HomeMy WebLinkAbout8382 - Underground Utility District 4A ...n RESOLUTION NO. 8382 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 4 AND ORDERING THE REMOVAL OF POLES, OVERHEAD WIRES AND ASSO- CIATED OVERHEAD STRUCTURES AND THE UNDERGROUN INSTALLATION OF WIRES AND FACILITIES FOR SUPPLYING ELECTRIC, COMMUNICATION OR SIMILAR OR ASSOCIATED SERVICE WITHIN THAT AREA OF THE CITY LOCATED WITHIN SAID DISTRICT WHEREAS, Chapter 15.32, entitled "Underground Utilities ", of the Newport Beach Municipal Code, authorizes the City Council to call public hearings to ascertain whether the public health, safety or welfare require the removal of poles, overhead wires and associated overhead structures within designated areas of the City, and underground installation of wires and facilities for supplying electric, communication, or similar services; and WHEREAS, on the 15th day of October, 1974, the City Council took action to set a public hearing on the 25th day of November, 1974, at 7:30 p.m., for the purpose of determining whether an underground utility district should be established within that certain territory referred to as Underground Utility District No. 4, which is hereinafter described; and WHEREAS, notices have been sent to all property owners within the territory proposed to be included within said under- . ground utility district, in the manner prescribed by said Chapter 15.32 of the Newport Beach Municipal Code; and WHEREAS, after consideration of all protests to the formation of said Underground Utility District No. 4, the City Council has determined that the public health, safety and welfare require the formation of said District; NOW, THEREFORE, the City Council hereby FINDS, DETERMINES AND ORDERS: Section l: The public necessity, health, safety • and welfare require the removal of poles, overhead wires and associated overhead structures used to supply electric and telephone service and their installation underground within the following described area of the City of Newport Beach: -1- 5; That portion of Blocks 55, 93 and 94 of Irvine's Sub- division as shown on a map recorded in Book 1, Page 88 of Miscellaneous Record Maps in the office of the County Recorder of Orange County, California, described as follows: Beginning at the intersection of the centerlines of the right -of -way of Jamboree Road and East Coast Highway as shown on Resubdivision No. 242 recorded in Book 12, Page 21 of Parcel Maps records of Orange County, Cali- fornia; thence S 780 33' 07" E 365.23 feet along the centerline of East Coast Highway to the True Point of • Beginning; thence N 12" 35' 39" E 60.77 feet to the Northerly right -of -way line of East Coast Highway as described in the deed recorded in Book 9062, Page 194 of Official Records; thence Easterly along said right - of -way line to an intersection with the northerly right - of -way line of East Coast Highway (100 feet in width) as described in the deed recorded in Book 487, Page 3 of official records; thence continuing Easterly and Southeasterly along said Northerly right -of -way line to the Southerly corner of Resubdivision No. 213 as recorded in Book 7815, Page 557 of Official Records, a radial to said corner bears N 40" 32' 33" E; thence Northerly 100.00 feet along said radial to a line parallel with and 100.00 feet Northeasterly measured at right angles from said North- erly right -of -way line of East Coast Highway; thence Southeasterly along said parallel line to a line parallel with and 430.00 feet Northwesterly from the centerline of the right -of -way of Newport Center Drive, having a bearing of N 40" 32' 33" E as shown on a map of Tract No. 6015 recorded in Book 239, Page 28 of Miscellaneous Maps; thence Northeasterly along last said parallel line to a line parallel with and 380.00 feet Northeasterly measured at right angles, from said Northerly right -of -way line of East Coast Highway; thence Southeasterly 860.00 feet along last said parallel line to a line parallel with and 430 feet Southeasterly, measured at right angles, from said centerline of right -of -way of Newport Center Drive; thence Southwesterly along last said parallel line to the Northeasterly right -of -way line of East Coast Highway, having a bearing of S 43" 44' 49" E as shown on the map of said Tract No. 6015; thence S 43° 44' 49" E 121.49 feet to an intersection with the northerly right -of -way line of said East Coast Highway (100.00 feet in width); thence Southeasterly along said Northerly right - of -way line to the Northeasterly prolongation of the Northwesterly right -of -way line of Dahlia Avenue; thence Southwesterly along said prolongation and the Northwesterly right -of -way line of Dahlia Avenue to the Southerly right - of -way line of East Coast Highway; thence Northwesterly and Westerly along said Southerly right -of -way line of East Coast Highway to an intersection with the Southwesterly prolongation of that certain course described as North 12° 35' 39" E 60.77 feet; thence North 12" 35' 39" East along said prolongation to the True Point of Beginning. The City Council further finds that: (1) The streets on which the work is to be performed are extensively used by the general public and carry a heavy volume • of pedestrian or vehicular traffic; and (2) The streets adjoin or pass through a public recreation area and an area of unusual scenic interest to the general public. Section 2: The above - described area is hereby declared to be an underground utility district, to be known as Underground -2- • L` Utility District No. 4, and the affected utility companies and property owners are ordered to cause the required removal and underground installation work to be done. Section 3: The date by which the required removal and underground installation work is to be accomplished and by which the affected property owners must be ready to receive underground service is ,T „no 2n ia7s Section 4: The City Clerk is directed to notify all affected utility companies and all persons owning property within said District of the adoption of this resolution within ten (10) days after its effective date, in accordance with Section 15.32.080 of the Newport Beach Municipal Code.
