CALIFORNIA, AS AMERDED.
01EREHAS, pursuant to the Conservation and Planning
Law and request of the City of Newport Beach by its
Resolution `To. 4106 of July 13, 1953, the Orange County
Planning CoMiscion has caused to be prepared a crap
designated EXHIBIT "B ", which map proposes to amend and
supercede the portion of the Shoreline Master Plan
applicable to the City of Newport Beach, and
WHEREAS, this Board of

Supervisors is in receipt of
p5" said aforementioned map.
'WHERFAS, as provided by the Conservation and
Planning Lair one public hearing has been held by the Board
of Supe-�visors of the County of Orange on September 22,
1953, at which hearing all present were given opportunity
to express themselves, and
WHEREAS, the Board of Supervisors of Orange County
is convinced that the conservation and promotion of public
health, safety and general wolfare requires the amendment
of the Master Plan of Shoreline Development of Orange
County, California, as set forth by the above stated map
designated EXHIBIT "B ".
NOW, THEREFORE, BE IT RESOLVED AND ORDERED that
the Master Plan of Shoreline Development of Orange County,
California and the amendment thereof entitled "Revised
General Plan and Priority Program" which was adopted by
said Board on the 26th day of April, 1949, be amended by
repealing and removing therefrom that portion of said
Master Plan applicable to the City of Newport Beach as set
forth by maps numbered 3, 4, 5, 6, and 7 of said "Revised
General Plan and Priority Program" and that the above
stated map designated EXHIBIT "B" be adopted in place
thereof.
BE IT FURTHER RESOLVED, that the Clerk of said
Board be, and the same is hereby directed to certify this action
upon the document and map constituting said amendment and to
transmit the necessary copies thereof, together with a copy
of this resolution, to the Park Commission, Division of
Beaches and Parks, Department of Natural Resources, State
of California.

• WHEREAS, tine City Council of the City of Newport
Beach has heretofore adopted a Resolution approving the
acquisition of certain real property in China Cove for park.
beach and recreational purposes, as part of the Master Plan
of Shore Line Development of Orange County and the State of
California; and
WHEREAS, the State of California has offered to
purchase sa9.d real property for a public beach on the basis
of the City of Newport Beach furnishing `=matching lands ";
and
WHEREAS, the City of Newport Beach, subsequent to
the approval of the said County and State Master Plan, did
adopt its oun plan in relation to China Cove, and did acquire
certain property therein, which said plan and acquisition of
property contemplates the acquisition of a lesser total
amount of real property in that area than the heretofore
approved Master Plan of the County of Orange and of the
State of California; and
WHEREAS, said next above referred to plan of the
City of Newport Beach also contemplates the acquisition of
certain other real property adjacent to or near said China
Cove for additional park, beach and recreational purposes
as a part of the Master Plan of Shore Line Development of
Orange County and the State of California, said additional
real property being more roarticularly described below; and
WHEREAS, it is felt that the City Council of the
City of Newport Beach should declare the change in its plan
from the said Shore Line Master Plan of the County of Orange
and of the State of California in order to remove the effect
of the County and State Plan from property not covered by
the new plan of the City and in order to place said addi-
tional property proposed to be so acquired under first
priority;
NOW, THEREFORE, BE IT RESOLVED, that the City
Council of the City of Newport Beach hereby withdraws its
previous action in approving the Master Plan of the County
of Orange and in its participation in the Master Plan of
the State of California in respect to all of the first
priority property in China Cove*
BE IT FURTHER RESOLVED, that the following de-
scribed real property, as shown on a Map marked Exhibit B,
dated June 19, 1953, be made a part of the Master Plan of

WMMUAS, the City of Newport Beach is the owner of the real property
hereinafter more particularly described; and
WHEREAS* said real property is not necessary for public use by said City
of Newport Beach; and
WHEREAS, the City <council of the City of Newport Beach heretofore invited
bids for the purchase from the City of Newport Beach of the real property
hereinafter more particularly described; and
AREAS, pursuant to said invitation, an offer has been presented to the
City of Newport Beach by Ralph P. Maskey, a licensed real estate broker, on
behalf of John A. Matthay for the purchase of said real property at a total
price of $38,100.00, upon condition that the buildings now on said real property
be removed by the City of Newport Beach at its own expense; and
WHEREAS, said offer is the highest and best bid made for the purchase of

