HomeMy WebLinkAbout98-7 - Residential Drug or Alcoholism Rehab ProgrRESOLUTION NO. 98 -7 • A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, RECOMMENDING THAT PERSONS UNDER COURT JURISDICTION WHO ARE REQUIRED TO PARTICIPATE IN A RESIDENTIAL DRUG OR ALCOHOLISM ABUSE REHABILITATION PROGRAM BE REQUIRED TO ATTEND A RECOVERY OR TREATMENT FACILITY THAT IS LICENSED BY THE CALIFORNIA DEPARTMENT OF ALCOHOL AND DRUG PROGRAMS. WHEREAS, Sober Living Homes are defined as any house, institution, hotel or other similar place that supplies room and board, or rooms only, and operates as a drug and alcohol -free residential facility; and WHEREAS, the Fair Housing Act was established in 1968 to prohibit housing discrimination based on race, color, religion, national origin or sex, and was subsequently amended to extend its protection to include certain individuals participating in rehabilitation programs because of an alcohol or drug dependency as well as persons suffering from chemical dependency; and WHEREAS, the number of Sober Living Homes is growing at a significant rate, • with the vast majority of such homes being located in residential neighborhoods; and WHEREAS, only 25% of Sober Living Homes are licensed by the California Department of Alcohol and Drug Programs, and the remaining 75% of Sober Living Homes are not subject to state regulatory guidelines, state monitoring procedures, or other requirements imposed by the Department of Alcohol and Drug programs; and WHEREAS, while the City of Newport Beach believes that the court should ensure that individuals required to participate in a residential drug or alcohol abuse rehabilitation program do so in any licensed Sober Living Home or other state licensed treatment facility; NOW, THEREFORE, the City Council of the City of Newport Beach hereby resolves as follows: 1. That any person under court jurisdiction, who is released on probation, parole, conditional sentence or a suspended sentence on the condition that he or she participate in a residential drug or alcoholism abuse rehabilitation program should be required to participate in a licensed alcoholism or drug abuse recovery or treatment facility. u • 2. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. BE IT FURTHER RESOLVED, that the City Manager is authorized to sign all documents and to carry out the provisions of this Resolution. ADOPTED, this 26th day of January '1998.
