Subject: Prohibition of "For Sale" signs on residential property j
In January"the City Council asked advice on prohibiting "For Sale"
signs in residential districts. Upon review of this problem, I
find several provisions in the Municipal Code which have a bearing
on the subject.
In the chapter on signs in Section 8532, an exemption from the.re -
quirement of obtaining a sin permit is provided for "real estate
signs not exceeding twelve (12) square feet in area which advertise
the sale, rental, or lease of the premises upon which said signs
are located ".
In Sections 9103.01, 9103.11, 9103.21, and 9103.31, which apply to
the R -A, R -1, R -2, and R -3 Districts, respectively, the Code
specifically authorizes one sign not over six feet in area and
pertaining to the sale, lease, or rental of the property upon
which the sign is to be located. The sections applicable to the
R -4 District contain a similar provision, but authorize the sign
to be twelve square feet, and larger with a use permit, so long
as the sign is appurtenant to any use on the property.
In order to enact the prohibition against such signs on all resi-
dential property, it would be necessary-to modify the sections
mentioned above.
Research on the question of a flat prohibition of such signs has
not produced a court decision th ere the precise point was decided.
In an early California case entitled Varne 1, Green v. Williams,
155 Cal. 318, the Supreme Court of Ca ornia a d unconstitut onal
an ordinance of the city of East San Jose which flatly prohibited
billboards, signboards, or other structures erected for the purpose
of displaying advertising. The ordinance also had an exception as
to an advertising sign which advertised only goods, wares or mer-
chandise sold on the premises where the sign was located. The court
did not rule on the exception inasmuch as it held the entire
ordinance invalid. The court based its decision upon the conclu-
sion that the only basis forthe prohibition was aesthetic. In
reaching its decision, the court used the following language:

"But, so far as we are advised, it has never been
held that these considerations alone will justify,
as an exercise of the police power, a radical
restriction of the right of an owner of property
to use his property in an ordinary and beneficial
way. Such restriction is, if not a taking, pro
tanto, of the property, a damaging thereof, for
which, under section 14 of article I, of the con-
stitution, the owner is entitled to compensation."
This case is widely quoted as being authority for the proposition
that the power.of cities to regulate or prohibit signs is strictly
limited by the constitution.
In a very late case, City of Santa Barbara v. Modern Neon Sign
Company (1961),.189 C. A. , the District Court of-Appeals
uphhelldd a judgment in which the trial court refused to order the
defendants to alter certain moving signs in a manner "to eliminate
all motion. The action was based on the Santa Barbara ordinance
which prohibited moving signs and flashing signs and provided that
every sign or advertising structure in existence at the time of
the adoption must be removed or altered to conform to the provisions
of the ordinance within five years. It also provided that any
moving sign visible from any public highway or.thoroughfare must
be altered to prevent such movement within one year from the date
of adoption. This the court refused to order.
In u ?holding the judgment, the appellate court.comments that the
city s case is based upon aesthetic considerations in seeking to
sustain the ordinance. The trial court had concluded that the
prohibition of moving signs in the ordinance was based solely and
wholly upon aesthetic grounds and considerations and, as such,
the prohibition constituted an unconstitutional exercise of police
power by the city. The appellate court upheld this conclusion and
cited Varner & Green v. Williams, quoting the same language here -
inabove quoted.
The court goes on to state that the trend in some states is toward
recognition of such considerations (aesthetic) as sufficient basis
for legislation which impinges upon property rights.
There are some Florida cases, for example, which seem to sustain
the regulation of signs on aesthetic considerations where the
attractiveness of the community bears a substantial relation to
the general welfare and where the city is a center of culture or
beauty.

It is interesting to note that the provision allowing signs adver-
tising the property for sale or lease upon which the sign is
placed, as in our ordinances, is a standard featured in this typla
of legislation. For example, the state legislature has enactdW
a provision in Section 5291 of the Business and Professions Code
which prohibits an advertising display adjacent to a landscaped
freeway in unincorporated areas, but it goes on to provide in
Section 5293 that the provisions do not apply if the sign is used
exclusively to advertise the sale or lease of the property upon
which such advertising display is placed.
From a legal standpoint the flat prohibition against such signs
may be invalid. The Varney & Green case and the Santa Barbara case
make it clear that the city's power to prohibit signs is not un-
limited. On the other hand, the city does have power to legislate
to promote the public health, safety, morals, and general welfare.
It is possible that such a provision would °be upheld. The probabil-
ity would be enhanced if it were made a part of a general zoning
plan.
If the City Council wishes to proceed, the amendments can be prepared.

SUBJECT: MARINAPARK RENT ADJUSTMENTS a
Adopt the attached resolution, which substitutes a new Marinapark
plot plan and rent schedule for the existing plot plan.
DISCUSSION
There are two deficiencies in the existing Marinapark rent
schedule -- both deficiencies would be corrected by the City Council's
adoption of the proposed "Marinapark Plot Plan and Rental for Spaces ".
1) The present rental fees have never been officially
approved by the City Council. The fee schedule ap-
parently was informally established in 1956 when
Marinapark was redeveloped and was informally re-
vised about four years ago to reflect current rents.
2) Present rental fees for some spaces (indicated by
red lines on the attached green sheet) are too low
in relation to the rents charged for.adjacent
spaces having comparable views.
The proposed rent adjustments would increase Marinapark's gross
annual revenue by approximately $5,500 (8 percent).

TRAILER PARK
RENTAL AGREEMENT AND REGULATIONS
The City of Newport Beach, hereinafter referred to as
"lessor ", does hereby lease to the undersigned lessee the trailer
space number which is more particularly shown on a map
entitled "Plot Plan Mari.napark ", dated June 13, 1960, attached
hereto and made a part hereof, in the City's trailer park, referred
to as "NEWPORT MARINAPARK", Newport Beach, California, for the term
and at the rent, and upon the terms, conditions and regulations as
are hereinafter set forth, to wit-
1. LESSOR ° MEANING. It is mutually understood by the
parties hereto, for the purposes of enforcement of the provisions
of this lease, the word "lessor" means the City Manager of Newport
Beach, oT his duly designated agent.
2. TRAILERS AND CABANAS. All trailers, cabanas and any
other structures or enclosures shall comply with state and local
laws and shall be kept in good repair. No improvements of any kind
shall be made by lessee without first submitting plans and obtain -
ing the written approval of such plans by lessor. In addition to
architectural features, such plans shall show color schemes.
3. LOT MAINTENANCE. Lots will remain under direct con-
trol of the lessor. Patio furniture and one storage chest are the
only items permitted outside the trailer. No laundry shall be hung
outside of trailers_ All landscaping, planting and fencing of yards
shall be only with lessor °s prior written approval. Fencing and
planting left by preceding tenants shall belong to lessor. Lessee
shall be responsible for the orderly maintenance and upkeep of his
trailer lot.
4. RESPONSIBILITY. The lessor is not responsible for
loss due to fire, theft or accident.
5. ASSIGNMENTS AND SUBLEASES. Trailer spaces are non-
transferable, except where in the judgment of the lessor permanent

type improvements have been constructed on the site. Lessor may,
at its option, agree only in writing to an assignment of the lease
covering such trailer space. Trailers may not be sublet without
written permission of the lessor.
6. USE. The leased premises shall be used solely for
trailer park purposes. Lessee agrees to comply with all laws,
regulations and ordinances of the city, county and state affecting
the leased premises and improvements thereon, and lessee's trailer
and other property.
7. GUESTS, The trailer space is herein leased for not
to exceed persons, and for each person in excess of said
number lessee agrees to pay lessor $ per day or fraction thereof.
8. UTILITIES. Lessee shall make arrangements for elec-
tric service and telephone service directly with the utility compa-
nies furnishing the same.
Lessor shall furnish water to lessee for use on the trailer
lot. Should lessee use an abnormal amount of water or waste water
or permit water to be wasted by occupants or guests of his trailer,
a reasonable charge, the amount of which shall be determined by les-
sor, may be made by lessor for such water.
Lessee shall pay a flat amount per month if gas service
is provided to the trailer lot covered by this lease,
(a) If occupancy of the trailer occurs on weekends only
or less often, lessee shall pay Two Dollars ($2.00) per month to
lessor for gas.
(b) In all other instances, lessee shall pay Four Dollars
($4.00) per month to lessor for gas.
9, TERM. The term of this lease is for the period of

