I have worked as a design professional on many projects over the last 40 years in Newport Beach. I also have owned a home in town for the last 30 years. At the urging of many of my neighbors and clients that reside on Peninsula Point, I have been actively attending the community workshops that the Planning department was sponsoring to evaluate the current massing problems we are experiencing. The proliferation of the third story mass has adversely affected the character and value of many properties including my own. It has taken away natural wind patterns thus necessitating the need for more Air conditioning in the Summer. It has blocked much needed sunlight which has increased the need for more heat in the Winter. And, most importantly, it has virtually eliminated the character that brought most residents to our neighborhoods in the first place. Furthermore, I have personally been hired to design mitigation additions to bring back privacy lost from neighbors' third story structures looming over a given property. This domino effect is clearly counter productive towards maintaining an overall scale in our neighborhoods. As a designer, I am all too familiar with the nuanced wording of the third story guidelines. The third story rule was intended to reduce some of the mass by requiring it to be 15' from the front and rear setbacks. However, the error was that it did not specify covered patios. Clearly, this was an oversight because the advent of these roofs over patios did nothing to reduce mass and help to maintain neighbors' natural light and wind patterns. Moreover, many of these approved covered roofs were then closed in and illegally converted into living space. This is why I have argued about the absurdity of the third story guidelines for years. The real issue isn't actually square footage, it is massing. My argument from day one was to create a massing envelope for each property thus ensuring that each neighbor can retain some meaningful amount of sunlight and air circulation. During the workshops and behind closed doors I argued and lobbied for this effectively hoping for a maximum perimeter height of 22' with all four sides increasing at a 45 degree angle until the maximum height of 29' was reached. No square footage limitation within that envelope. Simple! Easy to administer and a huge boost to preserving light, wind, and character. Sadly that is not what is being proposed. Regardless, what the Planning Staff is proposing is a compromise solution based on many public meetings based on lots of input. The proposal to eliminate covered patios within the first 15' of the rear and front setbacks along with counting all covered areas as square footage will provide meaningful relief to our neighborhoods. We are not proposing a reduction in allowable square footage on a lot. That hasn't changed. Therefore we haven't reduced the value of such properties. Rather, we are inching towards preserving the value of the existing properties. Myself along with many of my neighbors strongly urge you to approve this amendment as an initial step towards preserving our neighborhoods.. This item was presented at numerous public workshops, an outreach into neighborhoods, has been brought back to the City Council as a workshop and update item, then two public hearings at the Planning Commission and approval by the Commission. The staff has designed code changes to new homes to allow them to better fit into existing communities and still maintain their development rights, square footage and the continued enjoyment of third story outdoor areas. As the Balboa Island Improvement Association Local Government Liaison, I have done my job to insure as many residents of Balboa Island as possible are aware of this initiative. General Meetings with our residents and ourl,000+ database of Constant Contact emails were used. I promoted City workshops with residents and the General Meetings last year held at the Balboa Island Fire Station included updates. Nextdoor Balboa Island has over 1,000 members and the BIIA constant contact also over 1,000 emails. To summarize the position of Balboa Island, we support the staff recommendations. Balboa Island Improvement Association (BIIA), Balboa Island Preservation Association (BIPA) and the Little Balboa Island Home Owners Association (LBIHOA) all agree. Four past Presidents of the BIIA support these changes along with the current Board of Directors of the BIIA. In the last two Constant Contact emails to residents, I encouraged those that support and oppose the changes to voice their opinions. I hope the City Council recognizes the importance of fixing the 2010 code revisions that are having a negative impact on our community. I have attached two photos to illustrate the impact the current development code is having on the Island. The house in the picture meets current code and is photographed with its neighbor of 75+ years, an original cottage. The rear of the cottage a second story over the garage dwarfed by the new home. The Little Balboa Island Property Owners' Association recently solicited opinions and took a poll of our constituents through Constant Contact on the proposed setback requirements. We did not attempt to steer their vote or decision and provided the City's link for further information. Eighty-one percent (81%) of the respondents were in favor of the proposed setback requirements. Of the various associations on Balboa island, please note that we are also the only association that is a Property Owners' Association. We also wanted to make you aware that the Little Balboa Island Property Owners' Association Board unanimously voted in favor of the proposed setback requirements and that is our official position. If this does not work for all of Newport, the residents of Balboa Island seem overwhelmingly in favor and request this be put in place at least for Balboa Island properties. The 3 story homes that have become common as of late are monstrosities and really need to be kept off Balboa Island. The charm these residential developments take away from the island is remarkable. Please close the loopholes in the residential design developments and don't allow for these huge homes to be built. The committee consisted of architects, developers and ordinary citizens. We developed a formula that preserved the beach cottage atmosphere while allowing for variations in design. This worked for many years. Then a few years ago (as I was told by Diane Dixon), the rules were re -interpreted. All of a sudden we are getting three-story houses being built on 30 foot lots. The Peninsula Point is beginning to look like a housing tract where all the new houses are three stories, white, with a balcony on the second floor and a roof deck on top. And only a tiny paved outdoor living space in front. The unlucky neighbors nest door get their light and air cut off. Please approve these amendments concerning three- story houses. Dear Council Members, my apologies, I am unable to attend the City Council hearing today, but I have reviewed the revisions to the standards developed 10 years ago and have comments. 1. The standards were vetted very thoroughly 10 years ago, why do we keep revisiting them? 2. The height of the third level decks and enclosed areas have no impact to the pedestrians on the streets below 3. The downzoning of the 30'and 25' wide lots, by limiting their covered third floor area will not reduce the density at the ground level. 4. The 30' and 25' lots need every opportunity to create as much livable enclosed space as is possible 5. Tall shed roofs from the second floors can have the same impact up to the 29' height limit 6. The calculation of the Gross Floor area should not be altered. I believe the changes will have very little impact to the street scape with the exception to the homeowners that have these smaller lots. Land values in Newport Beach are such that every inch of enclosed space is a benefit to the residents that own these lots. Please vote NO to the revisions suggested by staff. In just two years their number grew from 3 to 19. That's a huge percentage for a secluded and private community such as ours. This happened with no notice and no study of environmental impacts on our community. For the last few months after numerous meetings we and the Council have agreed to the terms and conditions you see before you. We pray that you will agree as well to the conditions put forward by these amendments. You may expect disagreements from various vested commercial interests. Many of those contesting us are not residents and are corporations who look out for their balance sheets and not families who live here and love our homes.
