Commissioner Brenne'r asked that her name be added to the
roll call as being present at the last meeting. Motion was
made by Brenner and seconded by de Boom to approve the
minutes of the September 3, 1985 meeting as corrected.

Following questions and discussion, motion was made by,Brenne
to• adopt the proposed amendment to Policy I -9 as written.

Following discussion, it was 'decided to table this item until

would also like to See the restaurant's proposed plans and
get public input on this matter.

Concern was expressed by the Commission as to the negative
atmosphere new members may encounter at Oasis.
Ron Whitley suggested the Recreation Committee meet with
Commissioner Springer, liaison to Oasis, to help with
aaenda items at quarterly meetings.

will come before this Commission.

Information from Neil Fairbanks, the architect who de-
signed the new restroom at the Balboa Pier, was provided
in the agenda packet and representatives from Ruby's ,
Restaurant are present to address the issue and answer
any questions. The Commission's recommendation will be
sent to the City Manager and then to Council.
Mr. Douglas S. Cavanaugh, owner of Ruby's Restaurant,
addressed the Commission. He reported Ruby's opened in
1982 and has grown at such a successful rate that they
have outgrown their present.storage site which will not eve
handle one day's supplies.
Mr. Cavanaugh explained that the City receivesfunds from
their lease rental and that their proposal is to convert
the present restroom scheduled for demolition to a ware-
house for storing food stufft. Ruby's would be responsible
for all costs of conversion', maintenance, landscaping, etc.

He passed out the proposed original plans for the ramp for
the handicapped which.would be modified by lowering its
elevation. They will pay for the new drawings which would
have to be drawn.
Mr. Cavanaugh addressed the issue of demolition costs which,
he felt, would be negligible and the additional revenue
the City would receive from the lease. He then addressed
the matters objected to in a letter from the General
Services Director
Mr. Cavanaugh explained that their present warehouse is
totally inadequate and that use of the City building would
make Ruby's more efficient and profitable. He'made refer-
ence to letters passed out to the Commission from the Balboa
Improvement Association and Peninsula Point Association
wherein both Associations recommend leasing the building
to Ruby's for storage. He reiterated they would pick up
all costs, if not exorbitant, resulting from the design
change plus all maintenance. Storage would be for food
stuffs only. Since they would be leasing the building, he
agreed it could be'taken away from them and demolished if
there were any problems such as maintenance, etc.
Mr. Cavanaugh pointed out that Ruby's is a City facility
which produces revenue for the City. He said Ruby's is

not trying to take anything away from the public and that
the proposed area for the building is never used.

Ron Whitley reported staff has no recommendation and that
the major concern should be if it serves the community.
He also brought up the idea of using the building for both
additional food service and storage.
During discussion Springer expressed concern over using
public property for private use when there are storage
alternatives available.
Wolfe moved the Commission approve the concept of the
existing Balboa Pier restroom's conversion to a storage
room-for Ruby's Restaurant subject to the Commission's
acceptance of the architect's,plans; and that there will be
no cost to the City;, the storage use will be for only food
stuffs for Ruby's Restaurant; and the building is main-
tained to the City's satisfaction. Seconded by Hopkins.
Unanimous.

• Ron Whitley reported the Commission's joint meeting with the
December 9
City Council is scheduled at their Study Session on
1:30 P.M.
December 9 at 1:30 P.M.
Following discussion, it was decided that Oasis-and capital
improvements will be on the agenda at the Study Session in
addition to asking for Council's recommendations for the
Commission. Wolfe will develop the Oasis topics and Ron
Whitley will draft the agenda for Commission approval on
December 3.
For informational purposes, Councilwoman Jackie Heather
asked that the Department gather data on the formulation of
a Teen Commission. This information has been obtained and
transmitted to Council and they have appointed an Ad Hoc
Committee to study the matter.

Ron Whitley reported Sterling Wolfe, Robert Hopkins and

in San Francisco the end of October. They all felt the

sessions were excellent and very beneficial. Wolfe said he
felt it was very worthwhile and thanked the City for
allowing him to participate.