11. TAXES. Lessee agrees to pay when due all taxes as-
sensed upon his personal property.
12. REGULATIONS. Lessee hereby agrees to abide by and
be bound by the regulations hereinafter set forth or attached and
which may be amended from time to time as provided.
..(a) Children m Adult Section, Marinapark is divided
into an adult section and a children's section as is particularly
shown on the attached map of the park, Permanent residency in the
adult section is limited to adults only. Children are permitted in
the adult section only as visitors and only on a temporary basis
(not more than a few days at a time).
Lessee shall not permit children to occupy the trailer or
space hereby leased.in the adult section except as hereinbefore
specifically permitted.
In the event one or more children become members of lesm
see °s immediate family during the term of this lease if the same is
of space in the adult section, then this lease and all lessee's
rights hereunder shall terminate at the end of the month during
which such event happens.
(Child or children for the purpose of this subparagraph
is any person or persoans under the age of eighteen (18) years.)
(b) Lessee's Liability Property Damage. Responsibility
for the acts of children or guests of lessee rests with lessee.
Lessee agrees to pay for any damages to City property or property
of other tenants caused by the negligent act or willful misconduct
of his children or guests.
(c) Amendment. The City Council may at any time by
resolution amend or add to the regulations set out above in sub-
paragraphs (a) and (b).

(d) Additional Regulations. In addition to the forego-
ing regulations, this lease is expressly made subject to all of the
rules and regulations of Marinapark promulgated by lessor, a copy
of which is attached hereto and made a part hereof. Lessee agrees
to obey and abide by said rules and regulations and any failure to
do so shall constitute a breach of this lease.
Said rules and regulations may be revised, amended or
altered by lessor from time to time during the term of this lease
as conditions require. Any such revision, amendment, or alteration
of said rules and regulations shall be effective when posted in the
office of Marinapark.
13. USE OF NAME OR ADDRESS OF PARK. This park or its
name or address shall not be used for the purpose of advertisement
or sale of automobiles, trailers or merchandise, or for any other
commercial purpose except with the specific written consent of the
lessor.
14. REMOVAL OF TRAILER. Trailers are not to be removed
without first securing the written consent of the lessor.
15. DEFAULT. Upon failure of lessee to comply with any
of the covenants, conditions, rules and regulations hereof, then
lessor may at its option, but without being obligated therefor, do
or perform any act to correct any default, and the reasonable costs
thereof shall be immediately due from lessee to lessor as additional
rent hereunder.
16. TERMINATION. If lessee or any other occupant of les-
see's trailer site fails to comply with the terms, covenants, condi-
tions, rules and regulations as herein set forth, lessor shall have
the right to terminate this lease by first giving lessee three (3)
days' written notice thereof. It is agreed that placing or posting
of any notice to lessee at any place upon the leased trailer space
shall be equivalent to personal notice upon said lessee.
In the event it is necessary to engage the services of
an attorney to enforce any of the terms and /or conditions of this

agreement, lessee agrees to pay lessor reasonable attcraney fees and
costs,
17. ABANDONMENT OF IMPROVEMENTS. Any and all improve-
ments, including cabanas, left remaining on said trailer site at
the expiration of this lease or sooner termination thereof as herein
provided or by abandonment thereof by the lessee, shall belong to
and be the property of the lessor.
18. OPTION, Lessee shall have the option to, renew this
lease upon the same term2 and conditiconv, herein ccnt:ained, or upon
the terms and conditions that appear in a lease form hereafter
adopted by the City Council to replace this form and be used for
leasing the trailer spaces in Marinapark, with the exception of
rental, price. Said rental price upon renewal shall be determined
at the discretion of the City Council c:.f Newport Beach, but will be
comparable to rentals for similar trailer sites in the immediate
vicinity within the Newport Marinapark, Lessee must give to les-
sor notice in writing of his intent ,t,y exercise his option at least

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING A LEASE FORM FOR MARINAPARK
WHEREAS, the City Council has heretofore approveda lease
form for use in leasing the spaces in Marinapark by Resolution Noe
4520 on July 239 1956; and
WHEREAS, the City 'Council revised said lease form by Reso-
lution No, 5098 on September 28, 1959; and
WHEREAS, a new proposed lease form has been prepared, a
copy of which is attached hereto, marked Exhibit "A ", and made a
part hereof; and
WHEREAS, the City Council has reviewed said form and found
it acceptable and wishes to approve the same and to authorize the
City Manager or an employee of the City designated by the City Man-
ager to execute said leases on behalf of the City;
NOW, THEREFORE, BE IT RESOLVED that the lease form attached
hereto be and the same is hereby approved and that the City Manager
or an employee designated by him be and each is hereby authorized
to execute leases in the form attached hereto on behalf of the City
as lessor of the City-owned Marinaparko

2. TRAILERS AND CABANAS. All trailers, cabanas and any
other structures or enclosures shall comply with state and local
laws and shall be kept in good repair. No improvements of any kind
shall be made by lessee without first submitting plans and obtain-
ing the written approval of such plans by lessor. In addition to
architectural features, such plans shall show color schemes.
3. LOT MAINTENANCE. Lots will remain under direct con-
trol of the lessor. Patio furniture and one storage chest are the
only items permitted outside the trailer. No laundry shall be hung
outside of trailers. All landscaping, planting and fencing of yards
shall be only with lessor °s prior written approval. Fencing and
planting left by preceding tenants shall belong to lessor. Lessee
shall be responsible for the orderly maintenance and upkeep of his
trailer lot.
4. RESPONSIBILITY. The lessor is not responsible for
loss due to fire, theft or accident.
5. ASSIGNMENTS AND SUBLEASES. Trailer spaces are non-
transferable, except where in the ,judgment of the lessor permanent

type improvements have been constructed on the site. Lessor may,
at its option, agree only in writing to an assignment of the lease
covering such trailer space. Trailers may not be sublet without
written permission of the lessor.
6. USE. The leased premises shall be used solely for
trailer park purposes. Lessee agrees to comply with all laws,
regulations and ordinances of the city, county and state affecting
the leased premises and improvements thereon, and lessee's trailer
and other property.
7. GUESTS. The trailer space is herein leased for not
to exceed persons, and for each person in excess of said
number lessee agrees to pay lessor $ per day or fraction thereof.
8. UTILITIES. Lessee shall make arrangements for elec-
tric service and telephone service directly with the utility compa-
nies furnishing the same.
Lessor shall furnish water to lessee for use on the trailer
lot. Should lessee use an abnormal amount of water or waste water
or permit water to be wasted by occupants or guests of his trailer,
a reasonable charge, the amount of which shall be determined by les-
sor, may be made by lessor for such water.
Lessee shall pay a flat amount per month if gas service
is provided to the trailer lot covered by this lease.
(a) If occupancy of the trailer occurs on weekends only
or less often, lessee shall pay Two Dollars ($2.00) per month to
lessor for gas.
(b) In all other instances, lessee shall pay Four Dollars
($4.00) per month to lessor for gas.
9. TERM. The term of this lease is for the period of

