CITY COUNCIL COMMITTEES
City Council Ad Hoc and Standing Committees: Unless otherwise provided
for in the resolution creating the particular committee, all City
Council ad hoc and standing committees will consist of one or two
members of the Council to make committee meeting scheduling less
cumbersome and to permit the Mayor, or in the absence of the Mayor, the
Mayor Pro Tem to participate in committee deliberations as ex- officio
members with full voting rights.
The Mayor will appoint members to Council ad hoc and standing committees
and will appoint the chairman of these committees.
All citizens advisory committees' memberships shall consist of fourteen
citizens; two nominations to be made by each individual Council Member,
with the following exceptions: (1) Those citizens advisory committees
whose membership differs, pursuant to the resolution creating the
particular committee; those ad hoc citizens advisory committees whose
membership is appointed by the Mayor; (3) members of the Technical Oil L„r%
Advisory Committee shall be nominated by the City Council Appointments
Committee and appointed by the City Council; and (4) those citizens
advisory committees, or ad hoc citizens advisory committees whose
membership is expanded as a result of the addition of Council liaison
members. Appointments will be made on an annual basis from January 1 to -
December 31 (or any portion thereof) and may be renewed at the pleasure
of the Council upon recommendation by each Council Member.

The Ralph M. Brown Act applies to all commissions and boards created by
charter, and possibly to certain advisory committees created by formal
action of the City Council. All meetings of these boards and
commissions, and those advisory committees subject to the Brown Act,
must be held within the City of Newport Beach, open to the public, and
otherwise conducted in conformance with this policy and the Brown Act.
These boards, commissions and committees shall comply with the following
rules for noticing and conducting meetings:
1. An agenda containing a brief description of each item of
business to be transacted or discussed must be posted at a
location freely accessible to the public at least 72 hours
before each regular meeting;
2. All meetings shall be open and public, and all persons shall
be permitted to attend;
3. All meetings shall be held in the City of Newport Beach at a •
location accessible to the general public. The time for
holding regular meetings shall be established by appropriate
action of the board, commission or committee and, if at any
time a regular meeting falls on a holiday, the regular
meeting shall be held on the next business day;
4. No action may be taken on an off - agenda item unless;
a) Majority of those present determine that an emergency
situation exists; or
b) Two- thirds of the members, or all of the members if
less than two - thirds are present, determine that the
need to take action on the item arose subsequent to
the posting of the agenda; or
c) The item was included in a properly posted agenda for
prior meeting occurring not more than five days prior
to the meeting at which the action is taken and the
matter was continued to the meeting at which action is
taken.
It is inevitable that subjects will be discussed, either
during the course of consideration of agenda items or during
public comments, on which no action can be taken because the

sooner by act of the City Council, the committee will automatically
cease to exist and can be deleted from the City Council committees
roster, unless its life is extended by formal action of the City
Council.

circumstances outlined in (a) through (c) above do not
exist. In such event, the Presiding Officer shall have the
power to refer the matter to staff, or to place the item on
the agenda of a future meeting, or both.
5. Every agenda for a regular meeting must provide an
opportunity for members of the general public to speak on an
item of interest to the public within the subject matter
jurisdiction of the board, commission or committee provided,
however, the agenda need not provide an opportunity for
members of the public to address the board, commission or
committee on any item that has already been considered by a
committee, composed exclusively of members of the board,
committee or commission at a public meeting wherein all
interested members of the public were afforded the
opportunity to address the committee on the item, unless the
item has been substantially changed since the item was
heard.
6. Charter created boards and commissions, and any advisory
commission or committee subject to the Brown Act may adopt
rules for the noticing and conduct of meetings so long as
those rules are not inconsistent with provisions of the
Brown Act or this policy.
Committee RePorts: During the study session of the first regular
meeting of each month, all Council committees, citizens advisory
committees, and joint governmental committees having a report for the
City Council shall be placed on the agenda for Council information and
review.
These reports may be verbal or written and will cover the status of the
committee's work, timing and any difficulties which should be brought to
the attention of the full Council.
Annual Review: In October of each year, the City Council and City
Manager shall review the Boards, Commissions and Committees Manual for
any needed additions, changes or deletions deemed appropriate at the
time. Nothing in this policy shall prevent any individual member of the
Council, the City Manager or City Attorney from bringing to the
Council's attention any suggestions for Manual revisions at other times
during the year.
