My name is Tim Cleary, residing at 203 40th Street, the residence
I have rented for nine years which was
My rental agreement with the prior owner, Mr. Ted Fessenden, was
a rental amount of $225.00 per month not to be raised as long as
I lived there. In my initial conversation with Mr. Horst Hlawaty,
City Engineer, I was told the City's policy is not to raise the existing
rental rate on residences being taken over by the City.
I now find my rate increased from $225.00 to $400.00 per month.
I will pay this rate if forced to, but do not believe you are aware
of the change in policy and hopefully will reverse the rental
increase.

RECOMMENDATIONS:
Authorize the purchase of 202 34th Street (Lot 2, Block 133,
Lake Tract) at the appraised fair market value of $163,000.
2. Adopt a resolution accepting a grant deed from Loren J. Buist
and Karen J. Buist for 202 34th Street (Lot 2, Block 133, Lake
Tract).
DISCUSSION:
On November 14, 1977, the Council authorized the appraisal of 202
34th Street owned by Mr. and Mrs. Buist. The Buists had requested that the
City purchase their parcel for hardship reasons. Attached is a copy of the
letter from Ms. Hurd on behalf of the Buists.
Mr. Phillip S. Jackson, MAI, was retained to appraise 202 34th Street.
He concluded that the fair market value of the parcel was $163,000. This
amount has been offered to the Buists, subject to the approval of the purchase
by the City Council.
The structure on the parcel is a duplex with each unit having two
bedrooms and approximately 1,200 square feet. The Buists are presently living
in the upstairs unit and the downstairs unit is vacant. The Buists have lived
at 202 34th Street for over 180 days making them eligible for relocation bene-
fits when they move from the property.
Funds for the purchase of this parcel will come from the Gas Tax
Fund. $73,000 remains in Account Number 18- 3370 -009 which was budgeted for
the acquisition of right -of -way for street. widening projects. A budget amend-
ment has been prepared to provide for the following transfers and appropria-
tions to cover the remainder of the purchase price, fees, and relocation
assistance.

This concerns property located at 202 and 20235 34th St. Our problem
concerns the difficulty of sale due to the existance in the cities general
plan to widen Balboa Blvd. in the area of subject property.
The building has been on the market since May 29, 1977 and has had 3
bona fide offers on it. When the prospective buyers are informed about
the possible widening of Balboa they decide against purchasing, stating
that they do not want to have any complications with the city or any
possible litigation in the future.
The sellers feel at this time they are now in a desperate situation
because they have purchased another home which they plan to live in but
can not sell their duplex on 34th due to the cities proposal.
On approximately June 3, 1977, I spoke with Don Webb regarding the
property located on 34th to see if the city would purchase said property
Don told me at that time there was only $75,000.00 allocated for such a
purchase and that the city could not do so at that time. He explained
what the situation was with regards to the widening of Balboa and it
was precisely what the letter attached has to say.
At this time we would like to suggest to the city that the city purchase
this property at the price of $165,000.00 with a closing date of the 1st
of January so that an additional amount of money could be appropriated for
this land with next years budget. That the city pay for all costs in
connection with this.
We feel at this time there are damages and it has now turned to a hard-
ship case, since Mr. and Mrs. Buist have had to borrow additional money
from their credit union to maintain their position in the property due
to the inability to sell it at.a reasonable price.
We strongly urge your consideration in this matter with a timely
resolution before a foreclosure action is started by the 1st trust deed
holder.

This letter is being written in response to your inquiries
regarding the City's intent in regards to the acquisition
of the above referenced property.
The City has adopted a General Plan that show the widening
of Balboa Boulevard in the,vicinity of the subject property.
The City Council has never adopted a policy dealing with
the acquisition of property on the north side of Balboa
Boulevard for street widening purposes.
The City has, from time to time, on a case by case basis,
acquired properties on the north side of Balboa Boulevard
between 32nd Street and Coast Highway for the 'purposes of
widening Balboa Boulevard to its ultimate master plan width.
There is no capital improvement program or authorization for
acquisition of additional property along Balboa Boulevard
for the widening nor for the construction of the wider section
of Balboa Boulevard.
There is no present intent of the City to acquire the subject
property or any other property along Balboa Boulevard.
Presently, there are insufficient funds available to buy any
properties along Balboa Boulevard for any purpose.
Any acquisition of additional properties along the north side
of Balboa Boulevard, at best, contemplate-' in the distant