10. RENT. During the term of this lease, lessee agrees
to pay to the lessor as rental for said premises, the aggregate sum

12. REGULATIONS. Lessee hereby agrees to abide by and
be bound by the regulations hereinafter set forth or attached and
which may be amended from time to time as provided.
(a) Children m Adult Section. Marinapark is divided
into an adult section and a children's section as is particularly
shown on the attached map of the park. Permanent residency in the
adult section is limited to adults only. Children are permitted in
the adult section only as visitors and only on a temporary basis
(not more than a few days at a time).
Lessee shall not permit children to occupy the trailer or
space hereby leased in the adult section except as hereinbefore
specifically permitted.
In the event one or more children become members of les°
see °s immediate family during the term of this lease if the same is
of space in the adult section, then this lease and all lessee's
rights hereunder shall terminate at the end of the month during
which such event happens.
(Child or children for the purpose of this subparagraph
is any person or persons under the age of eighteen (18) years.)
(b) Lessee's Liability Property Damage. Responsibility
for the acts of children or guests of lessee rests with lessee.
Lessee agrees to pay for any damages to City property or property
of other tenants caused by the negligent act or willful misconduct
of his children or guests.
(c) Amendment. The City Council may at any time by
resolution amend or add to the regulations set out above in sub-
paragraphs (a) and (b).

(d) Additional Regulations.

In addition to the forego-
ing regulations, this lease is expressly made subject to all of the
rules and regulations of Marinapark promulgated by lessor, a copy
of which is attached hereto and made a part hereof. Lessee agrees
to obey and abide by said rules and regulations and any failure to
do so shall constitute a breach of this lease.
Said rules and regulations may be revised, amended or
altered by lessor from time to time during the term of this lease
as conditions require. Any such revision, amendment; or alteration
of said rules and regulations shall be effective when posted in the
office of Marinapark.
13. USE OF NAME OR ADDRESS OF PARK. This park or its
name or address shall not be used for the purpose of advertisement
or sale of automobiles, trailers or merchandise, or for any other
commercial purpose except with the specific written consent of the
lessor.
14. REMOVAL OF TRAILER. Trailers are not to be removed
without first ,securing the written consent of the lessor.
15. DEFAULT. Upon failure of lessee to comply with any
of the covenants, conditions, rules and regulations hereof, then
lessor may at its option, but without being obligated therefor, do
or perform any act to correct any default, and the reasonable costs
thereof shall be immediately due from lessee to lessor as additional
rent hereunder.
16. TERMINATION. If lessee or any other occupant of les°
see °s trailer site fails to comply with the terms, covenants, condi-
tions, rules and regulations as herein set forth, lessor shall have
the right to terminate this lease by first giving lessee three (3)
days° written notice thereof. It is agreed that placing or posting
of any notice to lessee at any place upon the leased trailer space
shall be equivalent to personal notice upon said lessee.
In the event it is necessary to engage the services of
an attorney to enforce any of the terms and /or conditions of this

agreement, lessee agrees to pay lessor reasonable attorney fees and
costs.
17. ABANDONMENT OF IMPROVEMENTS. Any and all improve-
ments, including cabanas, left remaining on said trailer site at
the expiration of this lease or sooner termination thereof as herein
provided or by abandonment thereof by the lessee, shall belong to
and be the property of the lessor.
18. OPTION. Lessee shall have the option to renew this
lease upon the same terms and conditions herein contained, or upon
the terms and conditions that appear in a lease form hereafter
adopted by the City Council to replace this form and be used for
leasing the trailer spaces in Marinapark, with the exception of
rental price. Said rental price upon renewal shall be determined
at the discretion of the City Council of Newport Beach, but will be
comparable to rentals for similar trailer sites in the immediate
vicinity within the Newport Marinapark. Lessee must give to les-
sor notice in writing of his intent to exercise his option at least
sixty (60) days before the expiration date of said lease.

RULES AND REGULATIONS
The following Rules and Regulations are established pursuant to Paragraph 12(d)of the
Marinapark lease agreement:
1. FIRES Open fires on the beach area adjacent to Marinapark are prohibited.
2. TRAFFIC All drivers are required to observe the traffic regulation signs posted
in the Park. The maximum speed limit for any vehicle is 10 MPH.
3. PARKING Each tenant shall park in the space assigned to him. Guests of tenants
shall park only as follows:

a. In the guests' parking area
b. On the street
c. In the parking space of the tenant they are visiting
4. NOISE No unnecessary noises(loud radios, televisions, etc.) between the hours of
10:00 P. M. and 8:00 A. M. No disturbing noises at any time.
5. ROLLER SKATES Roller skating is not permitted anywhere in the Park. Bicycles,
skooters, etc., are prohibited on the promenade and middle and rear walks; use
rear drive only.
6. CONSTRUCTION Construction, either by tenants or their contractors, is prohibited
on Sundays and holidays and is permitted on other days only between the hours of
8:00 A. M. and 5:00 P. M. During and on completion of construction, tenants shall
be responsible for the following:
a. Removal of waste products(lumber scraps, saw dust, etc.)
b. Maintaining their leased areas in a clean and sanitary
condition
c. Stopping any excessive noise caused by construction machinery
(unmuffled gasoline engines, etc.)
7. LAWNS AND PATIOS Tenants shall not leave water hoses, beach toys, bicycles,
etc., on the grass or patio areas.
8. SAND Tenants and guests are required to wash sand off their bodies and bathing
suits before entering showers, rest rooms, or laundry facilities. An outside
shower is provided for this purpose and is located opposite the ladies' rest room.
9. REST ROOMS AND LAUNDRY ROOM The public conveniences in Marinapark are maintained
as a part of your home. Your cooperation in keeping them clean and sanitary is
expected. Washing and drying hours are 7:00 A. M. to 5:00 P. M. Clogged drains,
defective driers, etc., and any irregularities should immediately be reported to
the Manager. All facilities must be left clean after use. Clothes shall be
removed from the laundry lines as soon as they are dry. Responsibility for
maintenance of private utilities rests with tenants.
10. CHILDREN Children under six(6)years of age are not permitted in service rooms,
toilets, or showers unless accompanied by an adult. Children are prohibited from
playing in and around these areas.
11. SHRUBS Tenants are responsible for weed removal and mainenance of lawns, flowers,
and other shrubs in their own spaces. Use of the area under trailers for storage
purposes is prohibited.
12. PETS No pets are allowed in Marinapark. Instruct your guests not to bring dogs
or cats with them when they visit you.

