The land under lease now belongs to the County of Orange and the City no longer has any interest either in the lease or in the property. The title was quieted in Orange County under a Superior Court case entitled 'City of Newport Beach v. County of Orange" Superior Court No. 59376. The decree in that case was Mad November 21, 1952. It quieted title to that land and some additional land in the County of Orange and quieted title to the say Club property in the City of Newport Beach. The settlement with Orange County was carried out in accordance with the directions contained in City Council resolution No. 4011. Walter W. At the time of the purchase the City reserved at the Southeast corner of said property a plot 340 x 350 feet on which is situated a well, which is not 'being used, and several small buildings. I understand this was retained by the City in the event it might need the well at some future time. I am hoping, in the near future, to establish a shopping center on the 86 acres and in connection therewith I am anxious to either purchase or lease the corner retained by the City. The purpose of this acquisition, or the leasing of said corner is to prevent signs being placed thereon or other buildings or improvements that would interfere with the proposed shopping center. I would be willing to enter into a 25 -Year lease to the property with the understanding that it would not be used for anything but farming, or probably parking, and that no improvements would be erected thereon if the shopping center goes through. Or, if you do not wish to lease it, I would be willing to make monthly payments to the City for the purpose of keeping off any billboards or other improvements or other business. I am willing to meet any other offer that might be sub - mitted to the City for the use of this land. In the event we entered into an agreement for said parcel, I would like to have the agreement contain a provision to the effect that if the City at any time desired to sell the property I would be notified and have an opportunity to bid for the same. In the event you anticipate leasing the parcel for out- door advertising or billboards, I will meet any rental offered. Further, in the event we entered into an agreement and during the term thereof the City should need to use the well for water, I would be willing to cooperate with the City and arrange for the City to put down a second well, if desired, on that part of .the 86 acres which would not interfere with the shopping center Mayor and City Council of Newport Beach Page Two September 5, 1962 or the use of the property. They offer to pay the City $25.00 per month per structure on a lease for a period of three years. The lease is cancellable in the event the property is sold or in the event the property is permanently improved. A check with the City Manager of Huntington Beach indicates that that City has no objection whatsoever to the erection of said signs. The signs will conform in all respects to the requirements of the City of Huntington Beach. We now have two water wells on this property and have no plans for the disposal of this property in the foreseeable future. CITY OF NEWPORT BEACH i OFFICE OF THE CITY MANAGER Cuu� 6� April 1961 N0: 60 -61 -26 TO: MAYOR AND CITY COUNCIL FROM: Robert Shelton, City Manager SUBJECT.: REPAIR VS REMOVAL OF BALBOA RESTROOMS, WEST BAY AT WASHINGTON The Council has previously indicated its tentative approval of removing the restrooms, fire station, and other.City buildings at the corner of West Bay and Washington following completion of the new Balboa fire station. A letter to the Council from the Balboa Improvement Association, dated March 22, requesting that the restrooms remain was referred to the City Manager for report. Councilman Somers, the City Manager, and the Park Superintendent have met at the site with President Dillman and others representing the Balboa Improvement Association. The Association argues that the large numbers of people who patronize the attractions in the Balboa area during vacation periods re- quire public restrooms in addition to those at the base of the Balboa Pier. Private toilets, intended only for employee use, cannot handle the demand. Until land uses change and buildings are replaced, there is no better solution to the problem than to maintain the present restrooms, according to the Association. It is assumed that this period_ would be at least three years. The City originally intended that the old restrooms be removed when the new were constructed at the foot of the Balboa Pier in 1955. At the urging of the Balboa Improvement Association, the old restrooms have been temporarily repaired and allowed to remain. Until recently, it was assumed that there was agreement that the old restrooms would be removed when the fire station is vacated and that the cleared area would be temporarily used for public parking. ` The staff has explored the alternative of requiring businesses in the area to provide more adequate restroom facilities, but finds no solid basis for doing so. It is estimated that the restrooms can be placed in a service- able condition for a total cost of $2,400, of which approximately $1,000 is City labor. The sealed bids shall be opened and publicly announced at a City Council meeting in the City Council Chamber at 7:30 P. M. on December 14, 1959. The Mayor shall conduct the auction and shall announce the amount of the highest sealed bid and the name of the bidder and shall then call for oral bids. Each person who has submitted a qualified sealed bid accompanied by a cash deposit or check as required may make oral bids on the land for which he has submitted a sealed bid. Before making an oral bid, any person who has not submitted a qualified sealed bid must submit a cash depositor certified or cashier's check equal to fifteen per cent (15%) of the highest sealed bid on the parcel on which such person wishes to bid. To be considered, the first oral bid must exceed the highest sealed bid by ten per cent (10%) of the amount of such high sealed bid. In conducting the sale, the City Council may waive informalities in bids and may by motion modify the terms of this