RESOLUTION NO. 11085
A RESOLUTION OF THE CITY COUNCIL,OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A RESCISSION AGREEMENT
IN CONNECTION WITH A PUBLIC! WORKS CONTRACT
WITH B -1 ENTERPRISE CORPORATION
WHEREAS, there has been presented to the City Council
of the City of Newport Beach a certain Rescission Agreement
between the City of Newport Beach and B -1 Enterprise Corporation,
in connection with proposed reconstruction of curb and sidewalk
along Pacific Coast Highway between Avocado and Poppy Avenues;
and
WHEREAS, the City Council has reviewed the report from
the City Attorney's office and the Public Works Department which
considered, among other things, the rescission of Contract No. C-
2266 previously entered into with B• -1 Enterprise Corporation, and
finds that it would be in the best :interests of the City to
rescind Contract No. C -2266 which is now in effect.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the Rescission
described is approved, which agreement will &
rescind Public Works Contract No. C -2266 with
Corporation, and the Mayor and City Clerk are
and directed to execute same on behalf of the
Beach.