13. PHONE CALLS Check your mail box daily for any phone messages. They will not
be delivered to trailers, except in emergencies.
14. TRAILERS Trailers are to be equipped with wheels and tires, as required by
State law.
15. GARBAGE AND TRASH All garbage and refuse must be separated and placed in the
proper containers provided by the Park for this purpose. Put trash only in the
larger cans.
16. MARINAPARR BUSINESS HOURS 8.00 A. M. to 5.00 P. M.
17. VIOLATIONS OF LAW Violations of law will not be tolerated. Violations by a
tenant,or any guest of a tenant, will be deemed a breach of the lease.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING A REVISION OF PARAGRAPH
16 IN THE LEASE RENTAL FORMS FOR MARINAPARK
WHEREAS, the City Council of the City of Newport Beach
approved a lease form for use in leasing the spaces in Marinapark
by Resolution No. 4520 on July 23, 1956; and
WHEREAS, it has come to the attention of the City Council
that Paragraph 16 of said lease should be amended to authorize
changes in the form of the lease as appear necessary for the
proper administration of Marinapark;
NOW, THEREFORE, BE IT RESOLVED that the City Council
hereby approves amending the form to cause Paragraph 16 to read:
"16. OPTION. Lessee shall have the option to renew
this lease upon the same terms and conditions herein con-
tained, or upon the terms and conditions that appear in a
lease form hereafter adopted by the City Council to
replace this form and be used for leasing the trailer spaces
in Marinapark, with the exception of rental price. Said

The city of Newport Beach, hereinafter referred to as
"lessor ", does hereby lease to the undersigned lessee the trailer
space number.' and which is more particularly shown on a
map attached hereto and made a part hereof, in the city's trailer
park, referred to as "NEWPORT MARINAPARK ", Newport Beach, California,
for the term and at the rent, and upon the terms; conditions and
regulations as are hereinafter set forth, to tit:
1. LESSOR - MEANING. It is mutually understood by
the parties hereto, for the purposes of enforcement of the pro -
visions of this lease, the word "lessor" means the city manager

(c) Noise. Loud talking and any noise that, in the
opinion of the lessor, constitutes boisterous conduct is pro-
hibited. Loud talking and radio playing that carries beyond
the limits of the space leased to the lessee between the hours
of 10:00 p..m, and 8:00 a.m. is also prohibited. If in the
opinion of the lessor, any lessee or member of his or her family,
or any of his or her guests, uses beer, wine or liquor to excess,
lessor at its option may terminate this lease, and upon verbal or
written notice thereof, the lessee agrees immediately to vacate
the leased premises.
(d) Refuse. All papers and garbage must be separated
and placed in proper containers. Refuse containers are permitted
only in spaces provided for them by the lessor.

(e) Use of address. This park or its address shall
not be used for.the..purpose of advertisement or sale o$ auto-
mobiles, trailers or merchandise. The only exception shall
be with the written consent.of the lessor.
(f) Removal of trailer. Trailers are not to be
removed without.'f1rat securing the written consent of the
lessor.
(g) Telephone. Park office telephones shall not be
used by tenants. No one will be called to the phone. A public
telephone is located in the park for your convenience.
(h) Traffic. A speed limit of five (5) miles an
hour must be observed in the park at all times and all other
regulations posted from time to time must be observed.
(1) Pets. Dogs and cats are not permitted in the
park under any conditions. Other pets must first be approved
in writing by the lessor.
(j) Fires. Open fires are not permitted on the beach.
13. Upon failure of lessee to comply with any of the
covenants, conditions, rules and regulations hereof, then lessor
may at its option, but without being obligated therefor, do
or perform any act to correct any default, and the reasonable
costs thereof shall be immediately due from lessee to lessor
as additional rent-

TRAILER PARK
RENTAL AGREEMENT AND REGULATIONS
The City of Newport Beach, hereinafter referred to as
"lessor ", does hereby lease to the undersigned lessee the trailer
space number and which is more particularly shown on a map
attached hereto and made a part hereof, in the City's trailer park,
referred to as "NEWPORT MARINAPARK ", Newport Poach, California, for
the term and at the rent, and upon the terms, conditions and regulat-
ions as are hereinafter set forth, to wit:
1. LESSOR - MEANING. It is mutually understood by the
parties hereto, for the purposes of enforcement of the provisions of
this lease, the word "lessor" means the City Manager of Newport Beach,
or his duly designated agent.
2. TRAILERS AND CABANAS. All trailers, cabanas and any
other structures or enclosures shall comply with state and local laws
and shall be kept in good repair. No improvements of any kind shall
be made by lessee without first submitting plans and obtaining the
written approval of such plans by lessor. In addition to architectural
features, such plans shall show color schemes.
3. LOT MAINTENANCE. Lots will remain under direct control
of the lessor. Patio furniture and one storage chest are the only
items permitted outside the the trailer. No laundry shall be hung
outside of trailers. All landscaping, planting and fencing of yards
shall be only with lessor's prior written approval. Fencing and plant-
ing left by preceding tenants shall belong to lessor. Lessee shall
be responsible for the orderly maintenance and upkeep of his trailer
lot.
4. RESPONSIBILITY. The lessor is not responsible for loss
due to fire, theft or accident.
5. ASSIGNMENTS AND SUBLEASES. Trailer spaces are non-
transferable, except where in the judgment of the lessor a permanent
type cabana has been constructed on the site. Lessor may, at its

option, agree only in writing town assignment of the lease cover-
ing such trailer space. Trailers may not be sublet without written
permission of the lessor.
6. USE. The leased premises shall be used solely for
trailer park purposes. Lessee agrees to comply with all laws,
regulations and ordinances of the city, county and state affecting
the leased premises and improvements thereon, and lessee's trailer
and other property.
7. GUESTS. The trailer space is herein leased for not to
exceed persons, and for each person in excess of said number,
lessee agrees to pay lessor $ per day or fraction thereof.
S. UTILITIES. Lessor agrees to furnish lessee gas and
water. Lessee shall purchase electricity directly from the Southern
California Edison Company.
9. TERM. The term of this lease is for the period of
, commencing on the day of ,

10. RENT. During the term of this lease, lessee agrees to
pay to the lessor as rental for said premises, the aggregate sum of
$ , payable in equal monthly installments in the amount of
$ per month, commencing on the day of

the term of this lease. Lessor acknowledges receipt of the sum of
$ as rent for the first and last months` rent of
the term hereof. A five percent (5 %) discount will Be permitted if
one year's rent is paid in advance.
11. TAXES. Lessee agrees to pay when due all taxes assessed
upon his personal property.
12. REGULATIONS. Lessee hereby agrees to abide by the
following regulations as hereinafter set forth and which may be
amended from time to time by resolution of the City Council of the
City of Newport Bach.

(a) Children. Responsibility for the acts of children
rests with the head of each family. Children must have supervision
at all times and shall not play or loiter in or around rest rooms
or in any place except their own trailer area. Parents agree to
be responsible for the torts of their children.
(b) Rest rooms.. Lessee assumes responsibility for main-
tenance and care of private utility buildings and rest rooms.
(c) Noise. Loud talking and any noise that, in the opinion
of the lessor, constitutues boisterous conduct is prohibited. Loud
talking and radio playing that carries beyond the limits of the space
leased to the lessee between the hours of 10:00 p.m. and 8:00 a.m.
is also prohibited. If in the opinion of the lessor, any lessee or
member of his or her family, or any of his or her guests, uses beer,
wine or liquor to excess, lessor at its option may terminate this
lease, and upon verbal or written notice thereof, the lessee agrees
immediately to vacate the leased premises.
(d) Refuse. All papers and garbage must be separated and
placed in proper containers. Refuse containers are permitted only
in spaces provided for them by the lessor.
(e) Use of address. This park or its address shall not be
used for the purpose of advertisement or sale of automobiles, trailers
or merchandise. The only exception shall be with the written consent
of the lessor.
(f) Removal of trailer. Trailers are not to be removed
without first securing the written consent of the lessor.
(g) Telephone. Park office telephones shall not be used
by tenants. No one will be called to the phone. A public telephone
is located in the park for your convenience.
(h) Traffic. A speed limit of five (5) miles an hour must
be observed in the park at all times and all other regulations posted
from time to time must be observed.
(i) Pets. Dogs and cats are not permitted in the park under
any conditions. Other pets must first be approved in writing by the
lessor.