15 WHEREAS, the City of Newport Beach deems that said price of $38,100.00 to
16 be the fair market value of said real property, allowing for the removal of

BE IT FURTHER RESOLVED, that the Mayor of the City of Newport Beach and
the City Clerk of the City of Newport Beach be and they hereby are authorized
to make, execute and deliver a good and sufficient grant deed and any and all
other documents necessary or expedient so as to vest title in said John A.
Matthay to said real property subject only to donditions, restrictions,
reservations or rights of way of record; and
BE IT FURTHER RESOLVED, that in pursuance of said sale, the City of
Newport Beach procure, at its own expense, a certificate of title showing title
to said real property so vested in said John A. Matthay as aforesaid; and
BE IT FURTHER RESOLVED, that the commission upon said sale, which
commission is fixed at $1,905.00, be paid to said Ralph P. Maskey in
compensation for his dervices in connection with said sale.
The above and foregoing resolution was duly passed and adopted at a
regular meeting of the City Council of the City of Newport Beach held on the

On February 28, 1949, the City Coun�2 a,l of the City of Newport Leach
adoptec Resolution #36)7 wherein authorization was given the con-
veyance of docks 14 -A anc 15 -A, Section B, Newport Beach, to the
State of California on the conditions therein set forth, a copy of
said resolution is attached hereto and marked Exhibit A.

On July 29, 1949, Mr. John A. Hennessy, Supervising Land Officer of
the State of California, by Miles E. Allen, Parks Land Purchasing
Officer, wrote a letter to Mr. John Sailors, City Tanager of the
City of Newport Beach, referring to a conversation with Mr. Sailors
of that date, in which the matter of conveyance of the city's
"matching lands" was discussed, and suggesting the opening of an
escrow. I't was suggested in said letter that in addition to Blocks
14 -A and 15 -A that either Blocks 13 -A or 16 -A, or preferably both,
should be conveyed for matching purposes. This letter also set
forth the followings "In addition to tf.e city's fee -owned lands to
be conveyed for matching, a quit claim deed of the submerged and
art.ificiall7 accreted lands seaward thereof must be included in the
conveyance.' A copy of this letter is attached hereto and marked
Exhibit B.

On September 12, 1949, the City Council adopted Resolution ,'B728.
In this resolution, Resolution #3607 was referred to and reference
was made to Blocks 14 -A and 15 -A. Further reference was made to
the fact that the acquisition contemplated entailed a greater expense
to the State of California and that it appeared to the best interest
of the city that an additional donation and grant to the state be
made. The property granted was then described by metes and bounds
and a separate paragraph in said resolution authorized a quit claim
to the State of California of all of the right, title and interest of
the said City of Newport Beach in and to all land lying seaward of the
property above referred to. A copy of said Resolution ;3728 is
attached hereto and marked Exhibit C.

On October 17, 1949, the City of Newport Eeach executed a deed
signed by Dick Drake, Mayor, and Charles K. Priest, City Clerk,
wherein in addition to the property r'es -.r ;bed by metes and bounds,
the city quit claimed to the State of i:;2:li.fornia all of ti right,
title and interest of said City of Newport. Beach in and to all
land: lying seaward of said described property. This deed was
accepter, by the State Park Commission on October 21, 1949, A copy
of said deed is attached hereto and marker; Exhibit D, and a copy
of said acceptance is attached hereto and marked Exhibit E.

A certificate of Approval by James S. Dear.-., Director of Finance of
the State of California, was executed on October 28, 1949. A copy
of said Certificate is attached hereto and marked Exhibit F.

