HomeMy WebLinkAbout11015 - Vacating & Abandoning an Access EasementRESOLUTION NO. 11015 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SUMMARILY VACATING AND ABANDONING AN ACCESS EASEMENT TO BIG CANYON RESERVOIR (DWG R/W - 5444 -L) WHEREAS, an access easement has heretofore been granted to the City of Newport Beach to provide access to Big Canyon Reservoir, which access easement is both depicted and described on the drawing and description form prepared by the Public Works Department of the City of Newport Beach, and which drawing and description form are attached hereto as Exhibit "A "; and WHEREAS, the access easement described above has remained continuously unused by the City of Newport Beach for access or other public purposes for more than five years immediately preceeding the date of this Resolution; and WHEREAS, there are no public utility facilities in place that would be affected by the! vacation of this access easement; and WHEREAS, no public money has been expended for the maintenance of this access easement during such five year period; and WHEREAS, this easement is unnecessary for the present or perspective public use and it is the desire of the City of Newport Beach to summarily vacate and abandon this easement pursuant to the summary vacation procedures authorized in Chapter • 4, Part 3, Division 9 of the Streets and Highways Code of the State of California (Sections 8330 through 8336). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the access easement depicted and • legally described in Exhibit "A" be summarily vacated and abandoned; and BE IT FURTHER RESOLVED that the City Clerk shall cause a certified copy of this Resolution and exhibit, attested by the City Clerk, under seal, to be recorded in the office of the Recorder of the County of Orange; and BE IT FURTHER RESOLVED that from and after the date this Resolution is recorded, the access easement depicted and legally described in Exhibit "A" shall no longer constitute an access easement. That portion of Block 96 of Irvine's Subdivision as shown upon a map recorded in Book 1, Page 88 of Miscellaneous Record Maps, Records of Orange County, State of California, described as follows: Beginning at a point which is the southwesterly corner of that certain "Reservoir Site," conveyed to the City of Newport Beach and described in a deed recorded in Book 4143, Page 395, Official Records of said Orange County, which point is also a point in the northerly line of Pacific View Drive; thence along the most westerly boundary of said "Reservoir Site," North 18059'26" West a distance of 30 feet; thence South 71000'34" West to an inter- section with a curved line, said curved line being the northerly line of said Pacific View Drive having a 40- foot -wide right -of -way as recorded by description in Book 4143, Page 400, Official Records of.said Orange County; thence along said northerly line on a curve concave to the northeast and having a radius of 358.98 feet, in a southeasterly direction to the point of beginning, which point is also the end of curve of said Pacific View- ar_ive.