future, maybe five to ten years hence unless there is a major',
but unforeseen policy change on behalf of the City Council.
Should the subject property ever be acquired by the City of
Newport Beach, the City would follow the Uniform Real Property
Acquisition Act and the eminent domain law of California.
That would require the City to appraise the property at its
fair market value and offer the full appraised value to the
property owner once the Council had determined to acquire
the property. Should the price not be satisfactory to the
property owner, eminent domain proceedings could be commenced.
In addition, eligible parties would receive relocation
benefits as provided by law.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ACCEPTING A GRANT DEED FROM
LOREN J. BUIST AND KAREN J. BUIST IN CONNECTION
WITH ACQUISITION OF 202 34TH STREET, NEWPORT
BEACH
WHEREAS, there has been delivered to the City of
Newport Beach a certain Grant Deed dated November 28, 1977,
wherein Loren J. Buist and Karen J. Buist grant to the City
of Newport Beach the following described real property in
connection with acquisition of 202 34th Street, Newport Beach,
California:
Lot 2, in Block 133 of "Lake Tract, Newport Beach ",
in the City of Newport Beach, County of Orange,
State of California, as per map thereof recorded
in Book 4 Page 13 of Miscellaneous Maps, in the
Office of the County Recorder of said County.

WHEREAS, it is to the interest of the City to accept
said Grant Deed;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said Grant Deed is hereby
accepted and the City Clerk is authorized and directed to

consent to its recording and to cause said document to be
recorded in the Orange County Recorder's Office.

The Budget Committee met on Friday, January 13, to con-
sider the budget amendments necessary for the appropriation of
property at 202 34th Street.
The Committee decided that the sources of funds for the
appropriations were appropriate, but determined that the purchase
of the property should be a policy decision decided by the entire
City Council.

Authorize the staff to retain an appraiser to determine the fair
market value of 202 and 202, 34th Street.
DISCUSSION:
On October 25, 1977, Christine Hurd appeared before the Council as
the agent for Mr. and Mrs. Loren J. Buist and requested that the City pur-
chase 202 and 202 34th Street. She stated that the Buists were not able to
sell their property due to the City's potential widening of Balboa Boulevard.
Attached is a copy of the letter from Ms. Hurd on behalf of the Buists.
A proposal has been obtained from Philip Jackson, M.A.I. for the
appraisal.
He will perform the appraisal to determine the fair market value of
the parcel for $1,800 and will complete it within 60 days.
Mr. Jackson has provided appraisals for the City in the past and is
well qualified to perform the work.
Funds for the appraisal will come from the Gas Tax Fund account for
the "Acquisition of Right -of -Way for Street Widening Projects."
The attached sketch shows the location of 202 and 202; 34th Street
as well as the location of other City -owned parcels along Balboa Boulevard.

Acquisition Act and the eminent domain law of California.

DISCUSSION:
The City's project for the widening of Balboa Boulevard from
44th Street to Coast Highway included the reconstruction of the traffic
signal at Coast Highway. On October 24, 1972, the City executed an agree-
ment with the State which provided for the State to pay for one -half of
the signal improvements up to a maximum of $28,700, unless otherwise pro-
vided for by supplemental agreement. Due to several change orders requested
by the State, their final share was $30,821.30.
This supplemental agreement increases the authorized State share
to $30,821.30. The State has already paid the City $30,821.30, but re-
quested that this agreement be executed.to officially authorize the expen-
diture.

DISCUSSION:
On March 8, 1976, the Council authorized the appraisals of the
Collins parcel at 203 35th Street and the Chamberlain parcel at 200 44th
Street. On March 22, 1976, the Council authorized the appraisal of the
Sanford parcel at 3510 -20 Balboa Boulevard. The owners of each of these par-.
eels had requested that the City purchase their parcel for hardship reasons.
Copies of their letters are attached.
Mr. George H. Jones, MAI, was retained to appraise the three par-
cels. He concluded that the fair market value of each parcel was as follows:
Collins 203 35th Street $54,000
Sanford 3510 -20 Balboa Boulevard $56,500
Chamberlain 200 44th Street $66,000
This amount has been offered to and accepted by each owner, subject to the
approval of the purchase by the City Council. If Balboa Boulevard is widened
between 44th Street and 33rd Street, these parcels would have to be acquired.

