SURPLUS PROPERTY DONATION AGREEMENT
his AGR �MENT FOR DONATION OF SURPLUS PROPERTY ("Agreement"} is made
this__., day o _—, 2014 ("Date of Donation") by and between the CITY OF
NEWPORT BEACH, a C lifornia municipal corporation and charter city ("City`), and the CITY
OF ORANGE, a California municipal corporation ("Donee"). It is agreed between the parties
that:
City agrees to donate, and Donee agrees to accept the following described controlled
surplus property ("Property„) valued at approximately $4,575:
6- 12 sets of electrical Hot Sticks; and
R 45 sets of electrical gloves.
Z Said Property is donated in "as is" condition and the City disclaims any warranty of
merchantability or working order or condition of the Property except that they shall be
donated in their present condition. City has not made any representations or warranties,
implied or express, relating to the condition of the Property.
The parties agree that the City will be released of all liability resulting from the use,
maintenance, storage or possession of the Property effective upon the Date of Donation.
4. The parties agree to transfer the Property at the address of the City Corporate Yard located
at:
City of Newport Beach
Corporate Yard
592 Superior Ave.
Newport Beach, CA 92662
5. This Agreement shall be binding and inure to the benefit of the parties, their successors,
assigns and personal representatives.
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed on
the dates written below.

SURPLUS PROPERTY DONATION AGREEMENT
