Zdeba, AICP, Associate Planner PHONE: 949-644-3253 TITLE: Resolution Amending the Term of the Balboa Village Advisory Committee (BVAC) ABSTRACT - The Balboa Village Advisory Committee (BVAC) is scheduled to sunset December 31, 2018. There is a desire to extend BVAC for an additional two years to continue efforts outlined in the Balboa Village Master Plan Implementation Plan (Implementation Plan) and make recommendations to City Council for the allocation of funding from the Balboa Village Area Benefit District (Parking Benefit District). RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No. 2018-80, A Resolution of the City Council of the City of Newport Beach, California, Amending the Term of the Balboa Village Advisory Committee. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The BVAC has met regularly since December 2012, and has made significant progress in helping to implement the strategies contained in the Implementation Plan. However, there is more to be accomplished with projects currently in process, as outlined in Attachment A. BVAC is the sole entity responsible for providing recommendations to the City Council regarding funding for Balboa Village projects derived from the Parking Benefit District and other sources. RIM Resolution Amending the Term of the Balboa Village Advisory Committee (BVAC) November 27, 2018 Page 2 The BVAC reviewed the description of their terms and responsibilities and requests that the term be extended to December 31, 2020. The amendments are contained in Exhibit "A" of the draft resolution (Attachment B) and shown with tracked changes in Attachment C. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). Attachment B Draft Resolution RIM RESOLUTION NO. 2018-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, AMENDING THE TERM OF THE BALBOA VILLAGE ADVISORY COMMITTEE WHEREAS, on September 25, 2012, the City Council adopted Resolution No. 2012- 85 creating the Balboa Village Advisory Committee ("Committee") to oversee the timely implementation of recommendations provided in the Balboa Village Master Plan ("Master Plan"); WHEREAS, on July 9, 2013, the City Council adopted Resolution No. 2013-58 amending the membership of the Committee; WHEREAS, the Committee is made up of seven (7) members consisting of two (2) City Council members, one of which shall represent District 1, one (1) Balboa Village Business Merchants Association Board Member, one (1) representative of OceanQuest, one (1) representative of the Balboa Peninsula Point Homeowners Association, one (1) representative of the Central Newport Beach Community Association, and one (1) at large member; WHEREAS, in 2014, the City Council established the Balboa Village Area Benefit District (also referred to as the "Parking Benefit District"), which receives revenue from parking fees for the purposes of enhancing or supplementing services in Balboa Village; WHEREAS, the Committee's responsibilities include providing recommendations to the City Council regarding allocation of funding from the Parking Benefit District; WHEREAS, on April 12, 2016, the City Council adopted Resolution No. 2016-50 amending the responsibilities of the Committee, including that the Committee is the sole entity responsible for providing recommendations to the City Council regarding funding for Balboa Village projects derived from the Parking Benefit District and other sources, and extending the term of the Committee to December 31, 2018; WHEREAS, the Committee has overseen the successful implementation of several recommendations of the Master Plan; however, continued guidance from the Committee and public involvement is needed to complete this effort; and WHEREAS, by this resolution, the City Council intends to extend the term of the Committee to December 31, 2020. NOW THEREFORE, The City Council of the City of Newport Beach resolves as follows - IR Resolution No. 2018-80 Page 2 of 2 Section 1. Extend the term of the Committee to December 31, 2020. Section 2. The City Council approves the revised description of the Committee, which is attached as "Exhibit A," and incorporated herein by reference. Section 3. The recitals provided above are true and correct and incorporated into the operative part of this resolution. Section 4. If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 5. The City Council finds the adoption of this resolution and the amendment of the Committee is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