These documents were recorded in the office of the County Recorder
of Orange County on November 16, 1949 in Book 927, Page 175, Official
Records of said county.
CONCLUSION
From the foregoing, it appears that the original Resolution #3607 wherein
the city authorized the conveyance of two blocks, being Blocks 14 -A
and 15 -A, was not acceptable to the State of California. that there-
after, the position of the State Division of Beaches and Parks was
made clear as to the property required from the City of Newport Beach
as set forth in said Exhibit B. That the City of Newport Beach, by
its Resolution #3728, approved the conveyance substantially on the
terms and conditions therein set forth, which, by quit claim, in
effect conveyed the interest of the city in the tidelands described.
As shown, the transaction was finally completed by the acceptance
by the State of California of the deed executed by the city on October
17, 1949, wherein the city quit claimed to the State its interest in
the tidelands described therein. The transaction was closed when the
documents were recorded on November 16, 1949.
From the state of the record, it is my opinion we could not prevail
in any action against the state to reform the deed and clear the
title to the tidelands involved in the City of Newport Beach.

RESOLUTION N0, 9607
WHEREAS, under Chapter 1422, Statutes of 1945, the Department of Natural
Resources, through the State Park Commission, have been authorized and directed
to make such supplemental surveys as may be necessary to determine what lands
are suitable and desirable for inclusion in a well balanced system of State
Parke and Beaches; and
WHEREAS, no portion of the appropriation mode by said Act. Chapter 1422,
Statutes of 1945, may be expended for the acquisition of Ocean Beaches and
..Beach Parke, except as provided for by Section 3 of said Act, in any county
which has not adopted the Master Plan of Shoreline Development for that county,
which Plea shall set up priorities Of acquisition and use of the shore line
of that county; and
WHEREAS, the County of Orange, in the State of California, has under
consideration an amendment to the Master Plan of Shoreline Development for
said County of Orange, which amendment proposes to set up priorities of
acquisition and use of said shore line; and
WHEREAS, there has been submitted to the City of Newport Beach a General
Plan and Priority Program for the acquisition of lands within said City, all
as shown on plat and map hereto attached marked Exhibits uAu and sBs and by

this reference made a part of this Resolution;. and
WEEMS, by Sections 5150 and 5151 of the Public Resources Code, the
City of Newport Beach my assist the State of California in acquiring any
park, playground, recreational center or beach to be used for recreational
purposes, and by the same Sections of the said Public Resources Code, it is
provided that such assistance may take the form of a donation, conveyance, or
grant to the State of any real property owned by the City of Newport Beach; and
WHEREAS, the State of California has agreed, through its Division of
Beaches and Parks, to purchase certain lands in the City of Newport Beach on
the condition that all purchases by the State be matched by a donation by the
City of Newport Beach of properties of equal value;
NW, THEREFORE. BE IT RESOLVED, that said General Plan and Priority
Program so shown on Exhibits "All and uBu,hereto attached, be and hereby 1s

For the use of your City Attorney in crafting the deed we enclose
a photocopy of a deed from the City of Los Awles to the State of California
which deed was used to convey "matching lands of the City of Los zUizeles
in connection with Los Angeles County's Master Shoreline Plan. It is
requested that this photocopy be returned to this office when it has served
its purpose.
It will, of course, eventually be necessary that the City furnish
the State a policy of title insurance to iCs fee -owned "matching land ", the
cost of which policy is to be borne by the City.
In the meantime, we will have complete appraisals made of the
"matching properties ".

WHEREAS, heretofore and on the 28th day of February,
1949, the City Council of the City of Newport Beach duly adopted
its Resolution No. 3607 wherein it was resolved among other things,
that when the State of California should, pursuant to the recitals
in said resolution set forth, acquire certain real property shown
in Exhibits A and B referred to in said resolution, conveyance by
the City of Newport Beach to the State of California be made of the
following described real property, to wit:
Blocks 14 -A and 15 -A, Section B, Newport Beach
as recorded in Map Book 4, page 27 of Miscellaneous
Maps, Records of Orange County, California.
WHEREAS, the acquisition by the State of California of
real property in accordance with the program in said resolution
referred to has entailed a greater expense to the State of Californi
than contemplated; and
WHEREAS, it appears to the satisfaction of the City of
Newport Beach that the State of California has made said acquisition'
as so shown in said Exhibits A and B; and
14HEREAS, it appears to be for the best interest of the
City of Newport Beach that, in consideration of the premises and
other valuable consideration, all of which the City Council of the

