HomeMy WebLinkAbout2017-12 - Temporarily Allowing A-Frame Signs in Lido Marina VillageORDINANCE NO. 2017-12 AN INTERIM ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, TEMPORARILY ALLOWING A -FRAME SIGNS IN LIDO MARINA VILLAGE WHEREAS, A -frame signs are prohibited in the City of Newport Beach ("City") pursuant to Newport Beach Municipal Code ("NBMC") Section 20.42.050(F)(1); WHEREAS, on October 28, 2014, the City Council adopted Ordinance No. 2014- 17, which amended the NBMC to allow A -frame signs in the Corona del Mar commercial zoning districts effective November 27, 2014; WHEREAS, Lido Marina Village business owners, particularly those located off the main walkway, have requested the ability to use A -frame signs as currently permitted in Corona del Mar; WHEREAS, following the completion of Lido Marina Village's extensive renovation efforts, A -frame signs may be suitable for its mixed-use, water -related ("MU -W2") zoning districts; WHEREAS, subject to the regulations of the NBMC, A -frame signs provide businesses an opportunity for identification while guarding against the excessive and confusing proliferation of signs; and WHEREAS, it is appropriate to temporarily allow A -frame signs in Lido Marina Village's MU -W2 zoning districts for a period of one (1) year to evaluate and determine if such signs are suitable for the area. NOW THEREFORE, the City Council of the City of Newport Beach ordains as follows: Section 1: The prohibition on A -frame signs is suspended in Lido Marina Village's MU -W2 zoning districts, as depicted in NBMC Section 20.80.010 (A-5), for a period of one (1) year commencing September 8, 2017 and ending September 8, 2018. Section 2: All A -frame signs permitted under this ordinance shall be subject to NBMC Subsection 20.42.090(G). Section 3: The Community Development Director shall monitor the use of A -frame signs in the Lido Marina Village's MU -W2 zoning districts during the one (1) year trial period and shall report back to the City Council regarding the use of A -frame signs prior to the expiration of this ordinance. Ordinance No. 2017-12 Page 2 of 3 Section 4: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5: The City Council finds the introduction and adoption of this ordinance is categorically exempt under Section 15311, of the State California Environmental Quality Act (CEQA) Guidelines — Class 11 (Accessory Structures), which exempts the construction or placement of minor structures accessory to (appurtenant to) existing commercial, industrial, or institutional facilities, including on -premise signs. Section 6: This ordinance shall become effective thirty (30) days after the date of its adoption and shall remain in effect until September 8, 2018, unless earlier terminated, repealed, or extended by ordinance of the City Council. Section 7: Except as expressly modified in this ordinance, all other Sections, Subsections, terms, clauses and phrases set forth in the NBMC shall remain unchanged and shall be in full force and effect. Section 8: The Mayor shall sign and the City Clerk shall attest to the passage of this ordinance. The City Clerk shall cause this ordinance, or a summary thereof, to be published pursuant to City Charter Section 414.