In addition, the parcel at 20044th Street is adjacent to the abandoned oil
well recently reopened by the City. If the structure at 200 44th Street is
removed, future work on the well could be conducted without blockage of
Balboa Boulevard.
The structure at 203 35th Street is a one - bedroom, single family
residence constructed in 1929. The total living area is 720 square feet.
The unit is presently rented.
The structure at 3510 -20 Balboa Boulevard is a single - story duplex
constructed in 1949. Each unit has one bedroom with a total living area for
both units of 1140 square feet. Each unit is presently rented.
The structure at 200 44th Street is a duplex, with the ground level
unit in front and an above - the - garage unit in the rear. Each unit has one
bedroom, 598 square feet, and was constructed in 1958. The upstairs unit is
rented with the downstairs unit being used by the owner on weekends.
All of the tenants have lived in the units for over 90 days, thus
qualifying them for relocation assistance benefits if the City requires them
to move from the property. If the Council authorizes the purchase of this
property, the City would continue to rent to the tenants in the Collins and
Sanford units. The Chamberlain units on 44th Street would be demolished as
soon as the tenant could be relocated.
Funds for the purchase of these parcels will come from the budgeted
item in the Gas Tax Fund for acquiring right -of -way for street widening pur-
poses.

Authorize staff to retain an appraiser to determine the fair
market value of 3510 -20 West Balboa Boulevard.
DISCUSSION:
Attached are two letters from Mr. R Mrs. Donald S. Sanford
requesting that the City purchase his property at the northeast corner
of 36th Street and Balboa Boulevard. Mr. Sanford first requested that
the City purchase his property in July, 1975. Since that time he has been
actively trying to sell the property and has been unable to do so. He
states that due to poor health conditions he is unable to properly care
for and manage the property.
The parcel needs to be acquired if Balboa Boulevard is widened
between 44th Street and 32nd Street.
In a letter dated December 7, 1973, the West Newport Beach Improve-
ment Association took the following position:
"The West Newport Beach Improvement Association urges the com-
pletion of the Balboa Boulevard improvements from 44th Street
to Coast Highway (including Superior Avenue) as soon as possible.
The City should continue acquisition of Balboa Boulevard right -
of -way properties on a hardship basis from 44th to 32nd Street,
but delay final plans until the traffic impact of the 44th Street
to Coast Highway improvements is known."
The attached sketch shows Parcels along Balboa Boulevard which
have been acquired by the City, the subject parcel, and the two parcels
which the Council authorized to be appraised on March 8, 1976.
If this appraisal is authorized, it can be included with the two
previously authorized appraisals for an additional $750. This would come
from the budgeted Gas Tax Project for acquisition of right -of -way for street
widening purposes. Gas Tax Funds for the purchase of the properties could
be budgeted in the 1976 -77 budget.
The structure at 3510 -20 W. Balboa Boulevard is a tenant occupied
older duplex. If the City decides to purchase the property the tenants in
residence at the time the City makes its first offer may be eligible for re-
location assistance.

Boulevard has created a hardship for him.

that the City purchase her property at the northeasterly corner of 44th Street
and Balboa Boulevard. She has stated that the presence of the oil well and
the inconvenience it has caused has created a hardship. That and the fact
that Balboa Boulevard has been widened up to her front door has discouraged
anyone from purchasing her property.
The parcels need to be acquired if Balboa Boulevard is widened between
44th Street and 32nd Street.
In a letter dated December 7, 1973, the West Newport Beach Improvement
Association took the following position:
"The West Newport Beach Improvement Association urges the completion
of the Balboa Boulevard improvements from 44th Street to Coast Highway
(including Superior Avenue) as soon as possible. The City should con -
tinue acquisition of Balboa Boulevard right -of -way properties on a
hardship basis from 44th to 32nd Street, but delay final plans until
the traffic impact of the 44th Street to Coast Highway improvements is
known."
The attached sketch shows Parcels along Balboa Boulevard which have
been acquired by the City and the two parcels proposed for acquisition.
If an appraisal of the two properties is authorized, the appraisal fee
of approximately $2500 would be funded from the budgeted Gas Tax Project for
acquisition of right -of -way for street widening purposes. Gas Tax Funds for the
purchase of the properties could be budgeted in the 1976 -77 budget.

