The original and one copy of a demand from Tri -City Savings and Loan Association dated January 13, 1965, in connection with their escrow No. L-1397. 2. A resolution which, if adopted by the City Council, will authorize the execution of a beneficiary's demand and a request for reconveyance on a deed of trust and the placing of documents in escrow. 3. A memorandum to the City Council in connection with this matter. It is requested that this matter be placed on the agenda for consideration by the Council on January 25, 1965. Thereafter, if the resolution is adopted, the instructions therein should be followed, after which the matter will be closed upon payment to the City of the balance of the indebtedness. The original note was transmitted to the Finance Director on December 24, 1963, and the deed of trust and title insurance policy were forwarded to your office with our memorandum of January 10, 1964. Mr. Harry V. Anderson, one of the makers of the note, has asked that this matter be processed on January 26 or as soon as possible thereafter, as they are anxious to close the escrow promptly. Moore, at al, Parcel I authorized for sale by Resolution No. 5869. The pur- chasers elected to pay for the property in installments as pro- vided by said resolution, paying one-third of the $62,500 purchase price within thirty days after the sale was approved and giving the City an installment note in the amount of $41,666.67 and a deed of trust securing the same, both. dated December 26, 1963, providing for payment in annual in.st.allments of $13,888.89, with accrued interest on the unpaid balance at 6% per annum, commencing December 26, 1964. , The present unpaid principal balance of the indebtedness is $27,777.78. The makers of the note now desire to pay the indebtedness in full. and have opened an escrow with Tri -City Savings and Loan Associa- tion through which this will be done. The escrow holder has requested that a beneficiary's demand and the request for full reconveyance on the deed of trust be executed and that the City place those documents in the escrow, along with the note and the title insurance policy held by the City, for use when Tri -Cifiv holds for the City the amount required to make full payment of the principal and interest due under said note. A resolution has been prepared and transmitted to the City Clerk which, if adopted by the City Council, will authorize the execu- tion and transmittal of the various documents. Thereafter, upon receipt by the City of the balance of the indebtedness, the matter will be closed. S� Transmitted herewith is an installment note for the unpaid balance of $41,666.67 in favor of the City of Newport Beach. The note is dated December 26 1963, and is executed by Parry V. Anderson, Louise E. Anderson, Norman E. Moore, Phyllis A. Moore, and Harry G. Anderson. It provides for payment thereof in three annual install= -nts of $13,888.89, together with accrued interest at 6% per annum on the unpaid balance, payable on the 26th day of December beginning on December 26, 1964. The pur- chasers have also furnished the City, as security for said note, a deed of trust on the property showing the City of Newport Beach as beneficiary, which will be transmitted to the City Clerk following its recording.