Ron Whitley passed out an evaluation of the City's parks "
and public areas for Commission Fdview. This is done on an
annual basis from a maintenance standpoint, however, 90%
are usually funded out of the M &O account. Current projects
shoul.d also be evaluated.
For informational purposes, Mr. Whitley reported that the
Community Youth Center does not have sufficient funding to
complete the project. West Newport needs more funds to
accomplish the existing projects. Bonita Creek Park is in
a preliminary design state. 'The present preliminary cost
estimate is too high and the reserve fund from in lieu fees
from Belcourt will not be enough for this project."
Item #10 - Beach Bike Trail

Chair Wolfe reported Bill Ficker was concerned with the
methodology used by the City's private engineer hired to
design the beach bike trail. Since the committee wants a
more accurate traffic count, it was decided to postpone a
decision until a count can be made in the summer. As a
result of this postponement, the beach encroachment matter
will be postponed until after the bike trail matter has
been resolved.
Ron Whitley reported that the Department will be submitting
a request for capital improvements to build a new multi-
purpose building at Mariners.Park. The Commission should
contact the Board of Trustees of the Library as to their
intentions since they are planning to fund a computer system
and may not want to remodel.

Mr. Whitley also reported the Newport Aquatic Center, a non-
profit corporation, is still trying to, raise funds for the
Aquatic Center. Council approved the Commission's recom-
mendation for the Nautical Museum which is now occupying
the 17th Street site which they intend to remodel.
Mr. Whitley reported the City owns 7J acres of West Bay Park
which is an archeological site. Since there are no resident
there is no need to develop a park site. At present there
is discussion concerning building a major regional. ,park on
this land which would be a County facility.

to have him aboard.

Chair Wolfe recommended a map or brochure be prepared which
would include information on the City's facilities, parks,
the Commission, etc. Ron Whitley suggested a brochure be
prepared as it would be impossible to include everything
the City offers on a map. Ron Whitley and Mark Deven will
follow up on this matter.
Hopkins , suggested, and it was agreed, to utilize the water
bill to transmit information to the community.

Dear Mr. Whitley;
It has come to my attention that the City of Newport
Beach is considering not demolishing the existing public
toilet building at Balboa Pier after the completion of the
new restroom facility. It is my understanding that the ex-
isting toilet building would be used as a storage facility
• for the restaurant at the end of the pier. As the project
architect for the new public restroom and plaza, I would like
to make several comments:
(1) The new restroom project now under construction
calls for a concrete,ramp and walkway to be built
connecting the Balboa Pier with the new structure.
If the existing restroom building remains, the new
ramp and walk cannot be built. Since the ramp pro-
vides handicap access to the new building; the new
facility would then not be in compliance with State
handicap requirements.

(2) The new restroom and plaza was designed to maximize
pedestrian circulation at the foot of the pier.
Leaving the existing facility definitely blocks
pedestrian movement. Patrons would be forced to
walk through the existing parking lot to gain access
to the new restroom.
(3) The construction contract now in effect requires
the contractor to remove the existing toilet build-
ing. Utility lines to the new facility requires
that the existing facility be removed. If the ex-
isting restroom remains, the City will have to issue
• a change order to redesign and reroute the new
utilities. This would be a very costly change.
(4) It would be difficult to understand why the City
would spend $142,500.00 to build a beautiful new
restroom and plaza space, then block the view of it
from the pier. There have- been numerous complaints
about the existing building. It is in f6ct 'pan eye
sore"' It would aesthetically be inappropriate to
leave the existing building.
I would strongly recommend that you demolish the existing
restroom as per contract documents already in effect. I would
be glad to discuss the matter further and appreciate the op-
portunity of stating my views.

SUBJECT: RETENTION OF BALBOA PIER RESTROOM FOR USE BY RUBYS.

RECOMMENDATION:
I do not recommend retention of the Balboa Pier restroom for
use by Ruby's restaurant.
DISCUSSION:
That restroom has been the target of many citizen's groups as
being most undesirable. Now that we are getting it replaced,
I believe it would be in the best interest of the whole city
to have it removed as soon as the new one is complet.ed.
Mr. Cavanaugh already has off site storage on th.e mainland,
right in the Balboa area. I believe -that space is adequate
for most of the summer season, and probably all of the winter
season.
• Demolition of the old building is included in the contract
price for the new one. I'm sure that the contractor included
salvage value of anything usable in the old building.
The City would have to re- negotiate that part of the contract,
at least.
In summary, retention of the old building would certainly detract
from the overall appearance of the new one, and would reduce
the overall benefit from the new building. I do'not recommend
it.