Recently the City Council has abandoned Bay Avenue which was located
bayward of the bay front homes on the peninsula eastward from G Street.
There was no abandonment of Bay Avenue immediately in front of the
street ends, The owners of the bay front lots fronting on this street
contributed to a fund which has been delivered to the city which is
to be used for the purpose of public improvements on the peninsula.
It is now proposed that slips be constructed by the city bayward of
three of the street ends in this area, and that the cost thereof be
advanced out of the fund contributed by the bay front owners above
_.maitioned. It is further proposed that these slips be leased to
owners of approved small boats. The question involved is whether the
income therefrom may be used to reimburse the fund above mentioned.
As set forth in my memorandum to you of January 8, 1957 regarding
the subject of Newport Harbor, the grants to the city of May 25, 1919,
April 5, 1927 and June 15, 1929, provide in part as follows:
"(a) Said lands shall be used by said city and by its successors
solely for the establishment, improvement and conduct of a harbor and
for the establishment and construction of bulkheads or breakwaters
for the protection of lands within its boundaries, or for the protection
of its harbor, and for the construction, maintenance and operation
thereon of wharves, docks, piers, slips, quays, ways and streets, and
other utilities, structures and appliances necessary or convenient for
the promotion or accomodation of commerce and navigation, and the
protection of the lands within said city. And said city or its
successors shall not at any time grant, convey, give or alien said
lands or any part thereof to any individual, firm, or corporation for
any purposes whatever; provided, that said city or its successors may
grant franchises thereon for a period not exceeding twenty -five years
for wharves and other public uses and purposes, and may lease said
lands or any part thereof for a period not exceeding twenty -five years
for purposes consistent with the trust upon which said lands are held
by the State of California and with the requirements of commerce or
navigation at said harbor."

OPINION.
It is my opinion that the proposed *11ps may be constructed, the
cost thereof to be advanced out of the fund contributed by.the bay
front property owners above mentioned; that said fund may be
reimbursed out of the income from the lease of the slips so con -
structed; that all maintenance and replacement cost may be paid
for out of said income; the balance remaining after such reimbursement
and after the cost of such maintenance shall be used for the general
purposes set forth in said grants.

Gentlemen:
Please consider this a request fnr your recommendation for
the acquisition of the below stated properties under the
County Master Plan of Parks and Beaches.
The property at China "cve including all of
Blocks B32, B33, D33 and A34, Lots 7,$, 14,
15 of C33 and 3, 4, 5, 6, 8, 91 10 of B33 as
per ;nap.
It been brought before the Council at an informal meeting
by the Corona del Mar Civic Association and the State Park
Commission that there are available funds appropriated by the
State to Orange County for the purpose of purchasing parks
and beaches such as China Cove and surrounding properties.
We were asked then to take it up with the Planning Commission
for their approval. The State asked that the city deed them
matching lands to compensate. It was thought, by the Council,
that beaches fronting commercial property along Balboa could
be used as matching lands.
After submitting our plan to the County Planning Commissioner
and supervisor, Willis Warner, they advised us that the plan
was practical and as soon as they received the request from
our City Council, they would place our plan on the number one
priority which would be filed with the State immediately.
At the present time, there are two building permits issued in
the center of China Cove Beach. The buildings have already
been started, therefore speed is an essential factor in our
proposal.
We respectfully request quick and favorable action on this
plan to save one of our most desirable beaches.

Reference is made to your telephone call on Novem-
ber 4th during which you requested an extension of the offer
heretofore made by the executors of the last will of Charles
C. Adams, deceased, to sell the property belonging to the es-
tate known as Inspiration Point, Corona del 'Martz California.
The original offer made by them on August 25, 1y54 called for
the offer to expire at 12:00 o'clock noon on November 30, 1954
unless by that date the offer had been formally accepted and
an escrow opened to consummate the sale. You have asked for
an extension to the end of the week of November 28, 1954.
This will serve as notice that the original offer
of the executors is hereby extended until December 4, 19549
at 12:00 o'clock noon on the same conditions as previously
existing. It is a further requirement that any escrow which
may be opened by December 4, 1954, be closed by December 27,
1954, in order to permit the executors to use the sale pro-
ceeds for payment of Federal Estate taxes in decedent's estate.
A copy of this letter is being sent directly to the
State for their information.
