During the noon settlement of the case and arrived at �rl-7 June 22, 1962 e� a` Pelt - recommendation of 219 1962, in Department 9 of recess we discussed the the following: Mr. Van Pelt is to pay the City $1,548 on or before June 30, 1962.. He is to release the personal property in storage with Balboa Transfer Company and authorize the sale and disposition of the property either by Balboa Transfer Company or by any auctioneer he may select. Any net return on the sale and disposition is to be paid to Mr. Van Pelt. The parties are to give complete re- leases to each other and in favor of all City employees involved in this proceeding. The City is to execute and record a satis- faction and release of the lien heretofore filed against the real property. The case was continued in Department 9 in the Superior Court to July 27, 1962, at 9:30 A. M., at which time it is to be dismissed with each party bearing their own litigation costs. The costs to the City have been $1400 for the removal of the build- ings, $1,056.70 for the removal and storage of the personal prop- erty up to October 1, 1961, and $518.40 for storage charges through June 30, 1962. In addition to that amount, the $1400 charge carried interest up to September, 1961, amounting to $122. This made a total claim of the City of $3,097.10. The settlement for the sum of $1,548 appears to be reasonable in view of the uncer- tainty of the litigation and the time and expense involved in case an appeal was processed after the trial was completed. It also provides for the disposition of the personal property. It is recommended that the City Council approve this settlement at its meeting on June 25, 1962. The following motion would approve the settlement and authorize this office to carry out the terms thereof: "The settlement of the case entitled Newport Beach v. Van Pelt, Superior Court No. 91529, under which the City would be paid p$1,548 on or before June 30, 1962, the personal property belonging to Mr. Van Pelt would be released from To: The Honorable Mayor and City Council 02® June 22, 1962 storage and disposed of with the net proceeds going to Mr Van Pelt, the parties would give complete mutual releases of claims against each other and against the employees of the City, the City would execute and record a release and satisfaction of the lien on the real property, and the action would be dismissed with each party bearing their respective costs, is approved, and the City Attorney is authorized to complete the details thereof." WWC:mec 10/10/61 4 RESOLUTION NO. 5483 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CONFIRMING SUPPLEMENTAL STATEMENT OF EXPENSE OF ABATING A PUBLIC NUISANCE WHEREAS, Oliver A. Ring, Senior Building Inspector of the City of Newport Beach,has submitted to the City Council of the City of Newport Beach at its regular meeting on, Monday, October 9, 1961, at the hour of 7:30 o'clock P. M..in the Council Chambers at the City Hall, Newport Beach, California, a supple - mental statement of the expense of abating a public nuisance, to wit: the expense of the removal and storage of personal property located in and around the buildings heretofore removed from 904 906 East Balboa Boulevard and 905 - 907 East Bay Avenue, Newport Beach, California; and WHEREAS, a copy of said 'statement and notice of hearing before said City Council was posted conspicuously on said property and mailed to Mr. Roger B. King under date of October 2, 1961,, and which involves the purported cost of removal and storage of the personal property of the undersigned which was in the buildings belonging to him, located at 904..906 East Balboa Boulevard and 905 -907 East Bay Avenue, in the City of Newport Beach, California, and the undersigned objects and protests to and against such proposed supplemental statement and against the proposed assessment, upon the following grounds, to wit: 1. That the City of Newport Beach has heretofore caused to be filed against the undersigned in the Superior Court of Orange County, State of California, an action therein, numbered 91529,, and by its complaint in that action seeks to enforce a purported statutory lien against the real property of the undersigned in the sum of $1, 400. 00 and the collection of the alleged costs or removing and stor- ing the personal property of the undersigned from said premises.. The statutory lien sought to be enforced, was recorded as Instrument 107340 in Book 5293, Page 54 of Official Records in the Office of the County Recorder of Orange County, California, and said statutory lien is asserted against the real property of the undersigned in the City of Newport Beach, particularly described as follows: Lots 2 and 3, Block 13, Balboa Tract, as shown on a map recorded in Book 4,. Page 11 of Miscellaneous Maps, Records of Orange County, California, That in a separate count or cause of action set forth in the complaint in said Case No. 91529, the City of Newport Beach is seeking to recover from the undersigned personally the alleged expenses in removing and storing the personal property of the undersigned, which was removed from the premises hereinabove referred to. 2. That the undersigned has appeared in said Case No. 91529; and -1- c � has filed in the Superior Court of Orange County, his answer to the complaint in said action; that said action was pre »trialed and came on regularly for hearing in Department 8 of said Superior Court on the 20th day of September, 1961; that the trial of said cause on September 20, 1961 was however postponed and continued by reason of the application of the City of Newport Beach, who asked leave to file amended pleadings in this action. 