Subject: Quitclaim and resolution authorizing its execution
The attached quitclaim, if executed by the City, will release to
the owners of Lots 26, 40, and 41, in Tract No. 3138, the surface
easement acquired by the City at the time it was intended to
construct an open channel for the overflow from Cherry Lake.
Since that easement was acquired, the City has acquired other
easements and the flood control conduit and appurtenances have
been constructed in the other easements.
In connection with the eminent domain action entitled City of
Newport Beach v. Platt, et al, Mr. Platt requested that the
City release this surface easement if we have no further need
for it. It appears that we do not have such need and it is,
therefore, requested that the matter be submitted to the City
Council.
The attached resolution, if adopted by the City Council, will
authorize the execution of the quitclaim. If the resolution
is adopted, it is requested the quitclaim be executed and
transmitted to Mr. Platt.
