Sinacori, Assistant City Engineer, <br /> <br />PHONE: 949-644-3342 <br />TITLE: Resolution No. 2021-12: Request for Petition Certification and <br />Funding for Proposed Underground Assessment District No. 124 <br />(Central Balboa Island) and Approval of Professional Services <br />Agreement for Assessment Engineering <br />ABSTRACT: <br />Residents within a roughly 50 -block area of central Balboa Island have submitted a <br />petition to the City of Newport Beach (City) that was signed by at least 60 percent of the <br />affected property owners requesting formation of Underground Utility Assessment District <br />Number 124. The next step in the assessment district process would be for the City to <br />advance funds to retain an Assessment Engineer to prepare an Engineer's Report and to <br />circulate ballots for a property owner vote on a proposed assessment. Staff would assist <br />the process by developing and soliciting a property owner vote in the coming months to <br />be based on a conservative cost estimate developed at the completion of the schematic <br />level design. <br />RECOMMENDATION: <br />a) Staff recommends the City Council find this project exempt from the California <br />Environmental Quality Act (CEQA) pursuant to Section 15302(d) (conversion of <br />overhead electric utility distribution system facilities to underground including <br />connection to existing overhead electric utility distribution lines where the surface is <br />restored to the condition existing prior to the undergrounding); <br />b) Adopt Resolution No. 2021-12, A Resolution of the City Council of the City of Newport <br />Beach, California, Accepting Petition of Assessment District No. 124; <br />c) Approve Budget Amendment No. 21-031 to advance and appropriate $135,000 from <br />General Fund and increase expenditures in Account No. 67502-941006 <br />(AD Assessment Engineering); and <br />d) Approve Professional Services Agreement with NV5, Inc. of Irvine, CA for a <br />not -to -exceed fee of $135,000.00 for Assessment Engineering Services. <br />6-1 <br />