(j) Fires. Open fires are not permitted on the beach.
15. Upon failure of lessee to comply with any of the
covenants, conditions, rules and regulations hereof, then lessor
may at its option, but without being obligated therefor, do or per-
form any act to correct any default, and the reasonable costs thereof
shall be immediately due fr.);i lessee to lessor as additional rent
hereunder.
14. TERMINATION. If lessee or any other occupant of lessee's
trailer site fails to comply with the terms, covenants, conditions,
rules and regulations as herein set forth, lessor shall have the right
to terminate this lease by first giving lessee three (3) days' written
notice thereof. It is agreod that placing or posting of any notice
to lessee at any place upon the leased trailer space shall be equiva-
lent to personal notice upon said lessee.
In the event it is necessary to engage the services of an
attorney to enforce any of the terms and /or conditions of this agree-
ment, lessee agrees to pay lessor reasonable attorney fees and costs.
15. That any and all improvements, including cabanas, left
remaining on said trailer site at the expiration of this lease or
sooner termination thereof as herein provided or by abandonment there-
of by the lessee, shall belong to and be the property of the lessor.
16. OPTION. Lessee shall have the option to renew this
lease upon the same terms and conditions herein contained with the
exception of rental price. Said rental price shall be determined at
the discretion of the City Council of Newport Beach, but will be
comparable to rentals for similar trailer sites in the immediate
vicinity within the Nev:port Marinapark. Lessee must give to lessor
notice in writing of his intent to exercise his option at least sixty
(60) days before the expiration date of said lease.

Dear Madam and Sirs:
On behalf of the Citizens Committee for Parks and
Playgmounds I am writing to clarify our position in
regard to any action your Honorable Body may now decide
to initiate in the matter of placing upon the ballot
the question of reserving for public use a strip of
water front property in front of the Trailer Park.
'When the question of the Trailer Park was first
before the City Council our organization urged the City.
Council to reserve a strip of bay -side beach front ,
to extend the entire water -front length of the Trailer
Park property for the use of the people. At that time
the City Council declined to do this.
We then urged that the City Council of its own
motion submit the question of this reservation for
public use to a vote of the people. This also the
City Council declined to do.
Believing strongly in the validity of our
principle that City owned water -front property suit-
able for the recreational needs of our own community
and citizens should be kept for public use, we there-
fore drew up a proposed ballot measure to be placed
before the people of this City by initiative measure
to insure the reservation of a strip of bay -front
property in front
together with the
area immediately
of the proposed new
presently existing
westerly thereto.

We have obtained many signatures to this petition,
and we were preparing to file the same when we were inform-
ed that the City Attorney was desirous that some change
in the wording of the petition be made before its sub-
mission to the electorate. One of our members discussed
the matter at some length with Mr. Davis.
We would like to make it clear that our Committee
feels that the proposed measure as drafted and circulated
is sound in every respect. However, the proposed alterna-
tive drafted by Mr. Davis with Mr. Webb's concurrance is
equally acceptable to us and if the particular wording of
this latter proposal is more acceptable to the City Attorney,
and since we believe the spirit and true intent of the two
proposals is identical, we would be most happy to see Mr.
Davis' proposed draft, as drawn, submitted to the elector-
ate.
We would of course prefer to have a spirit of harmony
and civic cooperation establish the principle we support
as the law of our City. If, therefore, the City Council
at this time sees fit to initiate the proposed legislation,
in the form suggested by Mr. Davis, and place the same upon
the ballot as an initiative measure by act of the Council,
we will feel justified in withholding our measure.
May we make it very clear we are not at this time
asking you to place this matter on the ballot by Council
action. We are prepared to do that ourselves by filing
our initiative petitions. However, we shall be happy to
have you place this proposed legislation as presently drafted
by Mr. Davis upon the ballot in lieu of the measure as
prepared by us.
We feel that to have you do this at this time would
satisfy many citizens, and in harmony we could present
this matter for a final determination by the peoplep,
We do ask, however, that if you do now vote to place
this matter on the ballot it shall be with the clear inten-
tion of letting the Initiative you may now propose to
place upon the ballot remain there as now drawn for a
final determination at the next General Election; for in
withholding our petition in favor of one as drafted by Mr.
Davis we shall be trusting in the Council, rather than our-
selves to carry this matter to a vote of the people.

"Said lands shall be used by said city and by its successors
solely for the establishme.it, improvernent and conduct of a harbor and
for the establishment and co-struction of bulkheads or breakwaters
for the protection of lands 'vzithin its boundaries, or for the protection
of its harbor, and for the construction, maintenance and operation there-
on of wharves, docks, piers, slips, quays, ways and streets and other
utilities, structures and appliances necessary or convenient for the
promotion or accommodation of commerce.and navigation, and for the
protection of the lands within said city. And said city or its
successors shall not at any time grant, convey, give or alien said
lands or any part thereof to any individual, firm, or corporation,
for any purpose whatever; provided, that said city or its successors
may grant :ranchises thereon fora period not exceeding fifty years
for wharves, and other_ public uses and purposes, and may lease said
lands or any part thereof for limited`periods,'in any event not to
exceed fifty years for any and all purposes which shall not inter-
fere with commerce or navigation; and are not inconsistent with.the
trusts upon which said landu are held by the State of California or
V7= e requirements of commerce or navigation at said harbor."
A- exception is that in the grant of 1929, the time of
leasing property was extended to fifty years, instead of twenty -five
years.
The foiio;JiPp facts with respect to this property respect-
ing the locatio: of the mean high tide line is.substantially as follows:
The City - ngi_,ecr, IYr. Bert Webb, has presented to .me an -
old map, recorded in August, 1905, of this area which shows that in
all probability the mean hlEh tide line in this area extended back to
about the northerly line of the first alley northerly of Balboa Boulevard
immediately in front of 17th Street. From that point, the mean high
tide line extends in a northwesterly direction and in a northeasterly
direction to its intersection with 15th Street and 18th Street. :Je
have no information as to where this lire actually was located at the
time of the three grants from the State of California to the City of
Newport Beach above mentioned,'but.assurie it to be in substantially
the same location as delineated on the map of 1905.
Since that time, by r "eason of accretion or fill, the up-
lands appear to be extended to approximately where the present bulkhead
line has been established by the U.S. Army Engineers. As a result
of many law suits, in which the City of Newport Beach has been a
party, and covering property involved fronting on most of the Newport
Harbor frontage, it has been established by judicial decree that
the bulkhead line as designated by the Army Engineers is located
on the mean high tide line. There has been no judicial determination
as to any of the property owned by the City of Newport Beach. The
mean high tide line as established in these law suits continue up to
15th Street from the east and from 19th Street westerly. Apparently,
the determination of the mean high tide line in front of the city -owned

property was not adjudicate - ,jecause of the ownership by the City
of not only the uplands, but also the:;tide and submerged lands.
It is to be noted that in one of these law suits, pro -certy
owned by t'.e Pacific Electric.:Railroad Company waa adjudSed to extend
to the bulkhead line, It being:a;1so the mean high tide line, some
of this property involved bei.�g immediately to the east of 15th Street,
It shoal:; be further noted that the City acquired title to the up-
lands herein 1;:volved from ti;e Pacific Electric Railroad Company,
said lands being immcediatelf west of 15th Street.
It would be impossible for me to definitely state that the
city- ow"ied property herein i:nvolved,being uplands property, extends
to the bulkhead lime, however, by reason of the judicial decrees
above mentioned, it would be reasonable to assume that this line and
the mean high tide line are the same. rr ^or the purpose of this opinion,
I do not consider it necessary to definitely establish these facts.
From a careful reading,of the conditions of the grants
first above mentioned, it is apparent that the City may lease tide
or submerged lands granted to it by the State for limited periods,
for any and all purposes which shall not interfere with commerce or
navigation and not inconsistent with the trust upon which said lands
are held, or with the requirements of commerce or navigation at said
harbor.
In the operation m" this trailer park and in the leasinj; of
the trailer park spaces, it is my opinion that the City, by so doing,
does not violate any of the conditions of the trust imposed upon it
in the conveyances to the City by the State of California herein
mentioned. In this connection, it is my suggestion that the City
Council go on record that the operation of the trailer park and in
making leases as proposed is: (a) In the judgment of the City Council
for the best interests and welfare of the City and the residents thereof;
(b) That the use of said property for industrial uses or purposes would
be inimical to the best interests of the City; (c) That the use of

said property. for other than !-Ilustrial uses would be for the best
of the City and the resident s.'thereof; (d) That the leasing

cases made and provided; (e) That although in the judgment of the
City Council all of the land here lh referred to constitutes uplands,

nor can said tidelands be used without the uplands abutting thereon,
and that the leasing of the whole as one parcel is necessary for the
Proper development and use of said real ^ro_erty and for the proper
development of Newport Harbor and the City of Newport Beach,