3. That in connection with this application to amend, the City Attorney of the City of Newport Beach stated in the presence of the Court and the undersigned and opposing counsel, that there had in fact been materials from the structures and buildings of the undersigned at the addresses hereinabove given which were removed from said buildings by the demolition contractor,. one Rich Thunstrom, and by him sold and the proceeds of said sale retained, and in this connection the City Attorney also admitted in open Court and in the presence of the undersigned and opposing counsel, that the statutory provisions of Section 17828 of the State Housing Act as contained and set forth in the Health and Safety Code of the State of California, had not been complied with. On this occasion however, the City Attorney asserted that a claim would be made by amended pleadings to be filed in said Case No. 91529 in the Superior Court of Orange County, to claim a personal judgment against the undersigned on account of the cost of the removal of the buildings of the undersigned from the premises above described, and for the storage of the furnishings and personal property of the undersigned ,, and that leave to thus amend was granted to the City Attorney and the trial of said Case No. 91529 was interrupted and said case was placed off calendar to be rep -set upon the coming in of amended pleadings; The undersigned therefore avers that all matters involved in the collection of the alleged costs for the removal of buildings from the real property of the undersigned above referred to, and for the removal and storage of the personal property of the undersigned, are now all involved in Superior Court Case No.. 91529, and that during the pendency of said last mentioned case, the Superior Court of the County of Orange has exclusive jurisdiction to hear or determine all -2- matters in controversy with reference to the demands of the City of Newport Beach, 4, The undersigned also avers that shortly prior to the 5th day of May, 1960, the buildings upon the real property of the undersigned at the addresses hereinabove given, were broken into by persons entirely without authority so to do and without any process of law or warrant therefor, and the undersigned is informed and believes and therefore avers that the property was thus broken into and entered by Oliver A. King, who purported to act on behalf of the City of Newport Beach, but in fact had never been authorized so to do by any resolution of the City Council of the said City or other competent authority. 5, The undersigned further avers and is informed and believes and therefore alleges, that after the buildings of the undersigned had been broken into and entered as hereinabove set forth, that the same were allowed to remain open and unguarded so as to permit the removal of portions thereof by unauthorized persons, and that thereafter R. A. Glenn, a Building Official of said City, at the request of the City Attorney of the City of Newport Beach, caused the personal property of the undersigned to be removed from said premises by agents and servants of the Balboa Transfer Company, and caused the same to be stored in the storage warehouse of the Balboa Transfer Company in the name of the under - s igned, but that the removal and storage of said personal property was made after warnings from the undersigned as the owner of said personal property that all of said action was being done at the peril of the persons participating in the same and that in causing the removal and storage of the personal property of the undersigned, those purporting to act on behalf of the City of Newport Beach were acting wholly without any warrant or authority so to do from the Board of City Directors of said City or of any other lawful agency for permission thus to do. 6. The undersigned further avers that the cost of the removal and storage of the personal property of the undersigned was not included in the statement of the expenses of abating the alleged nuisance upon the real property of the undersigned at the addresses above given, nor was any statement of such -3- expenses posted upon said property or mailed to the undersigned prior to the adoption of Resolution No. 5247 on June 13, 1960. 