(� This AGREEMENT FOR ALE OF SURPLUS PROPERTY ( "Agreement') is
M made this day 1 2013 ( "Date of Sale ") by and between the City of
Newport Beach, a California municipal corporation and Charter City ( "City"), and
Roberts Waste and Recycling, a California corporation ("Buyer"). For good
consideration it is agreed between the parties that:
1. City agrees to sell, and Buyer agrees to buy the following described surplus
property:
Two (2) Ford F -350 Trucks with Packer Body ( "Vehicles ") described as:

2. Buyer agrees to pay to City the total purchase price of Twenty Thousand Dollars and
no /100 ($20,000.00); payable by January 3, 2013:

3. City warrants it has full legal title to said Vehicles.
4. Said Vehicles are sold in "as is" condition, City disclaiming any warranty of
merchantability or working order or condition of the Vehicles except that they shall
be sold in their present condition.
5. Buyer shall pay all taxes, costs, and fees imposed by any governmental entity upon
the Vehicles as well as all operating costs and expenses associated with the
Vehicles.
6. The parties agree that the City will be released of all liability resulting from the
operation of the Vehicles effective upon the Date of Sale (Vehicle Code § 5602).
The city shall cause the Notice of Release of Liability to be properly filed with the
California Department of Motor Vehicles upon the Date of Sale.
7. The parties agree to transfer title upon receipt of the payment, at the address of the
City Corporate Yard located at:

8. This Agreement shall be binding and inure to the benefit of the parties, their
successors, assigns and personal representatives.
IN WITNESS WHEREOF, the parties have caused this Agreement to be
