A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE
IMPLEMENTATION OF THE 208 EARLY ACTION AND
INTERIM PLAN FOR THE CONTROL OF SEDIMENTATION
IN UPPER NEWPORT BAY AND ACCEPTANCE OF AN
ENVIRONMENTAL DOCUMENT.
WHEREAS, under Section 208 of the Federal Water
Pollution Control Act, the City of Newport Beach, in conjunction
with other public agencies, is engaged in studies to control
sedimentation of Upper Newport Beach; and
WHEREAS, this program calls for the preparation of an
Early Action and Interim Plan to Control Sedimentation pending
adoption of permanent measures, and such early action and interim
plan has been completed; and
WHEREAS, the City of Newport Beach has certified the
Final Environmental Impact Report (EIR) prepared for said Early
Action and Interim Plan; and
WHEREAS, the City Council has reviewed and considered
the certified final EIR in making its decision on the proposed
project, and has further determined that the EIR has been
prepared in compliance with and satisfies the requirements of the
California Environmental Quality Act and the State EIR
Guidelines; and
WHEREAS.,, the environmental documentation includes the
proposed mitigation measures, statement of facts and statement of
overriding considerations; and
WHEREAS,'the
City Council
of the City of
Newport
Beach
desires that said
Plan
be utilized
to protect Upper
Newport
Bay
from sedimentation,

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Early Action and Interim Plan
for Control of Sedimentation of Upper Newport Bay be and it is
hereby approved.
BE IT FURTHER RESOLVED that the City Manager of the
City of Newport Beach is hereby authorized and directed to take
such steps as are necessary to ensure the implementation of the
Early Action and Interim Plan for Control of Sedimentation of
Upper Newport Bay.
ADOPTED this 22nd day of June 1981.