resolution as deemed necessary to obtain the highest price for the property. Upon receiving the highest bid obtainable from a quali- fied bidder, the Mayor shall declare the property sold to the bidder making the bid subject to approval of the City Council; provided, however, that the City Council may continue the sale until the next regular meeting of the City Council. Section 4. Withdrawal from Sale. The City Council reserves the right to reject any and all bids or to withdraw the property or any portion thereof or any interest therein from sale at any time. 4. Section 5. Deed - Title Insurance - Internal Revenue Stamps. Upon completion of the sale and payment of the amount of the bid, the City will execute a grant deed to and furnish at its expense a standard owners policy of title insurance in the amount of the successful bid showing title vested in the party or parties designated by the successful bidder subject to taxes, assessments and similar burdens and to covenants, conditions, restrictions, reservations, rights, roadways, rights of way and easements, if any. The buyer shall pay for all recording costs and the cost of Internal Revenue stamps. Section 6. Inability to Convey. If the property cannot, legally be sold by the City or the City is unable to convey mar- ketable title within a reasonable time after the date of sale, the sale shall be void and deemed mutually cancelled, and any price paid or deposit made shall be refunded and no liability of the City shall exist or arise from such cancellation. Section 7. No Warranty. No warranty is made or intended by any statement in this resolution or the notice of sale or other- wise with respect to location, size, zone or utility of any prop- erty or interest therein which is sold or offered for sale. Section 8. Notice of Sale - Publication. The City Clerk shall prepare a notice of sale setting out the address or location, description, zone and approximate size of the parcel or parcels of property being offered for sale, the date, place and time the bids will be received and opened and the fict.that additional informa- tion may be obtained from the City Clerk's office. The notice shall be published once a week for three (3) successive weeks and copies of the notice and resolution shall be available in the City Clerk's office and mailed by the City Clerk upon request. Section 9. Commission. Payment of a maximum total com- mission of five per cent (5 %) of the sales price shall be paid to the real estate broker or brokers entitled thereto, if any, under the following conditions; (a) The property must be actually sold and the 5. sales price paid to the City. (b) Only licensed real estate brokers shall be eligible to be paid any commission. (c) A sealed bid upon which a commission is to be claimed shall so state and shall name the broker who has obtained the bid on behalf of the City and has thereby established eligibility for the commission or a share of it. (d) A person making a deposit of fifteen per cent (15%) by cash or check as permitted in Section 3 hereof may at the time of submitting such deposit name the broker who has obtained the bidder and has thereby established eligibility for the commission or a share of it. (e) The real estate broker, if any, named in the highest qualified sealed bid shall receive two and one- half per cent (2k%) of the amount of such bid as commission. It is recommended that the City Council grant permission to Boy Scout Troop 182 Committee to locate a donated building In Cliff Drive Park at a site to be designated by the Public Works Director. 3. It is recommended that the City Council approve in principle the conditions of acceptance and use of the proposed Boy Scout House as contained 16 the attached outline. DISCUSSION: The Troop Committee of Boy Scout Troop 182, representing the Newport Heights area, has been offered a frame building approximately 28' x 28' from Richardson's Yacht Anchorage. The Troop Committee proposes to locate the build- ing in Cliff Drive Park and to donate it to the City. Approval in principle of the Troop Committee's plans has previously been granted by the Parks,, Beaches, and Recreation Commission and the City Countil. .. The Parks, Beaches, and Recreation Commission has also recommmended to the Council that action be taken to install necessary drainage facilities in the Part: to permit its development. A topographic map of the area has been obtained. Engineering estimates relating to earth moving and construction required to install drainage facilities, locate the proposed Scout building, and provide necessary utility connections are being prepared. Site The so- called "Cliff Drive Park" includes a large area dedicated for street purposes. {,pile it is indefinite whether or not the City eventually will construct a street at this location, it is apparent that not all of the area set &aide for street purposes is necessary for such a street. The demand for meeting places for comounity groups of a recreationd.educational and social nature far exceeds tin supply of meeting places. Accordingly, there is apparent justification for the City to assume responsibility for management. upkeep and maintenance of the building. The Troop Committee spokesmen recognise the importance of the dual need for the building and are willing to donate it to the City with this understanding. If the Council accepts the above recommendations, the Troop Committee can proceed promptly with site preparation and moving of the building. While the enact cost to the City of utility installations and other improvements re- lated to the use of the Park, such as, off - street parking and facilities for recreation purposes have not been precisely estimated, it is believed that the cost will be small in relation to the benefit to the community in placing a much needed park into active use. It is expected that Scout groups will main- tain an active roll in helping to finance and accomplish the development of the Park. It is part of the Scout program to landscape part of the area in accordance with plans to be approved by the Parks. The building hag been inspected by the City Building Department and is considered acceptable Official acceptance by theCity can be accomplished by a Resolution of City Council establishing the conditions of acceptance and use. Such Resolution would state that the building is being made available to the City, through the efforts of Boy Scout Troop 182 Committee, for the dual purpose of providing a permanent meeting place for Boy Scout Troop 182 and Explorer Poet 182, and to provide a meeting place for other community groups of a recreational, social, or educational nature. Official acceptance of the building can occur when the installation is completed in accordance with understandings outlined below. INSTALLATION: The following 'steps are involved in the installation of the building: I. The City will install drainage facilities prior to the earth being moved for the building site. 2. The Public Works Director shall pin -point the site for the.building. 