THE PLAYING OF CERTAIN] GAMES AND PERMITTING CER- TAIN GAMES TO BE PLAYED IN THE CITY OF NEWPORT BEACH TO BE A MISDEMEANOR. PRE -. SCRIBING A PENALTY THERE-I FOR, AND REPEALING ORDI -. NANCE NO. 76 OF SAID CITY. The Board of Trustees of the City of Newport Beach do ordain as fol- lows: - Section 1. It is hereby declared to be a misdemeanor and is Prohibited, for any person or Persons within the! corporate limits of the city of New.! port Beach to deal. play. conduct. carry on, engage in. or open any game dealt. played, conducted or carried on w4th cards. dice, or any other article or device for money. or at which game: a.ny money or chips. checks, or any other thing or object representing money or intended or expected to be redeemed in or by money, is lent, wagered. hazarded. won, or lost. Any person found guilty of a violation of this Section shall be punished as pro- vided for in Section 3 of this Ordi- nance. Section 2. It is hereby declared a misdemeanor and Prohibited for any. person. or persons. either as owner, or as lessee, agent. or employee of another. at and within the city of New- port Beach to allow or permit any game prohibited by Section 1 of this Ordinance to be dealt. Played, con- ducted. carried on, engaged in. or opened in any building, room. place. apartment or enclosure owned, leased. occupied. inhabited. or managed by any such person or persons. Any Per- son found guilty of a violation of this Section shall be punished as Provided for in Section 3 of this Ordinance: provided. however. that i8 any Person.. or persons, to whom a license has been issued by the City of Newport Beach. to conduct. maintain or carry on the business of a pool room or billiard hall, Shall be found guilty by a court of competent jurisdiction of allowing: ur permitting any game prohibited by Section 1 of this Ordinance to be dealt. played, conducted, carried on, engaged in or opened in any Pool room or billiard hall or in any room or space connected therewith, them In! addition to the penalty provided for In Section 3 of this Ordinance, it shall be the duty of the court [n which such conviction shall be had to transmit to the Clerk of the City of Newport Beach a certified copy of the record of conviction. and the Clerk of the City of Newport Beach shalh at the next meeting of the ara7 of Trustees of said City. present such certified copy of conviction to said Board. and the Board of Trustees.' shall thereupon revoke the license..of any such person to conduct a pool; room or billiard hall. and no further license for such purpose shall bel issued to such convicted person for a period of twelve (12) months. Section 3. Any person found guilty: by a court of competent jurisdiction of any act prohibited by Sections 1� and 2 of this Ordinance shall be deemed guilt- of a misdemeanor. and .shall be punished by a fine not ex- ceeding seventy -five dollars ($75.00). or by imprisonment not exceeding - thirty (30) days. or by both such fine- , and imprison.nenl, in the discretion; of the court. Section 4. This Ordinance is not intended to legislate upon. concerning; or against. and shall not be construed as legislating upon. concerning or against. any of the games mentioned in Section 330 of the Penal Code of the State of California. Section 6. This Ordinance shall take effect and be in force thirty days after its final passage, and in the meantime it shall be printed and Pub - iished once in the "Newport News." a newspaper of general circulation, printed, published and circulated in the City of Newport Beach. The above and foregoing Ordinance' No. 127 was passed at a regular meet- Ing of the Board of Trustees of the City of Newport Beach, held this 23rd day of October. 1916, by the affirma- tive vote of tine following named trustees. and on said day approved by the President of the said Board of .