I understand that the city is eventually intending to widen Balboa Blvd which
borders my property. I have owned this property for 7 years. Approximately 5
years ago, I was told that it would be taken by the city for street - widening
purposes in the future. I have not improved this R -2 property because I ex-
pected that it would be purchased by the city as many other properties on both
sides of me have been.
At this time I must either improve or dispose of this property as it is im-
posing a great financial burden on me.
It would seem follish to me to build on this property and then demolish the
building in a few years. Also, the threat of possible future condemnation
raises a stales barrier against my chances of selling the property at fair
market value.
I formally request that the city of Newport Beach offer to purchase this pro-
perty because of the hardships forced on me as stated above.

RECOMMENDATIONS:
1. Authorize the purchase of 202 42nd Street for the appraised
fair market value of $90,000.
2. Adopt a resolution accepting a grant deed from Richard T. Grindle
for 202 42nd Street (Lot 2 and northwesterly 3.57' of Lot 1,
Block 141, Canal Section).
DISCUSSION:
On January 27, 1975, the Council authorized the staff to retain an
appraiser to determine the fair market value of the subject parcel. Attached
is a copy of a letter from Mr. Richard T. Grindle requesting that the parcel
be purchased by the City.
Mr. Philip S. Jackson, MAI was retained to appraise the parcel. He
concluded that the fair market value was $90,000. This amount has been offered
to and accepted by the owner, Richard T. Grindle, subject to the approval by
the City Council. If Balboa Boulevard is widened between 44th Street and
33rd Street, this parcel would have to be acquired.
The structure at 202 42nd Street is a two -story duplex constructed in
1969 with a total living area of 2430 square feet. The present tenants have
both rented the property for longer than 90 days. This would qualify them for
relocation assistance if the City requires them to move from the property. If
the Council authorizes the purchase of this property, the City would continue to
rent to the tenants at a fair rental rate until the disposition of the Balboa
Boulevard widening project is finally determined.
Funds for the purchase of this parcel will come from the budgeted item
in the Gas Tax Fund for acquiring right -of -way for street widening purposes.
Attached is a sketch showing the parcel location as well as parcels
presently owned by the City.

He concluded that the fair market value was $53,500. This amount has been
offered to and accepted by the owner, Francis J. Horvath.
If Balboa Boulevard is widened between 44th Street and 33rd Street
this parcel would have to be acquired. This property is the only commercial
parcel along Balboa Boulevard between 32nd Street and 46th Street. The parcel
is a legal non - conforming use in an area which is zoned R -2. In the future,
if it is determined that the parcel is not needed for street purposes, it can
be sold with the restriction that the parcel be used for residential purposes,
thus eliminating a non- conforming use.
In lieu of any relocation assistance payments for which Mr. Horvath
might be eligible, the staff has agreed to allow Mr. Horvath to continue to
rent the property on a month to month basis for at least one year. When
Mr. Horvath vacates the property the City would demolish the existing structures.
Funds for the purchase of this parcel will come from the budgeted
item in the Gas Tax Fund for acquiring right of way for street widening purposes.

DISCUSSION:
The attached sketch shows Parcel 13. This parcel is in the
sidewalk area of the recently completed Balboa Boulevard widening project.
The Hopson's have agreed to accept $400 for Parcel 13. Due to
the small size of this parcel an appraisal was not obtained. The square
foot price for Parcel 13 is approximately the same as the price paid by
the City for the purchase of 202 - 39th Street in July, 1974.
Funds for the purchase of this parcel will come 50% from the
Gas Tax Fund and 50% from County AHFP funds.