+- About 3 p. m, today one of your councilmen took a picture from the
life guard station on the Trailer Park Beach, looking west, at a
time when there were relatively few people out on the sand strip.
Sunday was a cool day and naturally too cool for comfortable swimming.
But five minutes after he had left the park, MrZ Fred Palmer, my
neighbor, took a picture, marked No. 1, looking east up the beach from
the same place he took the picture looking west. No. 2 was taken look-
ing east also, and No, 3 picture was taken looking west from Lot 11.
The pictures in the Ensign, published recently, cannot be conclusive
of anything showing normal use of the beach, becaume they may not have
been taken at the same hour.
Those who come to a public beach 'on Sunday or Saturday come for a
swim. There is no other place for them to be except on the shore.
Those who live in the trailers spend most of their time in or near their
trailers, as they would a home; and they use the beach for swimming,
fishing or boating only as recreation. The objectives are entirely differ-
ent.
If a public beach were ever opened in front of the Municipal Trailer Park
I doubt if you could lease the lots for anything but concessions, as the
privacy necessary to warrant $30 to $50 per month land rentals would no
longer exist.

However, the new plan met
with plenty of opposition before
the vote..
One other phase of the plan,
as recommended by Ridderhof's
trailer park committee which de-
veloped it, calls for purchase by
the city of Pacific Electric Co.

Dear Madam Mayor and Sirs:-
A special meeting was held by the Central Newport
Beach community Association,Thursday,June 9th,tn the Legion Hall. This meeting
was fOr the purpose of studying and discussing the four expansion trailer park
plans as outlined in a paid advertisement by some group that calls themselves
a Taxpayers League of Newport Beach.
After surveying the plans,we find no civic improvement involved in either
of the four plans,but on:the contrary each plan is fordign'to action already
taken by our Council of August 1954.
Furthermore
,each and everyone of the plans are against the public tnteresf_
and a direct rebuff to those who are seeking to relieve the vital shortage and
the need for additional beach and bay are for swimming and recreational
activities.
Subseguently,a Motion was made and passed unanimously in protest against
any trailer park expansion project within the confines of the present public
beach property,now called Municipal Trailer Park.
The City of Newport Beach cannot afford to sacrifice this last piece
of public bay frontage when it is so vitally needed for our own citizens.
A well planned and regylated recreational area in this plot of beach
and water can be made self sustaining as an all year adult and children
City Park within a short period and mithou# extra cost to taxpayers.
It was well stated by our own Congressman,James B.Utt,tn this weeks
letter from him and published in several Orange County papers. Speaking of
Laurance Rockefeller during a Congressional study and tour of the Virgin
Islands. Quoting Mr.Wtt--- - - - "He desires to give this land to the government
s[E as a national park in order to preserve the beautiful beaches for
public use before individual people buy them up and close them to public use' -
Unquote,
The cardinal principle and by -line off this Community Association is to
„RRESERVE PUBLIC PROPERTY FOR PUBLIC USE'
Therefore,we emphatically reject any plan that will deny our own
tax - payers and voters the use of our own public beach property. We are of the
opinion that an excessive majority of Newport Beach citizens support us in
this principle. 4�

Honorable City Council:
At a meeting of the Board of Directors of the Balboa
Peninsula Point Association held June 6, 1955., the unanimous
decision was reached to urge your honorable body to continue
the Municipal Trailer Park. This decision was arrived at after
giving full consideration to the arguments pro and con presented
at meetings of the City Council and the Parks, Beach and
Recreation Commission. It was felt that the income which is
derived, and which reportedly can be increased by certain
improvements to the Trailer Park, can be used for, and will
result in, for greater benefit to the citizens of Newport Beach
than converting the area in question to a public beach. In
addition, although bay frontage available for public use is
limited compared to the miles of ocean beach, it was the opinon
of the Directors that locating a swimming area so near the
industries fronting on the bay is not wise.
The Directors of the Balboa Peninsula Point Association
therefore, earnestly request your consideration toward maintenance

recommendation was approved.

Mrs. Palmer, our three.chi2dren, their seven children and 3 have been guests
of the municipal campground and trailer park for many years. It has afforded
us uarneasurable'happiness and health and now its future has suddenly bccorne
a most controversial question.
Saturday, May loth, we lessees in the p athered in one of the kitchens in
the park for a conference at my instigati ighty of us discussed this equation
for an hour very informally. The outcome was all wrapped up in this agreerrent:
First - To cooperate fully with all rules under the guidance of the Crowells, and
to help them ail -we could, and
Second- To sit tight and listen for further developrylnts
Third- For as many as- could to attend the meeting of the Park and Recreation
Commission May 17tli and the subsequent Council meeting of the 23rd..
We consider ourselves both outsiders as well as interested members of your
community. We hesitate to become too vocal, as this procedure can easily be
considered purely selfish.
Meanwhile this moot question is very disturbing because of the uncertainties in-
volved.. Many do not even dare replace cabanas which were blown down last
winter. Many do not dare buy a modern trailer with bathrooms; many desire to
build modern cabanas, built to the City code, Many wonder if: they should get out
now while they can get buyers for their equipment.

I'm a Newport Beach property owner,a tax paying voter and long time
resident of West Ocean Front,adjacent to the so called Municipal Trailer
Park.1 have been as extensive world traveller,have visited many beaches
and know how they have been kept and the condition of each.
It is asserted that the Trailer Park,is being illegally rented to
an exclusive group of out of town people,by the City officials of Newport.
It is also declared that this Bay Front property,belonge to the
local people,and should be available for their use,and that the Oity has
no right to conduct a Trailer Park businesa,,in competition to other Trail-2
Parka,in the Newport Beach area. Why,therefore does the present new
administration,allow this injustice to continue and to consider the
prospect of improving the site,,as proposed by the City Manager,despite
the fact,that the previous Council agreed to return the property to the
people,by this coming September?
The Trailer occupanta,who now inhabit the property in question,are
not tax payera,voters or property ownera,yet they attend the meetings in
the Town Hall,and by voice and applause,endeavor to deride the claims of
the local geople,when they request the use of this choice Bay Front Beach,
Surely this matter concerna,only the representative,local inhabitant
and their elected Council and not a group of outsiders,belonging to other
distant communities? Their interference should be stopped,by the City
authorities.Meantime our beach goers have only'the Ocean Front Beach.
The Ocean Prontl Let me describe how that beach is kept.
We of Newport Beach should be justly proud of this magnificent
stretch of sandy shore, ......... butl period. It is never properly cleanec
and I mean cleaned,although we tax payers are heavily charged for it.
Throughout the winter months a huge amount of filth accumulates,
from the land,sea and air. Beer cans and broken bottles galore, paper
and garbage and cardboard drinking cupa,in abun:dance,atrewn about by
picnic parties,who leave their trash on the beach,because the existing
ordinances are never enforced. Dead seals are washed up on the shore,,
decayed fish and their entrails are strewn by the tide and sea birds
make it,their last resting place,amongst the oil well residue and bilge -
water muck,vegetable,fruit and other refuse and offal cast overboard by
passing ships.This germ infested mass grows larger,as the months pass.
None of it is carted away except the seaweed which is sometimes
gathered and trucked to purchasera,who use it,to obtain the alkaline
substances it contains. Dead seals are buried,ahallowly,on the shore.
When spring comea,this nasty mesa of filth,which must contain
dangerous microbes of disease,is smeared across the beach,by the City's
tractor,which drags e. log, attacked to a chain,behind it.
It is upon this decayed area of uncleanneas,our beach loungers
are forced to sit and recline ,because they are derived ohf any p�laee
else to go. Appalling i,s'nt it. What a ghastly me ace to ea , or our
Children to play in,yet we spend millions to fight Polio and. disease.