3. The Park Division shall clear the ground site preparatory to the heavy grad- ing to be done by the Boy Scout Troop Committee, in accordance with grading plans prepared by the Public Works Dept. 4. TheCommittee of Boy Scout Troop 182 shall be responsible for the entire moving and installation of the building to the site selected. The City shall also install the necessary sewer lines from the restroom facilities, and make arrangements for running the necessary electrical lines to the building. 6. The Committee of Boy Scout Troop 182 shall prepare a drawing showing all proposed developments, installations and landscaping in and around the building site. These proposals shall be presented to the Parks, Beaches and Recreation Commission for final approval. 7. The Troop Committee shall be responsible for any other items not noted herein which are directly connected with the complete installation of the building facility. This includes the final clean-up and removal of scrape and surplus materials when the installation is completed. 8. The building installation shall be completed and ready for use by July 1, 1958, and shall not be occupied until final inspections have been made by the City Building Department. C. OPERATION: The following is the recommended operational plan for the building: 1. This building shall be known•as the "Newport Heights Boy Scout House" and Boy Scout Troop 182 and Explorer Post 182 shall have first or "priority" use of the facility. Priority use, in this case, means that each of these units desiring to use the building as a regular meeting place may reserve the building for a definite day, and stated period of time, once each week. This reservation will be valid and may be retained as long as the group continues to actively use the facility during its specified time. Scout Troop 182 and Explorer Post 182 shall have the use of the wells of the building for the installation of banners, etc. connected with their troop activities, as long as such banners, etc. do not interfere with the general use of the building by other groups. 5. Each scout group shall be responsible for providing suitable lockers, or storage space, with locks attached for the purpose of storing any personal gear. No permanent -type installations or attachments to the building shall be made without the approval of the Parks, Beaches and Recreation Department. 6. At all other times the building shall be made available to other groups Who are eligible for use of public facilities under the adopted policy of the Parks, Beaches and Recreation Commission. T. At a regular meeting of the Parks, Beaches & Recreation Commission, held November 19, 1957, discussion was held pertaining to the propose move of a building on to the Cliff Drive Park area. Mr. John Boyd and Mr. Fred Singer, representing Boy Scout Troop 182, presented details of the plan and briefed the Commission on the great need for a building to house boy scouts in the Newport Heights area. A committee of four Commission members had inspected the building in question and the proposed site in the Cliff Drive Park area. This commnittee prepared a written report reconmending approval of the project, and also presented a list of suggestions dealing with problems of improvements, maintenance of the facilities, and control and use. Mr. Boyd expressed the opinion that most of the points mentioned in the committee report were completely agreeable to the boy scout group. However, there was some question regarding making the building available to other public groups when not in use by the boy scouts. The possibilr ity of granting the building to the boy scouts for exclusive use on a lease basis was discussed at great length. It was the consensus of opinion of all parties concerned that legal questions were involved which could not be answered by the Commission. If the proposal is accepted by City Council, it was felt that further technical details pertaining to use and moving of the building could be better worked out by the City Administration and representatives of the boy scouts. Gentlemen: At the regular meeting of the Board of Directors of the Balboa Peninsula Point Association, held on December 7th, the subject of leasing the former Harbor Department facilities at the Washington Street end, on the bay.front in Balboa, was discussed. The Board was informed that on May 14, 1952 the City Parke and Recreation Commission, is regular session, voted unanimously to send a letter to the City Council recommending that the City not lease or sell any public- owned waterfront property to any organization . On February 17, 1953 the City Parke and Recreation Commission, in regular session, re- affirmed their stand and by unanimous vote, again went on record as opposing the leasing or selling of any public -owned waterfront property to any organization, and the secretary was instructed to notity.the City Council of their action. The Officers and Board of Directors of the Balboa Peninsula Point Association, by unanimous vote at the December 7th meeting concurs in the action taken by the City Parke and Recreation Commission. It was the opinion of this body that the selling or leasing of any public -owned waterfront property was not in the best interest of the citizens of Newport Beach.
