T0: Robert Shelton, City Manager FROM: Karl Lynn Davis, City Attorney x Date Mareh 11,1957 SUBJECT: City -owned property (2 lots) fronting on Bayside Drive between 18th and 19th Streets The City Council has asked the question, "Does the above property constitute water -front property ?" Many years ago, by a court decree, the line of mean high tide front- ing on the above property was designated as being the line now front- ing on and adjacent to Bayside Drive. These two lots have a width of 25' each and are located in approximately the middle of the block. Since this decree, conditions have changed and for years Bayside Drive has been established and used by the public immediately bayward of the property as it now exists. Bayside Drive is a sign - posted area as such and although the Public Works Director advises me this street has never been actually dedicated, it undoubtedly is an established street so posted by signs and used by the public for that purpose. The street is paved. Immediately bayward of the portion of the street used for the movement of traffic is a public parking area with parking meters installed. This area is also paved. Bayward of the parking area is a beach which has a width of at least 801. This beach is used and has been used for some time by the public. It is my information that all of the foregoing physical facts were in existence at the time of the adoption of the City Charter. I have; viewed these premises on two occasions; the first time with the Public Works Director. Section 1402 of the City Charter provides in the first paragraph thereof as follows: "Section 1402. Water- front Property. The City Council shall not sell or convey any water- front or beach property, excepting to the State or to the County for use as a public beach or park." It is my opinion that the above property is not water -front or beach property and that said property is available for sale by the City to private purchasers.