It is truly, astonishing that t alth Dept., of this area,permits such
unsanitary methods to continue. menace to health is undeniable and yet
it doea,in. fact exist and unless stopped,will continue.
Here is proof of past maladministration and dreadful City management.
Our Bay Front Beach is badly needed by the community parents and the
children of the district.It is a choice site and free from,tidal dangers,
and it should be returned to the local public for health and recreation
Let the Trailer Park people,patronize some of the other Trailer Parilvv
in the Newport area.There are many of them,or if necessary,relocate the
present one,elsewhere. They can spend their $40.00 dollars a month for
parking space there and still have use of the beach,with the local people,
by paying for the privelege,to aid in it's upkeep.
Much is said about loss of revenue. This argument is absurd.
Other beachea,throughout the nation and the world,obtain a handsome
revenue from it's iriaitors. I know many of them and cite Jones Beach,
on Long Island,N.Y .... A1so,Todd's Point,of Greenwich,Connecticut.
There are many others,all of them reaping a substantial revenue.....,
and above all,they are kept beautiful and very sanitary. Uniformed
attendants see to it,that ordinances are strictly adhered to,or else.
The same thing can be done here and even more profitably because of
our all year round,aunny,southland climate. Tourists and non residents,
coming hereto use the beach,ahould be charged for the privilege.
Bath houses will bring in a revenue.Parking lot chargea,ahould be levied
and concession righta,sold to refreshment vendera,etc. Opportunities, aboud
A great many of the local inhabitanta,have signed a petition,requesting
the return of the fay front Heath property.This is indicative of local
pmntic opinion. The prevent honorable council must realize that they expect
fair treatment and not the shameful behavoir of old time administrationfi
The return or the Bay Beach Property will incur no loss of revenue,if
it is properly managed,by the people's representatives.
Make this district beach area,a sanitary place for the local people
to enjoy,not a 8lumland of the 8outhland,as I have heard some visitors
call it. End the folly of the past administrations and gain gratitude of
all people,who reside here.

To the Respected Commission: Re: Trailer Park
The undersigned is unable to attend the meeting of Tuesday, May
17, at which discussion will be had concerning the continuance or dis-
continuance of the Trailer Park.
As a non - resident of your City, I pay no direct taxes and hence
presume that I have no authoritative voice at your meetings.
As a frequent resident of your City, my family pays a great deal
in in&ect taxes; spends many dollars throughout the year with your
merchants; and pays a realistic annual rental for the small space we
occupy.
We have been pleased and somewhat proud of the record of good be-
havior by Trailer Park lessees and their guests during the five years
of our tenancy. It is difficult to find a comparable number of per-
sons who have caused a community's police and /or fire department so
little trouble.
May I add, in conclusion, that as a direct result of my regard
for the Trailer Park I have been instrumental in introducing the di-
versified attractions of your community to quite a number of persons -
and many of them have become summer renters. I am firmly convinced that
the organized minority seeking the elimination of this park are defeat-
ing their own purpose. We rent from the City and our friends rent from
Newport property owners.
Were there insufficient beaches available one could understand
the public- spirited sacrifice of income. But when available beaches
are seldom used to capacity, then, indeed, what appears to be self-
sacrifice really becomes unnecessary economic budgetting to satisfy
the voice of an organized minority.

A letter, dated July 9, 1954, from the League of Civic
Associations v requesting the conversion of the Municipal Trailer Park
to a Public Beach, was referred to the undersigned for recommendation.
About nine years ago, the Trailer Park was converted from a
Camp Ground to a Trailer Park and has been continued in operation ever
since primarily for the income the City derives from its operation.
This past fiscal year showed a gross revenue of $442164.16 and a net
return to the City of $33,4:63.10. The desirability of eventually develop -
ing this property as a public beach is unquestionable. The main problem
would be to adjust ourselves to the loss of this revenue. It is true,
that parking meters could be installed and furnish considerable return
after their cost was recovered. It is believed that this could be
made with a self - supporting recreational activity.

With this thought in mind, it is believed we should take
necessary steps to be in a position to decide one way or another at
Budget time next year. If this thinking meets with your approval, it
it recommended that a policy be adopted as follows. — That all future
lease renewals be written to expire not later than September 30, 1955;
and that no leases be written after April lst, 1955. This policy to
remain in effect until budget setting time next year.

Gentlemen:
I have just been advised that the City Council is contemplating
increasing the rent it the trailer park in your city of Newport.
Inasmuch as I have been paying-'rent there for the past two or
three years, the year around, I thought I world drop you a line
regarding this, as I understand no d6fihit6 action has as yet be
taken. I understand that this is under discussion now and possibly
something will be done, with reference to increasing the rent.
Inasmuch, as I have been paying rent all the time, and there were
no winter rates, I feel that it would be an injusted for me to
pay an additional increase at this particular time. I only occupy
the trailer about 90 days during the summer. During the rest of
the year my trailer remains vacant.
As we only use the trailer three months and pay for the entire year,
it figures quite expensive rent for the three months we use the trailer.
This runs $200. or so for the three months, which you can see is
quite a great deal. I Reel that those that pay rent all the time
should be allowed a consideration, and if we had been paying a winter
rate it would be in order to pay an increase at this time. I don't
think we should have to paw as those that just come in for the
summer months and move out again. By paying rent all the time it
should offset a difference that you charge those just for the summer
months, as you no doubt have vacancies during the winter.
I would appreciate your giving this consideration on my behalf and
I know that there are a number of others who possible feel the same
way. I felt that I would personally like to call this to your attention,
for I intend to continue keeping my trailer there in the further.
In the event the rent is raised, it is going to be most difficult
and beyond my financial means to do so. I enjoy your beach very much
and would very much dislike to do otherwise in the further. I trust

disturb the rent as we are now paying.