To our suprise and delight, Ruby's Diner has continually exceeded our sales
projections each and every year. From the City's perspective this means
an increase in this years revenues from the concession to an amount of
approximately $751,000. This continual increase in sales volume carries with
it the need for increased storage space. Presently, Ruby's cannot store
enough product to handle the demand for even one day.
• We understand the City will soon begin construction on a new restroom facility
at the base of the Balboa pier that will be built adjacent to the old one. We
would like to propose renting the old facility from the City and use it as
warehouse space for Ruby's Diner. This proposal would save the City whatever
the costs of demolition would be for the old building and would provide
additional revenues for the City from its rental. The only change to the
plans for the new facility would be a possible'relocation of the proposed'
handicapped ramp that is now shown going directly across the site of the old
building. Perhaps this ramp could be designed to service both the handicapped
traffic and the warehouse. We would agree to pay for all costs of converting
the old restroom into a warehouse and would also be responsible for building
maintenance.

To prepare for proposals to be submitted for consideration as
Capital Improvements for Fiscal Year 1986 -87, the attached is
an assessment of existing facilities with regard to condition and
possible improvement. Many of the items are to be included in
the M &O portion of our budget.
In addition, the Commission subcommittee should meet during November
to review possible proposals of new facilities and /or additional
appropriations for current projects. A review of our Park and
Recreation Element and future new residential development will aid

As I explained to you in our phone conversation, I am interested in
getting some water lines. We want water alon3 the fence to cover the
wire fence, dirt road, oil tankers, pumps and storage tanks on the edge
of our canal.
We also hope that some greenry along this area will work as a sound
barrier to noise from trucks and squeaking pumps.
.There are many home owners that will donate plants and plant them
but this will not be practical if there is not water available to keep
• them alive.
There is presently water at a nearby pumping well that is owned by the
city. I have already talked to Newport Oil and they own the property
and fence. We have permission to plant and add water.
I will be happy to meet with your committee and point out the exact
area I am referring to.

1. A professional study,of the problems and needs
of increasing senior citizen population in the City of
Newport Beach with emphasis on unmet current needs and
services, lastest elderly demographies, and determination
"whether a second senior citizen center is needed in the
western area of the City across the bridge.

Many times a job well done goes unmentioned', however, on behalf of the
Harbor View Community Association (Phase I), I want to take this oppor-
tunity to express our sincere appreciation for the tremendous cooperation
and support we received from the Parks & Recreation Department in providing
a picnic area near our clubhouse.
Since its installation, homeowners and guests have been continually using
this facility. It not only adds to the overall benefit of the common area
park and volley -ball area, but it has brought a new dimension to the local
neighborhood' "get- togethers ".
It should also be recognized that we appreciated the special efforts and ad-
vice of Mr. Jack Brooks and Ron Whitley. They have been most helpful from
the initial discussions in upgrading the overall common area. People using
this area lately have frequently indicated their pleasure of the facility
and generous praise of the city for its installation and park maintenance
program.
For the Board of Directors of the homeowners, we appreciate your cooperative

OCTOBER, 1985 PROGRESS REPORT
Our Park Crews performed the following tasks in addition to
normal maintenance during the month of October:
Removed debris behind CYC.
Spread wood chips at the Groves.
Installed irrigation and landscape and laid sod and
installed mower strip at City Hall.
Installed jute and grade at Cliff Drive Park.
Removed two old playground structures at Balboa Pier
playground.
Installed basketball court, installed mower strip around
Japanese Lantern at Irvine Terrace Park.
Installed temporary retaining wall at State Beach.
• Our Street Tree Division performed the following:
Trimmed 702 trees.
Planted 15 trees.
Removed 9 trees.
Root pruned 8 trees.
Completed 20 Work Requests.
Areas being trimmed are Spyglass Hills and Poppy in Corona del Mar.

