TRANSACTION NARRATIVE AND I14STRUCTIONS
AUTHORIZATION
Minute Orders dated December 7, 1971, and January 24,
1972, and Resolution 72 -78 dated January 25, 1972
BACKGROUND
On December 23, 1970, the Board of Supervisors entered
into a contract with the City of Newport Beach to ac-
quire a site in the City of Newport Beach's Civic Center
for the Harbor Judicial District Court. This parcel is
shown in green on the attached map marked "Exhibit A ".
Subsequently, on December 7, 1971,'the Board of Super -
visors, upon reviewing site surveys setting forth
alternative locations for the Orange County Harbor
Judicial District, selected the site offered by Collins
Radio Company. On January 25, 1972, the Board of
Supervisors authorized condemnation of this parcel.
This parcel fronts on Jamboree Road at the future
Birch Street, and is shown in red on the attached
map marked "Exhibit B ".
To effect this relocation of the Harbor Judicial Dis-
trict court site to the new location on Jamboree Road,
the Department of Real Property Services has obtained
an agreement with the City of Newport Beach rescinding
the agreement of December 23, 1970, and agreements
with Collins Radio Company and the Irvine Industrial
Complex providing for the acquisition of their inter -
ests in the new location.
Collins owns the leasehold interest in the site that
they offered to the County of Orange. The Irvine
Industrial Complex is the fee owner of the land.
The following is a brief analysis of each Agreement:
CITY OF NEWPORT BEACH SITE
The Agreement with the City of Newport Beach provides
for recision to reestablish the status quo that existed
prior-to the Agreement.

To accomplish this, the Agreement provides for the
City of Newport Beach to return to the County of Orange
its purchase price of $439,749• In addition to this
amount, the City will pay the County of Orange $16,500
in interest for a total of $456,249. This interest
payment is based on 5% annual rate for a 9 -month
period.
The City also agrees to accept all of the streets to
be built in conjunction with the development, of the
new court site as public streets at such time as they
are built to City standards and offered to the City.
In exchange for these considerations, the County of
Orange will return the property acquired under the
December 23, 1970, Agreement to the City.

Collins Radio owns the leasehold interest in this
site. The Irvine Industrial Complex owns the fee.
The Agreement with Collins Radio provides for Collins
to quitclaim its interest in the 10.969 -acre parcel
which consists of adjacent streets and a 7.859 -net-
acre court site.
The Agreement with the Irvine Industrial Complex pro-
vides for Irvine to convey fee title to the same area.
Collins also agrees that within 270 days after the
award of the courthouse construction contract.to com-

Collins is also required to make all utilities avail -
able in a street adjacent to the site.
In consideration for the site, the Agreement requires
the County to pay Collins $313,352 and the Irvine
Industrial Complex $105,608. These payments are to be
made when title vests in the County as provided in the
Contracts.
The Contract with Collins is contingent upon the suc-
cessful acquisition of the Irvine Industrial Complex'
interest, and the Contract with the Irvine Industrial
Complex is contingent upon the completion of the reci-
sion agreement with the City of Newport Beach.

INSTRUCTIONS
1. Authorize the Chairman of the Board of Supervisors
to execute the original and copy of the three attached
Agreements and return the three copies to this office.
The three originals may be retained by the Clerk for
his files.
2. Authorize publication in relation to the City of
Newport Beach Contract in compliance with Section 25365
of the Government Code.
3. Instruct the Auditor to accept the $456,249 payment
from the City of Newport Beach at the close of escrow
in accordance with instructions from Department of Real
Property Services. Said monies should be credited to
Account 0168 - 410 - 2114.
4. Instruct the Auditor to issue his warrants in the
amount of $313,352 in favor of Collins Radio Company,
and $105,608 "in favor of the Irvine Industrial Complex,
or assigns; and additional warrants as required for
reconveyance and forwarding fees in accordance with
the instructions from the Department of Real Property
Services; delivery of said warrants to be delayed pend-
ing notice from this Department that adequate title to
the subject property has been obtained. Said warrants
are to be made payable -out of Account 0168 - 410 -244.

On motion of Supervisor Caspers , duly seconded and carried,
the following Resolution. -•7as adopted;
WHEREAS, this Board of Supervisors has previously adopted Resolu-
tion No, 72 -78 authorizing the condemnation of real property, referred
to as Parcel G.A.- 1223.3, for courthouse purposes, and
WHEREAS, it appears that additional property should be acquired
fo:: purposes of providing adequate street access to said courthouse site,
and has resulted in reparcelizing of said property;
NOW, THEREFORE, BE IT RESOLVED that the public interest and necess
require the acquisition of the fee simple absolute interest in Parcels
G.A.- 1223 -3.029 3.11, 3.21, 3.31, and 3.41 for public buildings and

City.of Newport Beach and are located on the west side of Jamboree
Road approximately 300 feet southerly of its intersection with Campus

NOW, THEREFORE, IT IS HEREBY ORDERED that said property be acquired
by said County of Orange, and the County Counsel is hereby directed to
amend the existing action or to dismiss it and institute a new action
in eminent domain to acquire title in fee simple absolute to said
property, and to do, perform and carry out all the necessary proceedings
and steps incident to the acquiring of said property.