With reference to your trailer park at Newport, I have been a retter
there as you may, or may not know, for some time, We occupy the
trailer only during the summer months, from approximately July lot,
up to October lot, The remainder of the year, this remains idle,
so naturally we use no utilities, nor are we any expense whatsoever,
during the other nine months of the year, and feel that it would be
an injustice to raise the rent on those that pay rent the year around,
and actually occupy and use their trailers for only about three months
out of each year,
We would like to continue the same arrangement in the future as we have
had in the past, and feel that when we pay the rent all the time, that
we should be given special consideration, other than those that merely
come in for the summer months, for there are those that possibly obtain
space during the summer months, and it might be in order to charge higher
rate to them, but those who leave their trailers there all the time, 12
months of each year, and pay rent accordingly, and are no expense what-
soever to you, I feel that in proportion, we are paying a very high rent
for the three months that we use the trailer, If we had to pay ar.succes-
sive rent, such as that, it wouldntt seem fair.
I just heard that you were contemplating raising the rent, but nothing
had been done on this, as to any definite action, and merely wanted to
give yeu my opinion in the matter prior to your making any decision,

Certain improvements to the Newport Beach City Trailer Park are now being
contemplated to bring the conditions of the Park up to standard. Last
spring, as you know, the entire area was surfaced with decomposed granite
and electrical outlets provided for each lot. The attached report shows
the estimated net income for the fiscal year 1946 -47 to be $17,000.00.
We were granted a certain increase in the rental of these lots by the
0. P. A for these improvements and it is likely that we could get an
additional increase if we were to make certain other improvements at
this time. I have estimated the cost of a sewer system and additional
water lines in order to serve all lots. Also, the existing wooden fence
is in a very delapidated condition and probably with the installation of
sewers and water lines along this fence, we will find it necessary to in-
stall a new wire fence. The following is a list of the above mentioned
improvements and their estimated costs:
1 Approximately 3000 feet of bR Vitrified sewer pipe

We have also been considering the installation of electric meters for each
lot which no doubt would be a paying proposition for the City over a period

of time. The electric bills paid to the Edison Company amounted to $859.18
for the last six months. At the present time, approximately 75% of the
Trailer users are limited to 500 watts, which does not give them the use of
electric irons, toasters, heaters, etc. The remaining 25% (lots along the
fence) are not now restricted and no doubt are using electric appliances of
the nature mentioned. If meters were to be installed, we could increase
this wattage per Trailer and the user could pay according to t::e current
that was used. It is estimated that the cost of putting meters in would
be approximately $3,500.00, which shows that the cost could be ammortized
over a period of two years on the basis of current bills now paid by the
City. However, it is doubtful if we could get meters in time to have them
installed by the summer season.
If these improvements are to be made by April 1st, which woriald be the
dead line on having any improvements completed, a Program should be
started in the very near future. I understand that sewer pipe is avail -
able by Feb. 1st if we place our order now.

The receipts and expenditures of the Trailer Park so far
this fiscal year, areas follows:
The maximum gross income at present authorized rates is -
$2,710.32 per month, or $32,523.84 per year. It is conservatively
estimated that we will realize 78% of this for the fiscal year, or
approximately... .. . ..... ............$25,368.59
The total operating budget for the year is........... 8,400.00
Estimated net operating profit ....................... 16,968.59
The income for the first five months is 36% of maximum.
The income for November was 50% of maximum. It is behind December,
January and February. Will hold to about this figure and if our
construction program can be gotten out of the way by March 1st., WE
will see a big increase in March and a full park by April 1st.

Pursuant to your instructions, the following report
on the Municipal Cramp Ground is herewith submitted.
The policy of operating the camp grounds has been
more or less a hit and miss proposition during the past few
years, due in part to the war emergency. The city should adopt
a definite policy so that the camp grounds can be operated
efficiently and provide the maximum revenue to the city.
Originally the camp ground was operated by a private
party and the city received a percentage of the income. This
plan was abandoned in 1929 . as the revenue to the city was not
sufficient.
The city never has received the maximum revenue that
it was entitled to. The main purpose for years was to provide
camping space at cheap rentals, figuring that it developed a
certain amount of advertising value, and merchants in the immed-
iate vicinity received a considerable amount of trade. The
growth of the community eliminates both of these items to a
large extent. The camp grounds were operated for five months
each year, which was the camping season.

The lease for war work terminated in April of 1945, and
the grounds were opened again for the summer season with the
understanding that a plan would be develpped for the proper
utilization of the area so as to provide the maximum return to
the city. The delay in working out such a plan and the determin-
ing of the best policy of operation, together with the failure
of the former custodian to carry out instructions, has re-
sulted in a loss of revenue to the city during the winter
months.
During the past year the general appearance of the
camp ground was improved by increasing the size of the lots,
providing additional trailer sites and restricting the type of
tents. A majority of the tent sites were occupied by trailers.
The applicants with trailers would have more than filled the
grounds, although more than half of the sites were not laid out
for such use. If the policy of operation had been definitely
determined, at least forty trailers would have occupied the
grounds during the winter instead of only the nine now there.
In past years a limit was set on the time each occupant
could use the camp ground and the system of first come first served,
was given accomodations. This year advanced reservations were
accepted and the time limit was eliminated. Although the number
of sites was reduced and the camp ground was operated seven
months from June 1st, 1945, the net revenue was increased by
$2,409 over pre -war 1941 income.

The net income to the city is less than the books show
when you take into consideration the cost of garbage and trash
collection, free water and administrative overhead.
The value of the 960 feet of water frontage occupied by
the camp ground is estimated at $282,000. The existing improve-
ments are estimatea at $18,000. A fair return to the city on
a valuation of $300,000 at 5% would he $15,000 per year. Com-
puting a lease on a rental basis of $1.50 per front foot per
month, the return to the city would be $17,280 per year, which
is double the present income to the city.

It is my opinion that regardless of whether the city
continues to operate the camp ground or leases it to private
parties, the water frontage should be developed for boat slips.
At present there is a shortage of mooring facilities in the
harbor and this will be a serious problem in the future. It is a
well known fact that rental of 'boat slips is not profitable unless
other businesses are operated in connection therewith.
The possibility of the area being developed as a sport
fishing center has been discussed. If private interests are
interested in such a plan it might be advisable to lease the
land with proper restrictions providing that the city would
receive a fair return on the value of the property. However,
I do not think that such a plan will be profitable in from
five to ten years. There are several establishments in the
harbor catering to sport fishing and seem to be doing a good job
of it. Why should the city jeopardize established businesses?
I believe the most feasible plan for the next five
years at least, is for the camp ground site to be developed
as a high class trailer park with a portion of the water front-
age to be used for boat slip rentals, and operated by the city
or by lease agreement. The trailer park will produce more
revenue at less capital outlay than any other use.
The building occupied by the camp custodian is lo-
cated on private property. Several years ago the owner of the
property paid the city $100 to have the building moved. Owing
to war conditions the. owner did not insist on the building
being moved immediately. The owner has now requested that the
city move the building. We have received a quotation of $150
for moving the building inside the camp ground gate, or $200
for moving it to the south side of the camp ground in the
vicinity of 17th Street.
The following plan, together with the estimated cost,
is recommended for the improvement of the city camp ground as
a trailer park:
(1) Install electric conduit to all
lots not now served by electicity. $2,390

The trailer park, if properly operated throughout the
year, should bring in a net revenue of close to $10,000.
The gross income from the boat slips would be approximately
$5,000 per year. With the trailer park operator also looking
after the rental of the boat slips, the net income should be
around :4,000 annually.
The construction of the boat slips should be post-
poned until the labor and material situation is more favor-
able.

!Gentlemen:
The revenue from the Municipal Camp Ground for the
months of June to September will be 50% less than last year.
The revenue for the month of October, 1941 amounted to '$184.70.
Present indications are that this will be cut in half. The
revenue received for the months of November, 1941 to April,
1942 amounted to $149.50. Revenue for the months of April and
L'ay, 1952 amounted to $97.50.
It is my opinion that the Camp Ground should be closed
from October 1st to P,?ay 1st. T.'1Ir. Patterson, the Camp Custodian,
has advised me that he will resign his position at the end of
September.