7. The undersigned further avers that the City of Newport Beach has not contracted to become responsible for the removal or storage of the personal property of the undersigned which was removed from the premises above referred to or stored in the warehouse of the Balboa Transfer Company, but that at all times the cost of removal of the same and of the storage thereon has been charged against and billed to the undersigned individually, and no part thereof has been paid by the City of Newport Beach, and in this connection the undersigned avers that the removal of his personal property and the storage thereof in the warehouse of the Balboa Transfer Company was wholly unauthorized and illegal, and in particular that the storage thereof was not directed or authorized by the undersigned or by any person or persons having lawful possession of said personal property or of any portion thereof, and that as above set forth the responsibility for the removal and storage of said personal property is now involved in the Superior Court action now pending in Orange County, California and numbered 91529 in said Superior Court. 8. The undersigned further avers that no verified statement of any expenses incurred in the removal or storage of the personal property of the under- signed, hereinabove referred to, has ever been posted upon the real property of the undersigned or mailed to the undersigned, as required by the Health and Safety Code of the State of California, and in particular by Section 17828. 9. That on the 20th day of September, 1961 in Department 8 of the Superior Court of Orange County when said Case No. 91529 was called for trial,_ the City Attorney of the City of Newport Beach averred that a claim would be made to personal judgment against the undersigned under certain provisions of the Uniform Building Code; which the City Attorney averred had been heretofore adopted by the City of Newport Beach, and in particular Linder Chapter 2 of that Code, and in particular under Subsection a of Section 203 thereof. The undersigned is however informed and believes and therefore represents the fact to be that the Uniform Building Code, in so far as it involves ..4. E 0 the subject matter of the collection of costs or the imposing of liens upon real property, has never been legally adopted by the City of Newport Beach as a local ordinance pursuant to its Charter. The undersigned further avers that according to his best knowledge, information and belief, the Uniform Building Code does not include ordinances of the City of Newport Beach which have been previously adopted by the legislative body of said City, and that said Uniform Building Code is not a codification of any pre- existing ordinances of the City of Newport Beach which had theretofore been duly and legally adopted as such pursuant to the requirements of Sections 412, 413, and 414 of its City Charter, and in particular that no portion of said Uniform Building Code had been published in the official newspaper of the City of Newport Beach as required by Section 414, prior to the adoption thereof, and that the adoption of the so- called Uniform Building Code was not authorized by Section 415 of the Charter of the City of Newport Beach without compliance with the provisions of Sections 412 to 414 of said Charter, except as such code might relate to construction of buildings, plumbing and wiring, or to ordinances of the City of Newport Beach previously adopted by its legislative body in accordance with law. The undersigned therefore avers that the City of Newport Beach is without lawful authority to cause any assessment whatever to be ascertained or levied against the real property of the undersigned hereinabove referred to, or to take any action whatever upon the same, especially during the pendency of the Superior Court action hereinabove referred to. This matter is being.brought back to the City Council now because Mr. Van Pelt, the owner of the property, has never paid Balboa Transfer Company for removing and storing the property and they have not exercised their lien rights to sell the property and attempt to collect the cost of removal and storage. On September 29, they transmitted a bill to the City in the amount of $595.90 for the removal of the property and storage through May 319 1960, and of $57.60 per month for storage thereafter. S-1 W A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ORDERING THE ABATEMENT OF A PUBLIC NUISANCE WHEREAS, the chief building official of the City of New- port Beach, acting as the enforcement agency and building official pursuant to the State Housing Act, Section 17821, et seq., of the Health and Safety Code and the Uniform Building Code of the City of Newport Beach, respectively, did cause certain buildings to be posted and the owner of same to be notified that said buildings are unfit for human habitation or occupancy, the reasons for the same being set forth; an affidavit relative to the posting of notice being on file in the proceedings herein; and WHEREAS, pursuant to the said State Act hereinbefore men- tioned and said Uniform Building Code, said official did cause a "Notice to Abate Nuisance" to be posted in the form provided by law; and WHEREAS, said buildings have not been repaired or removed as required by the building official; and WHEREAS, Mr. Roger Van Pelt, the owner of said buildings, was notified to appear and did appear in person at the hearing before the City Council on the 11th day of January, 1960; and on such other days to which said hearing was continued; and WHEREAS, after evidence received at said hearing on said date, and on other dates to