DISCUSSION:
On January 28, 1974 the Council authorized the staff to retain an
appraiser to determine the fair market value of the subject parcel. The
purchase of the parcel at this value was also authorized.
Mr. Richard A. Fuller, MAI was retained to appraise the subject
parcel. He concluded that the fair market value was $37,500. This amount
has been offered to and accepted by the owner, Helen Mauldin.
Mrs. Mauldin had requested that the City purchase this property
because she was unable to sell due to the impending widening of Balboa Boule-
vard. This was creating a hardship for her.
If Balboa Boulevard is widened between 44th Street and 33rd Street
this parcel would have to be acquired. The parcel has no structures on it.
Funds for the purchase of this parcel will come from the budgeted
Gas Tax Fund item for the acquisition of property for street widening purposes.

DISCUSSION:
Attached is a copy of a letter dated March 25, 1974 from
Mr. Francis J. Horvath requesting that the City purchase his property
at the southeasterly corner of 35th Street and Balboa Boulevard.
Mr. Horvath's property is the only commercial parcel along
Balboa Boulevard between 32nd Street and 46th Street. The parcel is a
legal non - conforming use in an area which is zoned R -2.
If sometime in the future Balboa Boulevard is widened through
this area, 3410 -20 would have to be purchased. If it is determined that
the parcel is not needed for street purposes, it can be sold with the
restriction that the parcel be used for residential purposes. In either
case, the purchase of the property at this time would eliminate a non-
conforming commercial use in a residential area.
If the appraisal is authorized, it will be funded from the bud-
geted item in the Gas Tax Fund for acquiring right -of -way for street
widening purposes. It is estimated that an appraisal will cost $1200 and
be completed by July 1, 1974. The purchase of the property would be an
eligible Gas Tax Fund expenditure.

RECOMMENDATIONS:
Remove subject item from Table.
2. Adopt a resolution stating that the City wishes to withdraw
the subject project from the Fiscal Year 1973 -74 AHFP.
DISCUSSION:
On October 9, 1973 the Council tabled the authorization to execute
the subject agreement until additional information on the widening of Balboa
Boulevard from 44th Street to 33rd Street could be presented.
At the November 26, 1973 Study Session a presentation was made. Also
a meeting was held with the Board of Directors of the West Newport Association.
In a letter dated December 7, 1973 the Association took the following position:
"The West.Newport Beach Improvement Association urges the comple-
tion of the Balboa Boulevard improvements from 44th to Coast
Highway (including Superior Avenue) as soon as possible. The City
should continue acquisition of Balboa Boulevard right of way prop-
erties on a hardship basis from 44th to 32nd Street, but delay
final plans until the traffic impact of the 44th to Coast Highway
improvements is known."
County AHFP funds cannot be used to acquire rights of way on a hardship
basis unless an environmental statement has been prepared and accepted by the City.
This procedure is not recommended at this time because the approval of an E.I.S.
would imply a commitment by the City to widen the portion of Balboa Boulevard
between 32nd Street and 44th Street.
If the Council desires to follow the recommendations of the West Newport
Beach Improvement Association, any further planning on this project should be post-
poned until after the improvements from 44th Street to Coast Highway have been
completed. AHFP policies require that the funds allocated to FY 1973 -74 projects
for right of way acquisition be spent prior to July 1, 1974.
With these limitations on the project, it is recommended that the City
request that Project No. 675 be withdrawn from the FY 1973 -4 AHFP. The County
can then reallocate the funds set aside for this project.

understand the present situation regarding the widening of Balboa
Blvd., the city will proceed with plans to widen a portion of the
street from Pacific Coast Hwy. to the vacinity of 40th Street. This
work is to begin within the next few weeks if my information is
correct.
It is my belief that the widening of such a narrow portion of
the entire street would be unwise. It seems that any advantage the
widening would bring as far as reducing congestion at the highway
light would be small since no plans are proceeding for the widening
of Coast Hwy. or Superior Ave. which will have to absorb the traffic
coming from this area of Newport.
I think that the plans for widening the street were proposed
and passed at a time when the problems of driving and parking in the
area were great and needed city action. But in today's situatioh
of reduced gas supplies, and at a time when people's driving, car
buying and recreational habits are in transition, I feel a reevaluation
of the entire matter is called for. I am sure that Newport is going
to remain a popular place to visit gnd to live, but there might be
alternate ways to solve the traffic problems without widening a street.
Parking in the residential sections of't'he city should be by
permit for residents, guests and business persons in the community.
The city should provide public parking facilities along the Coast
Hwy* on land which is now vacant. A mini ,bus transportation system
should be provided which would service the entire peninsula area.
Such a system dould reduce the total car traffic and parking problems
of the area and at the same time not reduce the people who could use
the beaches and shopping and commercial facilities of the city.
I am quite sure you will give serious consideration to the
above suggestions.

