Alford, Zoning Administrator The Zoning Administrator meeting is subject to the Ralph M. Brown Act. Among other things, the Brown Act requires that the Zoning Administrator agenda be posted at least seventy-two (72) hours in advance of each regular meeting and that the public be allowed to comment on agenda items before the Zoning Administrator and items not on the agenda but are within the subject matter jurisdiction of the Zoning Administrator. The Chair may limit public comments to a reasonable amount of time, generally three(3)minutes per person. The City of Newport Beach's goal is to comply with the Americans with Disabilities Act (ADA) in all respects. If, as an attendee or a participant at this meeting, you will need special assistance beyond what is normally provided, we will attempt to accommodate you in every reasonable manner. NOTICE REGARDING PRESENTATIONS REQUIRING USE OF CITY EQUIPMENT Any presentation requiring the use of the City of Newport Beach's equipment must be submitted to the Community Development Department 24 hours prior to the scheduled meeting. If in the future, you wish to challenge in court any of the matters on this agenda for which a public hearing is to be conducted, you may be limited to raising only those issues which you (or someone else) raised orally at the public hearing or in written correspondence received by the City at or before the hearing. PUBLIC HEARING ITEMS 1. 109 Onyx Avenue Tentative Parcel Map No. NP2017-010 and Coastal Development Permit No. CD2017-023 (PA2017-057) Site Location: 109 Onyx Avenue Project Summary A Tentative Parcel Map and associated Coastal Development Permit to subdivide an existing 60-foot wide property which consists of one underlying 40-foot wide lot and a 20-foot wide portion of an adjoining underlying lot into two 30-foot wide lots. Two detached homes are currently under construction, one on each proposed lot. The new lots would not meet the minimum lot width requirement set forth in Title Zoning Administrator Meeting June 29, 2017 Page 2 20 (Zoning) for new subdivisions; however, the proposed lot area complies with the RB-1 Zoning District minimum. CEQA Compliance The project is categorically exempt under Section 15315, of the State CEQA (California Environmental Quality Act) Guidelines - Class 15 (Minor Land Divisions). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15315, Class 15 (Minor Land Divisions) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Tentative Parcel Map No. NP2017-010 and Coastal Development Permit No. CD2017-023. 2. Lumpkin Residence Coastal Development Permit No. CD2017-017 (PA2017-042) Site Location: 1519 E. Bay Avenue Project Summary A Coastal Development Permit to demolish a 2-story single-family residence and 2-car garage and construct a new 4,069-square-foot, 3-story, single-family residence with attached 692-square-foot 3-car garage. The design includes hardscape, drainage, and 62 square feet of landscaping. The project complies with all applicable development standards and no deviations are requested. CEQA Compliance The project is categorically exempt under Section 15303, of the State CEQA (California Environmental Quality Act) Guidelines - Class 3 (New Construction or Conversion of Small Structures). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Coastal Development Permit No. CD2017-017. 3. Balboa Pharmacy Sign Replacement Modification Permit No. MD2017-004 (PA2017-104) Site Location: 716 East Balboa Boulevard Zoning Administrator Meeting June 29, 2017 Page 3 Project Summary A modification permit to allow deviations from the maximum area and projection distance over the public sidewalk allowed for a projecting sign, and to permit a sign above the roof parapet. The proposed sign would replace the nonconforming projecting sign for the Balboa Pharmacy, which was involuntarily damaged earlier this year. CEQA Compliance The project is categorically exempt under Section 15311, of the State CEQA (California Environmental Quality Act) Guidelines - Class 11 (Accessory Structures). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15311 under Class 11 (Accessory Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Draft Zoning Administrator Resolution No. _approving Modification Permit No. MD2017-004. 4. Tower 48 Deli Minor Use Permit No. UP2017-010 (PA2017-084) Site Location: 4525 W. Coast Highway, Unit A Project Summary A minor use permit to allow a sandwich shop (Take-out service, limited) to operate in an existing 725-square-foot, ground floor commercial tenant space of a shopping plaza. The project includes tenant improvements to create a preparation area, front counter, and customer waiting area. The proposed hours of operation are from 8:00 a.m. to 10:00 p.m. No late hours (after 11:00 p.m.) or alcohol sales are proposed as part of this application. CEQA Compliance The project is categorically exempt under Section 15301, of the State CEQA (California Environmental Quality Act) Guidelines - Class 1 (Existing Facilities). Recommended Action 1. Conduct a public hearing; 2. Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15303 under Class 3 (New Construction or Conversion of Small Structures) of the CEQA Guidelines, because it has no potential to have a significant effect on the environment; and 3. Adopt Zoning Administrator Resolution No. _approving Minor Use Permit No. UP2017-010. Zoning Administrator Meeting June 29, 2017 Page 4 V. PUBLIC COMMENTS ON NON-AGENDA ITEMS Public comments are invited on agenda and non-agenda items generally considered to be within the subject matter jurisdiction of the Zoning Administrator. Speakers must limit comments to three (3) minutes. Before speaking, we invite, but do not require, you to state your name for the record. The Zoning Administrator has the discretion to extend or shorten the speakers' time limit on agenda or non-agenda items, provided the time limit adjustment is applied equally to all speakers.
