HomeMy WebLinkAbout6086 - Utility Easements 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27i 28L 29 30 31 32 A 64 (12) RESOLUTION N0. 6086 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ACCEPTING A UTILITY EASEMENT WHEREAS, Irvine Industrial Complex, a California corpora- tion, has executed and delivered to the City of Newport Beach a Utility Easement dated November 6, 1964, granting to the City a n exclusive easement for the purpose of operating and maintaining a water main and appurtenances in, over and under that certain real property situated in the County of Orange, State of California, described as follows: Parcel #1 Those portions of Blocks 49 and 50, Irvine's Subdivision in the County of Orange, State of California as per map recorded in Book 1, Page 88 of Miscellaneous Record Maps in the office of the County Recorder of said County, described as follows: Beginning at the intersection of the north- easterly line of Campus Drive (80 feet wide), formerly Paularino Avenue, as described in a deed recorded January 2, 1963 in Book 6380, Page 88 of Official Records of said County, with the center line of Jamboree Boulevard (60 feet wide), formerly.San Joaquin Road as described in a deed recorded July 15, 1940 in Book 1055, Page 115 of said Official Re- cords; thence North 500 08' 00" West 2762.10 feet, along said northeasterly line to the beginning of a tangent curve concave southerly having a radius of 1240.00 feet; thence north- westerly and westerly 928.93 feet along said curve being also the northeasterly and northerly line of said Campus Drive, through an angle of 42° 55' 2191 to the center line of MacArthur Boule- vard (100 feet wide), as described in a deed recorded January 10, 1963 in Book 6389, Page 641 of said Official Records, a radial line to said point bears North 30 03' 2111 West; thence North 120 19' 1549 East 18 feet, more or less, along said center line to the westerly prolongation of the generally southerly line of that cer- tain easterly parcel of land shown on a map filed in Book 55, Page 32 of Record of Surveys of said County, said southerly line being a curve concave southerly having a radius of 1250.00 feet; thence easterly along said westerly prolongation to the westerly terminus of said curve, a radial line to said westerly ter- minus bears North 00 47' 0518 East; thence easterly and southeasterly 852.64 feet along said curve and southerly line through an angle of 390 04' 5519 to a radial line which bears 0 • � z _ 1 North 39° 52' 00" East; thence tangent South 500 08' 0011 East -99,56 feet along the south - 2 westerly line of said easterly parcel of land to an an §le point therein; thence continuing 3 South 50 08 00" East 2672.51 feet, along a line parallel with and distant 10.00 feet 4 northeasterly from said northeasterly line of Campus Drive to said center line of Jamboree 5 Boulevard; thence South 390 49' 40" West 10.00 6I feet along said center line to the point of be- ginning. 71 Except that portion thereof included within Jamboree Boulevard (60 feet wide), formerly 8 known as San Joaquin Road, as described in a deed recorded July 15, 1940 in Book 1055, Page 8 115 of said Official Records. 10I Parcel #2 11 That portion of Block 50, Irvine's Subdivision, in the County of Orange, State of California 12 as per map recorded in Book 1, page 88 of Miscellaneous Record Maps in the office of the 13 County Recorder of said County, described as follows: 14 A strip of land 10 feet in width, the southeasterly 15 line of-said strip being described as follows: 16 Beginning at the intersection of the southwesterly line of Campus Drive (80 feet wide), formerly 17 Paularino Avenue, as described in a deed record- ed January 2, 1963 in Book 6380, Page 88 of 18 Official Records of said County, with the north - 19 westerly line of Jamboree Boulevard, (60 feet wide), formerly San Joaquin Road, as described 20 in a deed recorded July 15, 1940, in Book 1055, Pa §e 115 of said Official Records; thence South 21 39 49' 40" West 1910.72 feet along said north- westerly line to the beginning of a tangent 22 curve concave southeasterly and having a radius of 1030 feet, said point of curvature being in 23 the northeasterly right of way line of Jamboree Boulevard, (80 feet wide), formerly San Joaquin 24 Road, as described in a deed recorded January 5, 1950 in Book 1950, Page 84 of said Official 25 Records, said curve also being concentric with that certain center line curve of said Jamboree 26 Boulevard described in said last mentioned deed as being concave southeasterly and having a 27 radius of 1000 feet, a central angle of 47° 28' 10 ", and an arc length of 831.41 feet; thence 28 southwesterly along said first mentioned curve through an angle of 13° 51' 45" an arc distance 29 of 249.20 feet to a point in the southeasterly line of the northwesterly one half of the south - 30 easterly one half of said Block 50, said last mentioned point being also the southwesterly 31 prolongation of the center line of said Jamboree Boulevard; thence South 39° 49' 40" West 1745 32 feet along said southeasterly line and its south- westerly prolongation to the easterly line of 2. F I MacArthur Boulevard (110 feet wide), as described in a deed recorded July 25, 1940 in Book 1047, 2• Page 557 of said Official Records. 3 The northwesterly line of said 10 foot strip of land to be shortened to terminate southwesterly 4 in said easterly line of MacArthur Boulevard and prolonged northeasterly to terminate in said 5 southwesterly line of Campus Drive. 6 SUBJECT TO any and all existing easements and rights of way of record or of which the Grantee has actual notice in, 7 under, over, along and across said lands. 8 RESERVING UNTO THE GRANTOR, its successors and assigns, the right to use said land for any use or purpose which 9 shall not interfere with or endanger the use by the Grantee of said easement including but not limited to the right to 10 construct, relocate, repair, maintain and use and dedicate streets, alleys, roadways and fences on, in, over, across 11 and along said land; provided however, that no permanent structures of whatever nature or kind, except as therein 12 provided, shall be erected, placed or maintained upon any portion of said easement; 13 14 and 15 WHEREAS, it is to the interest of the City to accept said 16 Utility Easement for such purposes; 17 NOW, THEREFORE, BE IT RESOLVED that said Utility Easement 18 is hereby accepted and the City Clerk is authorized and directed to 19 execute and attach thereto a certificate of acceptance and consent 20 to its recording and to record said document in the County Recorder' 21 office, 22 ADOPTED this 28th day of December, 1964. 23 24 Mayor 25 ATTEST:, 26- _ 4 � t l•l_.L 2.t.E 27 - City Clerk 28 2Q 30 • 31 32 3. 0 STATE OF CALIFORNIA ) COUNTY OF ORANGE ) CITY OF NEWPORT BEACH) I, MARGERY SCHROUDER, City Clerk of the City of Newport Beach, California, do hereby certify that according to the records of the City of Newport Beach filed and maintained in my office, the foregoing Resolution No. 6086 was duly and regularly adopted, passed, and approved by the City Council of the City of Newport Beach, California, at a regular meeting of said City Council held at the regular meeting place thereof, on the 28th 19 64 by the following vote, to wit: day of December , AYES, COUNCILMEN: Stoddard, Forgit, Cook, Gruber, Elder, Parsons NOES, COUNCILMEN: None ABSENT, COUNCILMEN: Marshall Dated this 31St day of December 19 64 City Clerk a d E -Officio Clerk of the City Council, City of Newport Beach, State of California.
