CALL TO ORDER—The meeting was called to order at 3:30 p.m. Staff Present: Patrick J.Alford, Zoning Administrator Gregg Ramirez, Senior Planner Makana Nova,Associate Planner Benjamin M. MINUTES of March 30, 2017 Action: Approved D. PUBLIC HEARING ITEMS ITEM NO. 1 Moiso Lot Line Adjustment No. LA2017-001 (PA2017-010) Site Location: 25 and 27 Inverness Lane Council District 5 Liz Westmoreland, Assistant Planner, provided a brief project description stating that the application is for a lot line adjustment of two contiguous lots at 25 and 27 Inverness Lane. The two lots are zoned as Low Density Residential Area 9 of the Planned Community PC8 Big Canyon. The project site consists of Lots 72 and 73 of Tract 7368. Each lot currently contains one single-family residence. However, prior to the recordation of the lot line adjustment, the structure at 25 inverness would be demolished or altered to comply with all applicable development standards. Ms. Westmoreland stated that the applicant requests to shift the existing side property line of 27 Inverness Lane approximately 13 feet to the west. This will reallocate approximately 1,358 square feet from 25 Inverness Lane (or Lot 72)to 27 Inverness Lane. The proposed lots would continue to meet the minimum site area requirement of the underlying zoning, as the two properties would still exceed 8,000 square feet. The number of parcels will remain unchanged as a result of the lot line adjustment and there will be no change in the density or intensity of development. Access to the site would not be altered. Therefore, Staff recommended approval of Lot Line Adjustment No. LA2017-001 and provided a resolution with findings and conditions. Applicant and owner, Anthony Moiso, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved Page 1 of 5 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 04/13/2017 ITEM NO.2 708 Heliotrope Avenue Condominiums Tentative Parcel Map No. NP2017-006 (PA2017-051) Site Location: 708 and 708'/: Heliotrope Avenue Council District 6 David Lee, Planning Technician, provided a brief project description stating that the proposed project site is zoned as two-unit residential. An existing duplex will be replaced with a new two-unit duplex. Mr. Lee stated that the tentative parcel map would allow for each unit to be sold separately as condominiums. There are no waivers of the subdivision development standards proposed, and staff recommended approval and provided a resolution with findings. Applicant Buzz Person stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 3 617 Narcissus Avenue Condominiums Tentative Parcel Map No. NP2017-005 (PA2017-049) Site Location: 617 and 617'/: Narcissus Avenue Council District 6 David Lee, Planning Technician, provided a brief project description stating that the proposed project site is zoned as two-unit residential. An existing duplex will be replaced with a new two-unit duplex. Mr. Lee stated that the tentative parcel map would allow for each unit to be sold separately as condominiums. Action: Approved ITEM NO. 4 503 Poinsettia Avenue Condominiums Tentative Parcel Map No. NP2017-004 (PA2017-050) Site Location: 503 and 503 Y: Poinsettia Avenue Council District 6 David Lee, Planning Technician, provided a brief project description stating that the proposed project site is zoned as two-unit residential. An existing duplex will be replaced with a new two-unit duplex. Mr. Lee stated that the tentative parcel map would allow for each unit to be sold separately as condominiums. There are no waivers of the subdivision development standards proposed, and staff recommended approval and provided a resolution with findings. Action: Approved Page 2 of 5 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 04/13/2017 ITEM NO. 5 3990 and 4000 Westerly Place Parking Modification Permit No. MD2017-003 (PA2017-037) Site Location: 3990 and 4000 Westerly Place Council District 3 Melinda Whelan, Assistant Planner, provided a brief project description stating that the request is for a modification permit to reduce the parking requirement from one space per 225 square feet of net floor area to one space per 250 square feet of net floor area. The request is associated with a remodel and improvements to the existing office buildings including the addition of elevators and a common exterior seating area. The property is located in the John Wayne Airport area and the existing development contains two office buildings and a shared parking lot in the Newport Place Planned Community (PC-11). The PC-11 regulations offer relief of the parking requirement with the approval of a modification permit. The existing parking is nonconforming with one space per 240 square feet of net public area. The existing parking has not proven detrimental and has been sufficient. The one space per 250 square feet of net public area is consistent with the standard Zoning Code required parking for general office. Staff recommended approval of Modification Permit No. MD2017-003 and provided a resolution with findings and conditions. Applicant Dickson Oi of Shlemmer Algaze Associates, on behalf of property owner Ted Bischak, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator asked if the applicant was aware of what the parking rate was at the time of original construction. Mr. Oi responded that to his knowledge it has always been 199 spaces. In response to clarification requested by the Zoning Administrator, the applicant confirmed that the existing parking is adequate for the two office buildings and historically there have been no issues with parking. The Zoning Administrator added that it appears the project was originally built consistent with city-wide standard office parking requirements, possibly before PC-11 was adopted. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. Action: Approved ITEM NO. 6 Sharp Residence Coastal Development Permit No. CD2017-001 (PA2017-016) Site Location: 5223 River Avenue Council District 1 Gregg Ramirez, Senior Planner, provided a brief project description stating that the request is for a coastal development permit (CDP). The request includes approval for the demolition of an existing duplex and construction of a new single-family residence that is designed to comply with all applicable development standards. He further indicated that staff's recommendation of approval was based on compliance with all applicable development standards and that the project would not have an adverse affect on coastal resources, public views or coastal access. Applicant Phil Edmondson of Pacific Coast Architects, on behalf of the property owners, the Sharps, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. One member of the public, Philip Mladinich, spoke and asked about the City's CDP and appeal process. He owns the property next door and was concerned about hazardous materials during demolition and inquired about the timeline for demolition and construction.Zoning Administrator Alford explained that the City recently received permitting authority for CDP's and this would be the first CDP issued. Staff indicated that proper handling of hazardous materials typically found during the demolition of old homes is the responsibility of a licensed contractor, is monitored by the City and subject to standard requirements. There were no other public comments. Action: Approved Page 3 of 5 NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 04/13/2017 ITEM NO.7 30 Harbor Island Coastal Development Permit No. CD2017-006 (PA2017-020) Site Location: 30 Harbor Island Council District 5 Makana Nova, Associate Planner, provided a brief project description stating that the application is for the demolition of an existing single-family residence. The property is located on Harbor Island, a private island, which was determined by the State in 1984 to be inaccessible to the public and not suitable for public trust uses. The applicant had prepared a Construction Pollution Prevention Plan to address run-off during the demolition process. Staff was suggesting the addition of five conditions of approval to more specifically address the requirements for run-off. These conditions identify that demolition and construction materials should not impact environmentally sensitive habitat or receiving waters, that Best Management Practices and Good Housekeeping Practices would be adhered to, hazardous materials would be handled appropriately, debris would be stockpiled appropriately on-site during demolition, and trash and debris would be disposed of appropriately. Finally, Ms. Nova noted that staff had received one public comment letter noting their support for the proposed project. Applicant John F. Biggs, representing the property owner, stated that he had reviewed the draft resolution and conditions of approval including the additional suggested conditions and agrees with them. He thanked the City and staff for facilitating the processing of Coastal Development Permits. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. The Zoning Administrator chose to adopt the five additional conditions as suggested by staff. Action: Approved ITEM NO. 8 North Newport Center Planned Community Development Agreement Annual Review No. DA2007-002 (PA2009-023) Site Location: Block 100, 400, 500, 600 and 800 of Newport Center Drive and San Joaquin Plaza Council District 5 Benjamin M. Zdeba, Associate Planner, provided a brief project description stating that the North Newport Center Planned Community area did not have any major projects for the year 2016, and noted there were 12 tenant improvement projects that did not result in any gross floor area changes. The Zoning Administrator inquired about any remaining public benefit obligations. Shawna Schaffner of CAA Planning, Inc., on behalf of Irvine Company, stated most of the obligations had already been completed in prior years, as shown in the Annual Report. She noted there are only a few remaining obligations. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment the public hearing was closed. The Zoning Administrator found Irvine Company in good faith and compliance with the North Newport Center Zoning Implementation and Public Benefit Agreement for the year 2016. Action: Receive and File North Newport Center Implementation and Public Benefit Agreement Annual Report Year 2016 (January 2016-December 2016) E. PUBLIC COMMENTS ON NON-AGENDA ITEMS None.
