grantor
28 of the property encumbered by said easement necessitates a rearran
29 ment, relocation, or reconstruction of any facilities now existing
3O later installed pursuant to said easement, said facilities will
• 31 promptly be rearranged, relocated, or reconstructed at no expense
321 to the Grantor; and

1� WHEREAS, it is to the interest of the City is accept said
2 Easement Deed for such purposes;
3 NO% THEREFOIRE, BE IT RESOLVED that said Easement Deed is
41 hereby accepted and the City Clerk is authorized and directed to
51 execute and attach thereto a certificate of acceptance and consent
6 to its recording and to record said document in the County Recorder*
7i office.