which said hearing was continued, from the building official and from all other interested parties, and after an inspection of the premises by the City Council, the City Council makes the following findings: There are six buildings located on Lots 2 and 3, Block 13, Balboa Tract, in the City of Newport Beach, designated by street ad- dress as 904 East Balboa Boulevard, 906 East Balboa Boulevard, 905 East Bay Avenue, and 907 East Bay Avenue, owned by Mr. Roger Van Pelt, which buildings are unsafe and unfit for human habitation or occupancy for the reasons that structural, sanitary, maintenance to and other deficiencies exist in each of said buildings as herein- after set out, which said buildings have been designated in this proceeding for the purpose of convenience as Unit No. 1 through Unit No. 6. The plumbing is obsolete and unsanitary and is detrimental to the health and safety of occupants. (b) In Unit No. 2 at 906 East Balboa Boulevard, these deficiencies exist: 1. The shower room and toilet room added to the original building are of single wall construction, have no foundation and no screened windows and are not weathertight, and the floors are improperly constructed and have not been maintained. 2. The shower room and toilet room are unsanitary and by the nature of their construction could not be made sanitary. 3. The floor of the building is not level as a result of the building's having settled due to the lack of an adequate foundation. 2. • 0 4. There is little or no air space between the floor and the ground. 5. The floor has separated from the wall in the kitchen and has subsided to the extent that the doors do not open freely. 6. The kitchen range has no vent. 7. The natural gas line to the kitchen range is not equipped with a safe connector and valve. 8. The ceiling height throughout the building is low. 9. The windows in the building are so small as not to provide adequate light, air or ventilation. 10. Dry rot and termite damage exist in the struc- tural parts of the building at or near the ground level. 11. The screens are rusted and deteriorated. 12. The exterior walls of the building are deteri- orated and do not offer complete protection from the weather. 13. The electrical wiring is obsolete and the wires lack adequate insulation because of extreme age and deterioration. 14. The plumbing is obsolete and unsanitary and is detrimental to the health and safety of occupants. 15. The entire building is extremely dilapidated and shows evidence of a complete lack of maintenance and repair. (c) In Unit No. 3 at 906 East Balboa Boulevard, these deficiencies exist: 1. A lean -to addition has been added to this structure and is of unstable construction and suffers from extreme dilapidation. The lean -to houses a boiler type water heater which is located within a few inches of an exposed wood surface. 2. Glass is missing from some of the windows. 3. The building is not supported by an adequate foundation. 4. The floors have subsided and are not level. 5. The doors do not swing completely open. 6. The floor has separated from the wall in the kitchen because of subsidence. 7. The roof, walls and floor are badly deterior- ated and do not keep the weather out. 8. Dry rot and termite damage are in evidence at or near the ground level in structural parts of the building. 3. 9. The natural gas line to the kitchen range is not equipped with an adequate connector and valve. 10. The window area is so small that it does not provide adequate light and ventilation. 11. The toilet is not equipped with a flush tank. 12. The electrical wiring is obsolete and the wires lack adequate insulation because of extreme age and deterioration. 13. The plumbing is obsolete and unsanitary and is detrimental to the health and safety of occupants. (d) In Unit No. 4 at 904 East Balboa Boulevard, these deficiencies exist: 1. The sheathing on the porch roof is warped, twisted and deteriorated. 2. The light switch at the front door is broken. 3. The roof covering is badly deteriorated and defective. is broken. 4. The handle on the flush valve on the toilet 5. The windows do not keep the weather out. 6. The windows are of inadequate size to provide adequate light, air and ventilation. 7. The natural gas line to the kitchen range is not equipped with an adequate connector and valve. 8. The kitchen range is not provided with a vent. 9. There is a hole in the wall under the kitchen sink which extends to the outside. 10. The ceiling height throughout the building is low. 11. The building shows lack of adequate maintenance and repair and as a result is generally dilapidated. (e) In Unit No. 5 at 907 East Bay Avenue, these defi- ciencies exist: 1. The building is not supported by an adequate foundation with the result that it has subsided and rendered the floors unlevel. 2. There is a concentration of scrap lumber stored in the underfloor area 3. The brick lining in the fireplace is eroded and the mortar is deteriorated and crumbling with the result that the bricks are loose. 4. The sewer drain from the kitchen sink is defect - ive and has been repaired with friction tape. 4. 0 0 5. The natural gas line to the kitchen range is not equipped with a proper valve. 