DISCUSSION:
Eight bids for Contract No. 1369 were received and opened in the
office of the City Clerk at 10:30 A.M. on February 12, 1974. Three of the
bids had irregularities relating to the addition of the bid items. The
corrected bid and incorrect bid submitted are shown below:
The low bid is 4.7% above the engineer's estimate of $250,000.00.
J. B. Crosby Co. was the apparent low bidder at the bid opening.
The total price bid was checked by adding the separate prices for the various
bid items and was found to be in error. Correction of the addition error in-
creased Crosby's total bid to $265,319.70 and made him the second low bidder.
The low bidder, Donn 0. Michaels, is well qualified and has satis-
factorily performed similar work for the City in the past. The most recent
contract completed by Michaels is the Lafdyette.Widening Project.
The subject project provides for the widening of Balboa Boulevard
from Coast Highway to 44th Street. It includes the construction of pavement,
sidewalk, curb and gutter, storm drains, the modification of the Coast Highway

The street lights will have pressure sodium vapor luminaires
instead of the normal mercury vapor luminaires. The sodium vapor luminaire
gives approximately the same illumination as the mercury vapor luminaire at
half the wattage of the mercury vapor. The street light wattage will be
150 W and the intersection light wattage will be 250 W. The sodium vapor
lights have an orange color and are being tried in an effort to conserve
energy.

DISCUSSION:
On October 9, 1973 the Council tabled the subject acquisition
until additional information on the widening of Balboa Boulevard from 44th
Street to 33rd Street could be presented.
At the November 26, 1973 study session a presentation was made.
Also, a meeting was held with the Board of Directors of the West Newport
Association. In a letter dated December 7, 1973 the Association took the
following position:
"The West Newport Beach Improvement Association urges the
completion of the Balboa Blvd. improvements from 44th to
Coast Highway (including Superior Avenue) as soon as
possible. The City should continue acquisition of Balboa
Boulevard right -of -way properties on a hardship basis from
44th to 32nd Street, but delay final plans until the traffic
impact of the 44th to Coast Highway improvements is known."
The structures at 202 - 39th Street have been removed and the
parcel is now vacant. The staff feels that this parcel should be acquired
as a right of way protection measure before a new structure can be con-
structed.
On September 15, 1973 the property owner requested that the
City purchase this parcel. Funds for this purchase will come from the
)Gas Tax Fund.

Contract 1369 to be opened Tuesday, February 12, 1974
at 10:30 a.m.
DISCUSSION:
The attached drawing shows the limits of widening for Balboa
Boulevard to be constructed under Contract 1369.
This project will widen Balboa Boulevard to a right -of -way width
of 90 feet and a curb to curb width of 74 feet. The improvements include
new asphalt paving, curbs, gutter and sidewalk, the installation of a traffic
signal at River Avenue, upgrading the traffic signal at Coast Highway and
the revision of the existing storm drain system. Superior Avenue will be
widened to accommodate four lanes at Coast Highway with a transition to two
lanes ending 600 feet easterly. A double left turn lane for eastbound Coast
Highway will be constructed. The estimated date of completion for the road-
way improvements is June 15, 1974. The traffic signal improvements should be
completed by July 15, 1974.
The plans were prepared by Williamson and Schmid, Civil Engineers.
The engineer's estimate for the construction of this project is
$284,500. The County AHFP and State Department of Transportation are con -
tributing to this project. The City share of the project will come from the
Gas Tax Fund. Following is a breakdown of the shares:

A Coastal Zone Permit is required for this project. The South Coast
Regional Coastal Zone Commission has scheduled a public hearing for the project
on January 21, 1974. If the Commission does not grant the City a permit, bidding
of the project can be cancelled and all bids received returned.
Before the County will authorize an agency to advertise for bids on
an AHFP project, the agency must certify that all necessary right of way has
been acquired or condemned and hold the County harmless from any liability which
may arise from the County's reliance on this certification. The attached right
of way map shows parcels which have been acquired for the project. On October 9,
1973 the Council adopted a resolution of condemnation on Parcel 1. After numerous
unsuccessful efforts to settle without court action the City Attorney filed a
court action on January 2, 1974 requesting an order of immediate possession (OIP).
When the OIP is granted all parcels needed for the widening will have been
acquired.

