Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Fong Tse, Assistant City Engineer ftse@newportbeachca.gov PHONE: 949-644-3321 TITLE: Balboa Ocean Pier Pile Repairs Project — Notice of Completion for Contract No. 8188-2 (171-103) ABSTRACT: On May 9, 2017, the City Council approved additional work and contingency to be added to the Balboa Ocean Pier Pile Repairs Project (Contract No. 8188-2) with John S. Meek Company (Meek). The Work is now complete and staff requests City Council project acceptance and contract close out. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project. On May 9, 2017, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities); b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of the Civil Code; and c) Release the Faithful Performance Bond one (1) year after acceptance by the City Council. FUNDING REQUIREMENTS: Funds for the construction contract were expensed from the following account: Account Description Tidelands Maintenance Account Number 10001-980000-171-103 Amount $163,965.00 Total: $163,965.00 8-1 Balboa Ocean Pier Pile Repairs Project — Notice of Completion for Contract No. 8188-2 (17H03) September 26, 2017 Page 2 DISCUSSION: The City's bi-annual ocean piers inspection late last year identified a number of pier pilings that needed repairs ahead of the scheduled maintenance project. Accordingly, staff prepared the contract documents to make timely repairs to the Balboa Pier damaged piles as well as to install a new pile to replace a piling that broke off last Fall. After a competitive bid opening, the City Manager approved Meek's $111,300.00 base bid plus an $8,700.00 contingency amount to cover the cost of unforeseen work, for a total contract amount of $120,000.00. While the contract documents for the original contract were being processed, the February 14th/15th Winter storms destroyed the below -deck timber pile bracings and the maintenance access system (stairs, gangways and catwalks) used for inspecting and servicing the utilities systems under Ruby's restaurant. Being that these support items need to be restored at the earliest opportunity, staff requested and received acceptable pricing from Meek to make these repairs in addition to the originally contracted work. The City Council, on May 9, 2017, approved an extra work and contingency addition to Meek's original $113,000.00, bringing the amended contract to $151,165.00 plus a $15,000.00 contingency. A summary of this contract's construction cost is as follows: Original Bid Amount: Contract Increase Approved by City Council: Total Change Orders: Final Contract Cost: $111,300.00 $ 39,865.00 $ 12,800.00 $163,965.00 8-2 Balboa Ocean Pier Pile Repairs Project — Notice of Completion for Contract No. 8188-2 (17H03) September 26, 2017 Page 3 During the work, Meek and City inspection staff conducted a supplemental inspection of the pier's support structures from the entrance plaza (Bent No. 1) to the piles just north of the Ruby's restaurant (Bent No. 43) to see whether or not there were other issues or storm damage that needed to be addressed. During this supplemental inspection it was discovered that the pile cross bracings at Bent Nos. 24 and 32 had several moderate to severely cracked timber members and the survivability of their timber/pile connections were questionable. Since Meek was on-site and already ordering the special materials to rebuild the access system, a change order was issued to include and make the timber cross -bracing repairs at $15,600.00. A second change order was issued to credit the City (-$2,800) for the cost of replacing a palm tree that was damaged by Meek at the Balboa Pier "Entrance Plaza." Although a summary of the project schedule milestones is not available, as this project was unscheduled work, Meek completed all of the work within the contract scope and sooner than anticipated. ENVIRONMENTAL REVIEW: The work consists of making repairs to an existing facility. As such, Staff recommends the City Council find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
