J ORDINANCE NO. IE4 AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT BEACH DECLARING VACANT FOR PUBLIC STREET AND PUBLIC WAY PURPOSES A CERTAIN PORTION OF THE RHINE WITHIN SAID CITY. WHEREAS, the Board of Trustees of the City of Newport Beach on the (t 20th. day of October, 1919, at a regu. lur meeting of the Fuld Board of True. tees held on that date., duty passed and � adopted a resolution, being Resolution No. 129, entitled, "A•Resolution of the Board of Trustees of the City of New.' port Beach declaring their intention to vacate, close -up and abandon for public street and public way purposes a certain portion of the Rhine within said City," and WHEREAS, the Street Superintend- ent of the City of Newport Beach after the passage of said Resolution caused to be conspicuously posted j along the line of said contemplated I Improvement at not more than three if hundred feet in distance apart upon said street and public way, and not) less than three in all upon said street and public way, notices of I the passage of said resolution, said ' notice being headed, "Notice of Public Work," In letters not less than one inch in length and stating the fact of the passage of said resolution, its date and briefly the work of improve- mellt proposed, being that of vacating the above named street and public way as hereinafter described, and the I said notice herein (mentioned) re ferred to said resolution for further particulars; said street superintend ent having also caused a notice simi- lar to that hereinbefore referred to, to be published by four successive in -! sertiots in the Newport News, a week- ly newspaper printed, published and circulated in said City of Newport Beach (there being no daily news- paper so printed, published and cir- culated in said City), and more than ten days after the expiration of the time of publication of said notice hav -, `Ing elapsed and no eblections to the Clerk of the ity of Newport Beach, Cal. s sill improvement have een ei veC ed to the City Clerk of the City of 1 Newport Beach, and the said Board of I Trustees having acquired jurisdiction to order the vacation of said street) and public way as hereinafter de-1 scribed; THEREFORE, the Board of Trus-" tees of the City of Newport Beach do [ ordain as follows: i4{ SECTION ONE. That that portion of the public street and public way hereinafter described I ;within the said City be closed up,l vacated and abandoned for public, street and public way purposes; the said portion of said street and" public way, so closed up, vacated and aban. done.d for public street and public way , Purposes is described as follows: All that portion of The Rhine within the said City, beginning at a point in the easterly line of Block 529 of a ,Map of Lancaster Addition to New-1 port Beach, as per Slap recorded in SIap Book 5, page 14, Records of Or- . jange County, California, which point' is 15.31 feet southerly of the north- I easterly corner of Lot 1 of the afore.I ,said -Block 529, measured along the;, I easterly line of said Block 529: thence North 20 degrees 54 minutes 30 sec - ends East, 230.03 feet to a point of the f I intersection with the northerly pro- longation of the easterly line of said Block 529 and the northerly line of Washington Avenue; thence North 89 degrees 15 minutes 30 seconds East, 41.45 feet to a point; thence South 27 degrees 30 minutes East, 28.07 feet to a point of the intersection of the easterly line of The Rhine and the southwesterly bulkhead line establish -I ed by the War Department January; 18, 1917, and which bulkhead line ex -4 tends from U. S. Bulkhead Station No. 124 to U. S. Bulkhead Station No. 1251 as shown upon the Map of Newport[ Bay of the War Department of afore-, said date; thence South 20 degrees: 64 minutes 30 seconds West, along the easterly line of the Rhine, 234.65 feet to a point in the northerly line of 31st. I Street; thence northwesterly along the I northerly line of 31st. Street, around a circular curve with a radius of 235 feet to a point in the easterly line of. the aforesaid Block 529, the-place of i beginning. SECTION TWO: That the public work herein pro-! Aded"for is the closing up of the street and public way herein described in Section One, and it appearing to the Board of Trustees that there are no costs. damages or expense occasioned by or arising out of said work and that no assessment is necessary to pay the costs, damages or expense of said work and that therefore no commis - Isloners shall be appointed to assess benefits and damages. SECTION THREE. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be pub sshed by one insertion in the NE weort News. a 'weekly newspaper, pr.nted, published land circulated in said City and which is hereby designated for that purpose.; Ij�Passed and approved this 15th days !oi Decemocq 1919.