6. Wall paneling is buckled and warped. 7. The ceiling height on the second floor, which has been used as a dormitory, varies from 3 feet at the side walls to 7 feet at the center. 8. The second floor area does not have sufficient window area to provide adequate light, air and ventilation. 9. There is only one means of egress from the second floor, which consists of an exterior stair 28 inches in width with a head room of only 4 feet 10 inches. 10. Many floor boards are loose. 11. The exterior board and batt walls are cracked, split and warped to the extent that weather is not kept out. 12. The floor joists supporting the second floor are inadequate in size and number when the condition of the building is taken into consideration. 13. The electrical wiring is obsolete and the wires lack adequate insulation because of extreme age and deterioration. 14. The plumbing is obsolete and unsanitary and is detrimental to the health and safety of occupants. 15. The building shows lack of adequate maintenance and repair and as a result is generally dilapidated. (f) In Unit No. 6 at 905 East Bay Avenue, these defi- ciencies exist: 1. The 4" x 4" posts supporting the building are damaged by dry rot and termite infestation. These posts along with the mudsills on which they rest are buried ap- proximately 24 inches in the ground and have not been main- tained. 2. The building is not supported on-an adequate foundation, and as a result of the conditions described above substantial subsidence has resulted. 3. There is an accumulation of scrap lumber and debris in the underfloor area. 4. The mortar and firebrick in the fireplace are deteriorated and crumbling. 5. The natural gas line to the living room is equipped with an improper valve for the control of gas. 6. No vent is provided for the kitchen range. 7. Unvented space heaters are provided for heat. 8. The second floor area, which has been used as a dormitory, has insufficient window area to provide adequate light, air and ventilation. 5. • 0 9. The ceiling height of the second floor area used as a dormitory varies from 3 feet to 7 feet. 10. There is only one means of egress from the second floor area which is an exterior stairway measuring 21 inches in width and providing head room of only 4 feet 10 inches. 11. The wood ceiling material is buckling and warping. 12. Wires carrying electricity on the building attached to the exterior walls are partially bare due to deterioration of the insulating material. 13.. The siding is split and cracked and shows evidence of inadequate maintenance and it does not protect from the weather. 14. The roof is badly deteriorated and leaks in some areas. 15. The wiring is of knob and tube type and in some places is within easy reach of an adult. The insula- tion is deteriorated and in some places the bare wire is exposed. 16. The plumbing is obsolete and unsanitary and is detrimental to the health and safety "of occupants. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach, acting as the governing board under the State Housing Act and as City Council under the Uniform Building Code, does hereby, on the basis of the hearings and evidence presented and its inspection of the buildings, conclude that said buildings are a nuisance and are unsafe and unfit for human habita- tion or occupancy for the reasons heretofore set forth in this resolution, and does hereby direct the owner to abate said nuisance within thirty days after the date a copy of this resolution is posted on said buildings. BE IT FURTHER RESOLVED that it is the conclusion of the City Council that said buildings cannot practically or economically be reconstructed or repaired in a..manner to be made safe and fit for human occupancy and so as to comply with the requirements of the State Housing Act and the Building Code and Municipal Code of the City of Newport Beach and that, therefore, said buildings must be razed or removed and the building official is hereby authorized and directed to inform the owner of said buildings.that 6. if said nuisance is not abated said buildings will be razed or removed by the City of Newport Beach and the expense thereof made a lien on the land upon which said buildings are located. Mr. King submitted and entered into evidence, photographs on five sheets of Manila paper picturing some of the conditions al- leged, there being one picture for Units 1 and 2, two pictures for Unit 2 six pictures for Unit 3, five for L, for pictures Unit eleven pictures Unit 5, and .sixteen pictures for Unit 6. Mr. King stated that he had received his information from the County Assessor's records, and that a County Assessor by the name of Hartnett had given him information. Mr. Van Pelt stated that the information was er- roneous, that Units 1 and 2 were constructed in 1914; Units 5 and 6 were constructed in 1905; Unit 4 was being lived in, in 1921; Unit 3 was built a little later than 1905. Mr. Van Pelt stated he was willing to repair and rehabilitate the buildings but he had been prevented from doing so by the Building Department by reason of the fact that he was unable to obtain a building permit an was told to tear down his buildings.