RECREATION DIVISION
• OCTOBER, 1985 PROGRESS REPORT
Contract Classes
The month of October finds us adding the finishing touches on the new Winter
1986 Brochure. You will find a new section including One Day Workshops and
Seminars that we are very excited about. Publication of the brochure is set
for December 6.
One of our special' holiday activities will include the Lido Village Merchants.
Much like our Easter program with the Eastbluff Merchant Association, the Lido
merchants will work with the Recreation Department to provide a special Holiday
Celebration including a tree decorating contest, arts and crafts, movies and
Santa. We are very excited to be working with the many businesses in Newport
Beach and we believe it is a great partnership!
Aquatics and Tennis
Classes are running smoothly although attendance is winding down due to the
cooler weather.
Golf Championship
• The City's Golf Championship was another sell out this year. 128 golfers
participated in the 5th Annual Tournament at the Irvine Coast Country Club.
(By the way, our Dottie Flohr won First Place in the Silver Flight Division.)
Sports
Adult Softball and Basketball Leagues are going very well. The leagues will be
continuing through December. The Boys Flag Football program is also enjoying
a successful fall season.
The Annual Youth Cross Country Track Meet will be held Sunday, November 10,. at
Eastbluff Park.
Don't forget about the IOK in the Back Bay on November 9. The Commission and
City Council members have all been invited to attend.

Dear Mr. Whitley:
At the last general meeting of the Balboa Improvement Association we discussed
Mr. Cavanaugh's proposal to convert the old restrooms at the base of the
Balboa pier into a storage facility for Ruby's Diner after the new restroom
facility is canpleted.
After a general discussion, it was evident that there was no opposition to
leaving the old building standing or converting the facility to a warehouse as
long as the building was maintained in a satisfactory manner. The members
also seemed confident that the Ruby's organization would do a good job of
maintaining the property.
There was also some discussion that there was potential revenue for the City
from the rental of this facility that could help pay for the maintenance of
the new bathrooms.
In general, the group felt Ruby's has contributed quite a bit to the
redevelognent of Balboa and should be given a chance to lease the space from
the City.

ADMINISTRATION: The Nutrition Program needs a Fire Inspection Certificate. I called
the Newport Beach Fire Department and an Inspector came to OASIS and' gave us a list
of things to correct. These have been done except for 2 things: 2 new thermostats
and a gas valve need replacing (they have been ordered) and the fire- proofing of the
MP and Room I drapes needs proof (Ed is checking on this). We Will be able to obtain
the Fire Inspection Certificate after these• 2 items are complete,
Roseann Mason started full time at OASIS on September 30 as Program Coordinator and
Human Services. Pam McGovern has accepted a full time job as the Director of the
Orange County Ombudsman Program. This program reviews all matters regarding nursing
homes and advocates for -the residents. Pam was treated to a luncheon by OASIS Staff
on 10/4/85.
We Personnel Department will be advertising for a part -time Outreadh Coordinator.
On September 26, there was an Orange County Congress of the California Senior
Legislature representatives from Orange County and other senior leaders. Ross Miller
was on the Transportation /Housing Committee; Brenda Ross co- chaired the Education/
Income Security Committee; Matt Ross co- chaired the Health Committee and I was on the
Federal bills committee chaired by Neel Buell. There also was a State bills committee.
Each committee studied many bills - put them in priority and then the total group
voted on the total package. Four Federal and Ten State bills were given top priority.
This was a very worthwhile meeting.
PROGRAMS2 ACTIVITIES & CLASSES & HUMAN SERVICES: The Medical Library Committee met on
September 16. A wooden panel has been ordered which will show the "angels" who have
contributed to the Medical Library.
The Western Party on September 21 saw everyone dressed in.Western gear - it was
colorful. The cloggers provided top knotch entertainment.
The OASIS Ancient Mariners Sailing Club met October 3. Daryl Wilson reported for
Neel Buell on the 26' boat that has been donated to the Emeritus Research Foundation,
The Foundation has obtained insurance and paid about $2,500 to get the boat in shape.
The boat will be primarily used for OASIS. This club will meet monthly and soon
sailing excursions will get under way.
