RESOLUTION NO 11023
• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH SUPPORTING SB 358 TO AMEND THE EDUCATION CODE,
PART II, COMMENCING WITH SECTION 18010, BY ADDING
CHAPTER 1.5, PUBLIC LIBRARY FINANCE
WHEREAS, Public libraries are a source of information and
inspiration to persons of all ages, cultural backgrounds, and economic
statuses, and as such deserves adequate financial support from
government at all levels; and
WHEREAS, current law provides for a program of grants and
reimbursements to libraries under the California Library Services Act,
and;
WHEREAS, Senate Bill 358 has been introduced in the California
Senate to amend the Education Code, Part II, Section 18010 by adding
Chapter 1.5, Public Library Finance; and
WHEREAS, it is the intent of the Legislature under Chapter 1.5
to initiate a specific program providing equitable and adequate funds to
the public libraries of the state, and which, historically dependent for
their support on local property tax revenues, face a fiscal crisis as a
result of the tax limitations imposed by Article XIII A (Proposition 13)
of the California Constitution which fiscal crisis has not been suffi-
ciently resolved through application of existing statutes; and
• WHEREAS, SB 358 provides permanent, stable, and predictable
financing for public libraries regardless of the taxable wealth of the
local jurisdiction providing the service; and

WHEREAS, SB 358 provides an appropriate amendment to the
Education Code, Part II, Section 18010 for a feasible plan of State
• participation in the funding of public libraries with no loss of local
control;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Newport Beach that it expresses its strong support in favor of
Senate Bill 358, urges its early adoption by the Legislature and
immediate approval by the Governor of the State of California.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to send copies of this resolution to the
members of the State Legislature representing Newport Beach, to all
cities in Orange County, and to the Orange County Division of the
League of California Cities.
