21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
KZWPORT BEACH AUTHORIZING THE E.tECUTION OF A
3 REIY-BURSE1,1ENT AGREEVENT WITH THE BLUFFS FOR THE
4 WROVM -1E TT OF MSTBLUFF P&M
5 WHEREAS, the City of Newport Beach is the owner of a park
6 site in the Eastbluff area of the City where the need exists for a
7 public park; and
8 WHEREAS, The Bluffs, the developer of a planned residen-
9 tial community in the area surrounding said park site, has offered
10 to loan the City sufficient funds to pay for the improvement of
11 said park site as a public park and the City is willing to reimburse
12 said developer from the tax revenues accumulated in a special capita]
13 outlay fund pursuant to Chapter 8 of Article VI of the Newport Beach
14 Municipal Code; and
15 WHEREAS, there has been presented to the City Council a
16 reimbursement agreement between the City and The Bluffs providing
17 for the improvement of said public park and payment therefor as
18 hereinabove mentioned; and
19 WHEREAS, the City Council has considered the terms and
20 conditions of said agreement and found them to be reasonable and
21 equitable;
22 NOW, THEREFORE, BE IT RESOLVED that said reimbursement
23 agreement be approved and the Mayor and City Clerk are hereby
24 authorized and directed to execute the same on behalf of the City
25 of Newport Beach.
