A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DEDICATING PARCELS OF LAND 1'0 PUBLIC USE FOR STREET
AND HIGHWAY PURPOSES ADJACENT TO PACIFIC COAST HIGHWAY AND
EASTERLY OF FERN STREET, AND ACCEPTING THE OFFER THEREOF
• WHEREAS, the public interest, convenience and safety require the
widening of Pacific Coast Highway between Newport Boulevard and Highland Street;
and
WHEREAS, the widening of the Highway requires construction of a curb
return and sidewalk at the intersection of Pacific Coast Highway with Fern
Street and construction of a sound wall easterly of Fern Street which will
encroach on a parcel of land owned in fee by the City; and
WHEREAS, the parcel of land required for construction of the curb
return, sidewalk and sound wall is presently, improved and used for alley
purposes; and
WHEREAS, it is proper for the City to dedicate this parcel of land to
be used for street and highway purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that the City property described and shown on attached Exhibit
"A ", incorporated herein by this reference as if fully set forth be and is
hereby dedicated to public use for public street and highway purposes.
BE IT FURTHER RESOLVED that it is in the public interest to accept the
dedication of the above described property for public street and highway
purposes and the same is hereby accepted by the City of Newport Beach for public
street and highway purposes.
BE IT FURTHER RESOLVED that the City Clerk is authorized and directed
to cause a certified copy of this resolution to be recorded in the Official
Records of Orange County, California.