Adopt a resolution accepting a grant deed from Beeco, Ltd., for
Parcel 14 as shown on the Right of Way Map - Balboa Boulevard -
Coast Highway to 44th Street.
DISCUSSION:
Attached is a copy of the Balboa Boulevard right of way map
showing Parcel 14.
Parcel 14 is a three foot wide strip of land 63 to 76 feet long.
This parcel is needed to provide for maintenance parking of a City vehicle
while working.on the existing sewage pump station in the parkway. This
parcel is outside the Lido Sands fence and construction on the parcel will
not require relocation of the fence.
The value of Parcel 14 has been set at $1045. Beeco, Ltd. has
agreed to accept an offer in this amount. It was agreed that the City would
install a wind screen acceptable to the Lido Sands Community Association on
the interior of their fence adjacent to Balboa Boulevard.. The estimated
cost of the screen is $200. The widening of the sidewalk in this area will
require the removal of several bushes which screen the Lido Sands tennis
court.
Funds for this purchase will come from the monies budgeted in the
Gas Tax Fund for widening Balboa Boulevard. The County AHFP will contribute
50% of the purchase price.

On September 13, 1971, the City Council after reviewing a letter from the
'West Newport Beach Improvement Association instructed the staff "to look into the matter
and to come back with definite plans and recommendations for getting sidewalks constructed
on the south side of Balboa Boulevard between 38th and 47th Streets." A copy of the
letter from The West Newport Beach Improvement Association.is attached.
The present city policy (L -1) places the burden of initially installing concrete
sidewalks on the property owners. Because of the difficulties experienced by the city in
forcing sidewalk construction where there is limited benefit to adjoining property, a memo
was presented to the City Council on February 8, 1971 recommending some changes to the
policy to make it easier for sidewalks to be constructed in areas like Balboa Boulevard.
The Council did not approve the recommended changes. A copy of these recommendations is
also attached.
Balboa Boulevard widening between 44th Street and Coast Highway is presently
being designed with sidewalks to be constructed on both sides of the street. Construction
of this project should begin in a year.
If the city proceeds with its plan to widen Balboa Boulevard between 44th Street
and 33rd Street, it is estimated that actual construction would not take place until
sometime in 1976. In connection with this project the parkway widths would be increased and
sidewalks would be constructed on both sides of the streets. It may be necessary to adjust
street grades to provide adequate drainage in the area. Therefore, any sidewalks
constructed on the southerly side of Balboa at this time would probably require
reconstruction if the street is widened. All sidewalks on the northerly side would
require reconstruction if the widening occurs.
A drawing showing the areas along Balboa Boulevard where sidewalks do not exist
will be on display for the Council Study Session. There are 7 strips of walk 85 feet to
95 feet long adjacent to private property needed between 44th Street and 38th Street.
At 39th Street there is a 95 foot strip of walk needed on the northerly side of Balboa
Boulevard which is adjacent to city -owned property.

If the City desires to have all or part of the sidewalk constructed prior
to the widening of Balboa Boulevard, it is recommended that Chapter 27 of the 1911
Act be used to insure compliance with Policy N -1. It can be expected that the public
hearing procedure required by the provision of Chapter 27 will result in some
protest by the adjoining property owners who will be assessed for sidewalk construction.

RECOMMENDATION:
That the city adopt the attached policy for sidewalk construction.
` DISCUSSION:
The city annually receives a number of complaints regarding the need for
`sidewalks in areas where unusual hazards exist for the pedestrian. Once a city
receives a complaint of this type the following options are available:
1. Contact the adjoining property owner and ask his cooperation in
the construction of the sidewalk.
...2. Force sidewalk construction by use of special assessment district
proceedings..
If the sidewalk is of limited benefit to the adjoining property owner it
Is usually extremely difficult for the city to exercise either of the options.
To give the staff a more useful tool in handling these requests, the program
outlined in the policy is recommended.

of this policy.
